Second I-134 Question

Hello

I had submitted an I-134 back in November 2005 for k1 Visa that did not work out.

Now I am submitting 2nd I-134 for my new fiancee's interview.

Question 10 states " I have submitted a visa petiton to USCIS on behalf of the following person(s). If none state none"

Since I only have the one petition open for my current fiancee, I am not sure I need to put the former fiancee.

documents are never that clear with instructions are they? ;-)

I have everything ready, just need an answer on this one..

"I have submitted" is a statement that includes all time up to the present. Yes, you list the previous petition.

Facts are cheap...knowing how to use them is precious...

So wait, this means we do NOT list the person we are CURRENTLY sponsoring as someone for whom we have submitted a petition to USCIS? This is all so confusing. Could someone please clear that up for me?

You would indicate the current AND any previous petitions.....

You list all persons for whom you have submitted any affidavit of support, so in this case there will be two. In my case it was wife and daughter. Does that help?

This is used to determine household size. You list who is dependant on you and then who you've filed affidavits of support for. If there was never a visa or you are no longer bound by the affidavit due to citizenship, 40 quarters etc. they'll figure that out. A person might have submitted affidavits for spouse and six kids before. That's what the question is about.

Thanks for your quick responses..but you know I realize on Question 9 it ask who you had previously submitted an affidavit of

support for, so there I listed my former fiancee.

Question 10 seems to imply who you are submitting an affidavit for now, which is my current fiancee, so if the point is to refer

to the size of the household it would just be my fiancee and myself.

Does that make sense?

When I did the first fiancee visa request, I had listed none for questions 9 and 10 and there were no issues. So I believe by listing

my former fiancee for question 9 and my new fiancee for question 10 that should cover this.

Amazing the instructions aren't specific for each question that is on this form...

9. refers to affidavits. 10. refers to petitions. The names listed may or may not be the same. For instance, you may have sponsored somebody you didn't petition for, such as a co-sponsorship of visitor visa.

True. In my case Question # 9 would apply to me because I filled out an affidavit for my brother-in-law, but I did not PETITION FOR HIM. I'm a co-SPONSOR.
