Im really confused now...this is my case but I dont really know if my husband applied to Direct Consular Fillin or IR1/CR?? HELP!

Im colombian and he is america citizen,,,las year we got married in the US and I came back to get ready for out Church Wedding, meanwhilw he file form I-130 in USCS. I got a proved and the NVC requested him 380 dollars, adafit suport I-864, then they sent me here in colombia a form to set a person or agent in america, not Im waiting for the package with the appointment here in the embassy in colombia. My husband iss not coming to the interview...

Is this DCF or IR1/CR1?

This is the standard process for a CR-1 visa (instead of IR-1 since you havene't been married for over two years).

Your spouse should have gotten the same form from the NVC... Typically the USC is designated as the agent as mail from the NVC will get to the USC faster.

You won't get a letter from the consulate (Packet 3) until the process at the NVC is completed and your file is sent to the consulate.

You've asked an 'or' question about something that is not an 'or' situation.

Submitting an I-130 petition is a prerequisite to applying for a family-based immigrant visa - in your case a CR1 visa. The visa is the same whether the petition is submitted to a USCIS service center in the USA or to a US consulate abroad (DCF).

When we filed DCF our application didnt go through the NVC, it went straight to the consulate in Montreal. Not to say that its the same for everyone but thats what happened in our case.

11/26/05 married!!!!

5/8/06 I-130 filed at Calgary Consulate

5/8/06 I-130 approved!! YAY!!!

5/23/06 Received packet 3

5/24/06 Sent DS230 parts 1 and 2 to Montreal

5/24/06 Sent request for certified criminal record check to Ottawa

Petitions filed by DCF do not go to the NVC by definition - Direct Consular Filing.

A bit confusing in Canada, perhaps, because the consulate where the petitions can be filed is not the same consulate where the visa applications can be processed, but still the approved petitions do not go back to the USA before going to the correct consulate.
