Hello again folks. I have 2 questions for today. 1- My fiance (US citizen) only has the small credit size birth certificate but she was told as she has a full passport she wont need the full birth cert. Not sure if thats correct or not. 2nd question. Her step father adopted her when she was about 10, so she has had 2 different maiden names. What papers will she need to get for this? Is it just the adoption decree?

The adoption decree should be fine as evidence of the reason for the name change. I'd advise her to get a copy of her full birth certificate though.

Thanks Mark and Hannah. Shes in a bit of a panic cause we are applying for the K1 within the next 2 weeks. Does she need both documents for filing the I- 129f or is it for after?

my situation is very similar, adopted by step father (around 21yo), name change.

In my case in the I129 forms (g325 etc) when it was asked the name of the dad i said see attached letter where i put the names of my biological and step dad.

In other name used, i included my old name

to prove it i included my french birth certificate (with translation) because the adoption is written on it with names of all parents. If the one in scotland doesn't include thoses info, i would join an adoption decree.

do thoses before and i keep your originals since you will need it at the packet 3 and the interview.

Also, i would suggest to call the USCIS and ask.

and when the packet 3 will come, ask again to the consulate.

In my case, i asked the embassy because the package 3 mentionned the need of an adoption decree for ppl beeing adopted, it would have been a pain to get it from france and since my birth certificate mentionned it.... they said it was ok like that. (but that can totally depend on the country you are in)

Just talked to my fiance. Shes just told me her mother has her birth certificate. On her birth cert, her adopted fathers name is on there. It got changed after she was adopted. I find that strange and odd, maybe its the they do things in America. Will my fiance still need to get her original papers with her biological father on there or will the other do for when we apply for the K1?

I am adopted all i had to show was my birth certificate and my passport showing im am USA citizen.......my birth parents were not an issue and should not be.......after ur adopted it is as if the parents listed on ur birth certificate are ur original parents........there are many closed adoptions where even the adoptive parents do not know anything about the birth parents..........

I would still ask to both the USCIS and the consulate.. because on the forms (if i remember well) it asks... name at birth (wich might be different than name adopted)

Si if it is logical, they might wonder why the name changed (wich is where either the birth certif and adoption decree kicks in)

now the question is..... they wonder and send a RFE...

or they wonder, and it's not a big deal....

this i don't know
