Bringing my brother to U.S.A

Hello everyone,

I am just curious and a little frustrated that my brother is not in the U.S.A with me yet. I am wondering how long would it take for form I 130 Immigrant petition for relative to be approved or denied? it's been 6yrs that i filed for my brother in August 2002. I was 22yrs old at the time, my brother was 19yrs old. I received a notice in March 23, 2006 that the application or petition has being transferred to the INS office at California Service Center Laguna Niguel. I reside in Michigan but the INS pointed that "We transeferred this case because the record indicated that office has jurisdiction over the case. That office will notify me of subsequent action taken on this case."

Any clue what's going on? I will appreciate it.

Unfortunately, your brother is considered Fourth Preference and it looks like numbers are currently available for applications with priority dates of August 22, 1997 or before.

08/17/08: Mailed N400 to TSC

08/19/08: USPS attempted delivery

08/20/08: TSC received N400

08/21/08: TSC cashed check

09/02/08: Received NOA...........Priority date: 08/20/08

..............................................Notice date : 08/22/08

09/02/08: Received Biometrics Notification

09/18/08: Biometrics completed - Charlotte DO

10/24/08: Received Interview Letter

12/08/08: Interview @ 1:00pm. APPROVED!

01/05/09: Oath Ceremony 10:00AM. Now officially a USC!!!

01/17/09: Applied for US Passport and passport card

01/28/09: Received US Passport

01/29/09: Received US passport card

01/29/09: Received naturalization certificate back from passport office

And you have not since contacted them for an update? You should.

Although usually, these visas do take longer than spousal or fiancee visas -- I think (not sure) you have to wait for a visa number to become available, and that takes a long time. Though I could be mistaken.
