Hi,

Not sure if this is the correct place to post this but the instructions for filing EAD when you are a K-3 and not yet filing for AOS are incorrect still in the guides here http://www.visajourney.com/forums/index.ph...page=k1k3ead#k3

Per the USCIS instructions here http://www.uscis.gov/files/form/I-765instr.pdf on page 11 it states that if you are a K-3, filing as (a)(9) then you would file not with the Chicago office as it states in the guides but at your service center per the listing depending on where you live.

the guide says this:

While holding a valid K-3 (not yet applied for AOS). As a valid K-3 visa holder you may apply for an EAD based solely on this status. You will apply as a category (a)(9), K3 non-immigrant spouse. (Where: by mail -- to Chicago ONLY; not to your local office)

the EAD application instructions say this:

If your response to Question 16 is:1. (a)(9), admitted as a K-3 spouse or K-4 dependant; or

mail your EAD application with the required fee to theappropriate USCIS service center below:
