hello vj ers,

i have posted this query of mine but it seems im not getting any idea about it, but i will keep on posting till someone at least share their experience or knowledge with regards to my situation now.

Like i mention we are in the middle of K1 process. But suddenly my fiance needed to move to Kuwait at the end of this month.(hes not military).

I had my interview date last March already but was cancelled because of the failed medical. Only on May 2 will know the result and possibly get another date of interview.

But i like i said hes moving out of US territory already this April.

my questions are:

1. do we abandon the K1 petition?

2. is it USEM to inform the change of country/address or the USCIS?

3.if we get married here in Phil, to be able to join him Kuwait, in the future if he wants to go back to US for good can we file petition of KA in Kuwait and possibly do the interview there?

anyway, question number 3 is not so important at the moment. i need the some idea on the first 2 question.

Ihope someone read this and share more.

Is he actually changing his residency to Kuwait?

The K-1 is a visa to enter the United States, marry, and establish residency within the United States. The U.S. government has no say about what Kuwait will allow. If he is going to live in Kuwait and bring you over, then he will have to work through the Kuwaiti immigration system. Once you both decide to enter the United States again, you'll need to file for the appropriate Visa. If you are still unmarried you can file K-1. Otherwise you'll want to file CR-1.

Why is your fiance complicating matters like this? He's basically abandoning your current K-1.

thanks for the reply. yes he will have to change his residency to Kuwait. ITs not intentionally complicating the matters but opportunity knocks only once. HE have longed to work overseas without tax so he can be ahead financially, its just so happen that he got the job in the mid of the K1 process.

i guess we know now what will happen, leaving the K1 process behind. Work on the Kuwait immigration process for us to be there and together.

we plan to get married now, to be able to join him there. and i guess file for CR1 in the future.

and then she goes join him back with him in koweit under the wife of a foreign worker (probably koweit should have some kind of visa like that)

why dont they go marry in the US and them he alone goes back in koweit while she is adjusting status ???

and then she goes join him back with him in koweit under the wife of a foreign worker (probably koweit should have some kind of visa like that)

I already replied to this thread in another categorie...

there is no more time available to go US and get married.

hes leaving this month and will be in Kuwait for no one knows when.

so I guess the best option is to be with him in Kuwait, get married in Phil. and go through the KUwait immigration process.

and If one day we all want to be in US then file for spousal visa. At least thats i think the best option.

I assume he is a civilian contractor working in Kuwait to take advantage of the foreign earned income exclusion. If so those contracts usually last a year and can re-up at the end depending on which contract company he is with. If he is a contractor just working overseas he will not change his residency I assume. I handle many such contractors who have been in Iraq, Kuwait, Afghanistan, Dubai, Qatar, etc... They have married spouses from various countries then returned to the contract work overseas while the spouse goes through the continued process.

Go through with the process if that is what is wanted. You have 6 months to enter the US after the visa is issued. By that time he will be enough into his contract he can probably take a few weeks to return to the US to marry you then. If he is going to qualify for the foreign earned income exclusion there are constraints on the amount of days he can be in the US. He will have to be out of the US for 330 days in a 12 month period.
