Hi fellas,

I was wondering if anyone here in this forum has heard of extreme hardship waiver been approved?if so please share your experiences.I filed I-751 with the help of my lawyer and just curious what USCIS expects out of my case in order to approve?I always was a silent observer of this forum and it was always helpful to me.Thank you for that.

If you give details of what extreme hardship you claimed you will probably get comments on what others feel the success rate for that kind of petition is. Hardship waviers have a low rate of approval.

There was one terrible case where the USC miscarried and that was not considered a hardship.

In general they are not approved.

First visit:2007-09-12 to 2008-09-23

I-129F Sent : 2007-11-24

I-129F NOA1 : 2007-11-30

I-129F NOA2 : 2008-03-31

NVC Received : 2008-04-21

NVC Left : 2008-04-23

Consulate Received : 2008-04-28

Packet 3 Received : 2008-05-20

Interivew date : 2008-08-07 CO asks inappropraite questions

His father died: 2008-08-18

Retain Marc Ellis 2008-09

Visited Nigeria again: 2008-11-12

petitioned returned to CSC :2008-11-27

returned to USA 2008-12-13

His father buried 2009-01-03

picks up K1 visa Nov 2009

Marriage Dec 2009

take throne as Igwe /Lolo 2010 or 2011

now sorry about not giving the details.But what if state requires 1 year separation and meantime the 2yr GC expires..??? :unsure: you cannot file any type of waiver because you don't meet the criteria for anything :blush: .so I filed that with Extreme Hardship Waiver(had no choice,because cannot file good faith marriage due to state law is can't file for divorce until 1 year separation is over)...have you ever heard of this type of situation?if so please help me out with this.thanks in advance.

What is it you want waived and why? The above is just confusing.

I read a bit on your previous postings. I am not sure that state laws qualify you for any sort of hardship. I am not really an expert on the abuse filings but I see signs of mental abuse in your relationship. Maybe one of the experts could tell you more about what qualifies and what doesn't

For Extreme Hardship to be considered an accepted fgrounds for a waiver, the alien must be able to demonstrate that removal from this country as a result of being denied a green card (in your case, as a result of being denied the chance to remove conditions alone without your USC spouse) would cause the alien terrible hardship, either in the form of

* Separation with family that will remain in the United States,

* Emotional hardship associated with the removal,

* Being unable to obtain a visa to re-enter the United States at a future date, or

* Terminating the ability to provide financial support for a family that will remain in the United States.

However, when an alien finds himself in your predicament, with a mandatory separation period prior to divorce, this is often the only grounds that the alien has to file the i-751 on time and avoid the penalties of "failing to file". It is a strategy to at least meet the burden of filing, while a decree is unavailable, with the hope that if denied, by that time the divorce is well underway.

Thank you so much for your contributions.I have filed to remove the conditions 1.5 months ago and also got NOA1 for biometrics.My question is-will USCIS grant 1 year extension while my petition in process?I am asking that because I never received an extension letter as most of the people do. :unsure: .I will be divorced(most likely)in the October,08 or so.What are the chances of the interview before that(I filled with TSC)?(because if thats the case then I will be in the removal proceedings unfortunately),so confused.Anyway..I really appreciate all your help.May God bless you guys. :star:

You would be notified that you would be subject to removal if and when a petition is denied. Until then your status is still valid. Unless the petition is rejected for some reason.
