Frankfurt says petition has expired, but it hasn't?

We have just received an email from the embassy in Frankfurt, that our petition has expired. Jan's interview is this Friday, April 18; the I-797 NOA2 states that the dates of validity are 12/21/07 to 04/21/08.

They are requesting a new letter of intent from me (I've scanned and sent one to him, as I don't think I can get an express mail to him before he leaves, and will follow up with the hard copy); and that his visa will be issued upon receipt of missing items.

I have sent them a scan of the NOA2, and gotten an autoresponse (it's almost 7:00 PM there now), that says they will respond within 3 days <shrug>.

Has this situation happened to anyone?

I'm sure its just a mistake on their part. The Consulate can extend the validity of the petition, but I've never heard that they can make it shorter.

I've too received wrong information from the local Embassy before. For example, they sent me (through email) the list of documents to complete for my interview as if were applying for a green card. When I emalied the girl back she apologized saying it was her mistake.

Its good that you sent a new intent letter, I hope they are able to realize its their mistake and that they respond to your email soon.

The Frankfurt embassy is great about getting back to you and they are extremely helpful. I bet you will have an answer back in the morning...

Well, I haven't had a response yet, but he has, saying "...Since the visa is not issued the same day as the interview is taken

place it won't be a problem. Whenever the letter will reach us it may be attached to your file."

I've sent him a new letter of intent today, to forward to them.

FWIW, his medical is scheduled for *after* the interview, so I guess this means he won't get an answer Friday, anyway.

Just to follow up, the interview was yesterday. He had to wait for 4+ hours; a woman at one of the desks told him that he wouldn't be able to get to the doctor in time, since they wanted him to have the medical after the interview. So, he'll do that next week, and also will send the new letter of intent that I mailed.

I didn't get an email response from them, though he did.
