Hey guys :) my fiancee' just arrived here in Alaska a couple days ago, and we are attending a pre-marriage counseling thing at my Church, I guess we will need to attend six sessions, one sessions a week, before we can get married. So anyway, my question is after we get married how long can my fiancee' stay here for? We plan to file for AOS and all that, but is she going to have to go back home and come back here after it's approved or how does this work? I checked the 129f form and I'm just not sure if I understand things right... anyway thanks for your time :)

with which visa did she enter USA ?

If she enters the US on K1 Visa (Fiance'e Visa) she got 90 days to marry you, after you got married you apply for AOS. She can't go anywhere outside the US until she got her Green Card, unless she applied for Advance Parole.

Assuming your fiance entered on a K1 (since this is in the K1 forum), you will need to be married within the 90 days. Then you need to file AOS (and AP and EAD if you would like) as soon as you can after the marriage (though it can be after the 90 days if need be). Your fiance CAN NOT leave the USA until she has either AP or her green card. If she leaves without either of these, your AOS is abandoned and you will need to start over with a spousal visa. If she entered on a different visa, please clarify so we can give you a more accurate response.

Recieved NOA1's for all Sept 23 or 24 '07

Bio appt. Oct. 24 '07

EAD/AP approved Nov 26 '07

Got the AP Dec. 3 '07

AOS interview Feb 7th (5 days after the 1 year anniversary of our K1 NOA1!

Stuck in FBI name checks...

Got the GC July '08

She entered using a K1, so from what I gather as long as we get married within 90 days and file those things she doesn't have to leave the country? We have no plans of traveling outside the country, just wanna keep her here :D

Accuracy is very important. She's free to leave but will not be allowed to return without a new visa. So, no, she's not stuck with anybody. He better keep her happy or lose her. :thumbs:
