Hey Folks,

I was looking to get an opinion from as many people as possible regarding a very important decision. This is regarding the I-864 Affidavit of Support. First of all, a little background information. I have an annual salary well above the 125% poverty guidelines and it has been that way since I started working. My 2006 tax return was above the poverty line and my 2007 tax return was below the 125% poverty line by $2500. The reason I missed this cutoff was because I was in Germany with my husband getting married and so on. Had I been in the United States working, I could have easily made that money in less than 3 months.

Now, my question is: Do I send in a letter to explain the impotant details as to why I didn't make the poverty line and that I could have done so had I been in the USA, or not? I am afraid that sending the letter along will possibly point out more problems. I have been employed by this job since 2005, but took the 6 months off and returned working in October 2007. Again, my salary is well above the limit and 2006's tax return was fine, but 2007 missed it.

Do I send the letter, or not? The letter points out the specific facts as far as money earned and not making enough for the 2007 tax return. What do I do?

Your replies are appreciated. I could also post the letter if that would help.

From this FAQ I was able to pinpoint several interesting things.

Is a sufficient I-864 the only consideration for meeting any public charge issues at the time of the visa interview?

No. Even though the I-864 is a contract and the U.S. government prohibits giving immigrants most federal means-tested public benefits for at least the first five years after their arrival in the U.S., consular officers look at other public charge issues. They will look at the complete financial situation of the sponsor and the applicant. This means looking at the age, health, education, skills, financial resources and family status of the applicant and the sponsor. They will confirm to the extent possible that the applicant will have adequate financial support and is not likely to become a public charge.

Can a credible offer of employment for the visa applicant replace or supplement an insufficient Affidavit of Support?

No. The law does not allow for consideration of offers of employment in place of the I-864. A job offer may not be counted in reaching the 125 percent minimum income.

A job offer can be taken into consideration in determining the ability of the applicant to overcome ineligibility on public charge grounds, but it does not meet any requirement for presenting an I-864.

Income is not only dead end. You can send Asset information worth or 5 X $2500 = $12,500. If you can't fulfill this requirement then put as much as you can and get co-sponsor. This co-sponsor can be your parents or relatives.

Thanks for the reply. Unfortunately, I don't have anyone that wants to co-sponsor... which is why it is important that I do this myself. I am just really fearing that I am going to get an RFE. :-\

it is very simple

you need only last return, which is 2007

either you have an income above or under 125 % line

since you are under then you gonna need some assets or joint sponsor

I think it is easier to find a joint sponsor the deal withe assets

anybody can be joint sponsor

just read the guidelines

it doesn't matter what is your 2006 income since they are not asking for it

you can include 2006 but it is not required

I did not included

that would be to much paperwork for those "tired workers" at the NVC

I had also a joint sponsor

it worked

I am just curious if there were any cases in which people came close and they provided additional support and the nvc was able to see that. I do not have anyone who will joint sponsor. That's my problem. Do you think that my letter could possibly help along with my income verficiation and so on? That's all I'm asking. I already understand the basics.

I am in a very similar situation as you, I dont have anybody to be my co-sponsor, joint sponsor, etc. I would suggest to get a letter from your job stating how much you are making now, how long you have been with company, position, etc...and all that written on company`s letterhead, also if you can send letter with explanation the reason why you didnt made the 125% PG, your 3-4 paystubs. Thats my suggestion, hope it will work.
