Greetings Everyone,

Well this is my first step towards the process of bringing my sweetheart Arlene (PI) to the US. I read in the instructions of the I-129F that you must have met "within 2 years" of the filing process...what does this exactly mean?? Arlene tells me that we have to know eachother for at least 2 years before we can file for K1. But I told her that I understood it to mean that we can file anytime up to 2 years...am I confused??? I sent a question email about this to USC but got a repy back that they are not taking any email questions, there are too many.

I have known my Arlene for about 1 month now...but things look really positive..and we want to get married. Thanks, Chris

Hi,

it means that the last time you saw your fiancee was maximum 2 years ago, so if you have seen each other within past 2 years you will be fine.

Good luck with your K1 journey.

No...when you decide to start filing the K-1 is totally up to you. It means that you have to have SEEN her within the last two years. THEN, whenever you choose to file it, that's up to you. My fiancé and I first met face to face in 2004 but didnt file til late 2005. Hope this clarifies things :)

Thanks JS...

So I guess that means if its been 3 years and you want to file for a K1...you waited too long???

Chris

The 2 year requirement is the maximum amount of time since you have met in person. If it has been 2 years and 1 day or more since you last met in person, you will have to meet in person again before you can file. If it has been less than 2 years since you have met in person, then you can file regardless of how long you have known each other.

Yeah, all that means is that you've been in each other's physical presence within the last two years. If you've not been able to meet within that time, you can explain why (i.e. that traveling would be a true hardship for you or that your religious/cultural beliefs forbid it). That you've been together for a month shouldn't be a problem, if you've gotten to meet in that time.

Hi CHris!

And since your original question has been answered, here goes an ADVICE!!! Make sure to KEEP all records of your communication (EMAIL, phone bills, chat transcripts, ETC) from now on, and the next time you had the urge of asking the USCIS for information, you'd better off posting your question here on VJ coz you will get answered FASTER!!!

Goodluck!!!
