Hopefully I don't get chewed out if they're easily found on the site.

My wife and I are from the same country but she moved here as a little girl (with permanent residency). She recently got naturalized as a USC. We're married and about to file. Does she need her birth certificate to file (seeing that she wasn't born in the US I don't think so but some people on here say it's a requirement). We have copies of her naturalisation certificate for the i130, is that all we need? I have copies of my birth certificate (does this need to be certiffied or would regular xerox copies do?).

Just a little background info on me, I came here as a student, just finished my undergrad degree but about to go to grad school in the fall so I'm on F1 status now and will be maintain it until the AOS switch.

Another question, I work full time and part time now on OPT (my wife is unemployed at the moment). I'm using my income (which is well above the poverty guidelines) on the i864 (I've got the W2s, tax returns and all that as well as my wife's returns from last year). Is it a problem if I'm the one whose funds are used? Also, when I go to grad school I'll be leaving my fulltime job but keeping the part time one. Also, I'm given a stipend at school so those things combined keep my income above the poverty guidelines, will that future change have any effect?

I know the advice on here isn't legal advice but maybe someone may have some insight.

The instructions for the I-130 should answer your question about the birth certificate quite well. If your income qualifies, it qualifies.

US based legally acquired income can be considered

To prove that she is a USC, then the naturalization certificate is what is needed. Her BC in this regard is meaningless. The ID page of her US passport would serve the purpose as well.

Read the instructions carefully... When the USCIS requires an original document they will indicate specifically.. otherwise regular photocopies are OK. (They can be xerox, minolta, canon, etc...)
