Hi all

I have a couple of questions that I need to know before posting my AOS on Monday

1) With the divorce do you use the filed date or the date the judge signs it? I believe it to be the filed date but not 100%.

2) What surname do I use on the forms as my wife's surname has changed to mine after we tied the knot so does she use my surname now or her old one?

3) When sending in documents together do we need to supply pictures as requested or will 2 be enough as all the files will be together?

I think that is it but may need to come back for more advice soon

when we filed we put the date the divorce was final

you would use her married legal name

i would send in as many pictures that they are asking for i dont remember exactly how many but we sent in quite a few

....

1) when divorce is final that is judge date.

2) Use married name on the I-485 paperwork, unless you want green-card in prior name.

3) 2 passport photos for each application. (I-485 - 2 pictures, I-765 - 2 pics, I-131 - 2 pics, total of 6 pictures.)

Treat each application as if they were being sent separately, that is do not share any evidence. They are being sent together in same envelope, but will get separated at USCIS for processing, so they need to be able to stand by themselves.

Thanks for the replies. Another coupe for you all if you do not mind. As we have to treat each form separate does that mean separate checks? Also on the 485 part 2, Should I put an x in (A) as I am married to a US citizen or (H) and say I married a US citizen?

I thought the forms were easy until I got to this one lol.

I came in under the VWP but thanks anyway.

Then check A and you need to include an I-130 along with fee, and other supporting docs, one passport photo from petitioner and one for benificiary.

Thanks YuandDan. You are a star. 1 more quick question and sorry about all the asks. I have just looked at the medical stuff and was wondering if I have to have the medical before filing? I hope not as I do not have much time yet and no list is given on the uscis page? :huh:

Yes you will need to visit a US Civil surgeon and get a full medical and vaccination supplement done.

Maybe an RFE, or they may just ask you to bring it with you to your AOS interview. They wont return the case to you because your medical was left out.

Phew. My sphincter has been going ten to the dozen the last couple of hours because of this. I managed to find myself a Doctor and get to see them tomorrow to have all the boosters etc done and the HIV one will take 10 days so that pushes it tight as the office will not do the physical without it. One thing that did annoy me today was the office that does the physical insisting on driving to them (60 miles ) to get a form from them that they could have easily faxed as all it tells you is the jabs you need grrrrrr. Oh well I have the ball rolling and will get the stuff done as soon as I can. Will post everything else on Monday after the Wedding Sunday and then just send in the medical as soon as I get it completed.

David and I met online December of 2006 and spent a year getting to know each other online and with visits! He proposed to me July 2007 onstage at my Favorite bands (candlebox) concert in Florida .We found out we were expecting a child January 31st sadly due to an ectopic pregnancy we lost the baby and almost lost me as well on February 8th. We then decided to get married if my long and drawn out divorce finalized before David was due to go back on April 13th

Divorced finalized March 20th

3/30/2008 MARRIED !!!!

4/11/2008 I 130 , I 485, 1765 and I131 Mailed to Chicago Lockbox

4/21/2008 first NOA for everything

5/17/2008 RFE for Affidavit of support

5/20/2008 mailed in response to RFE

5/22/2008 Biometrics

6/10/2008 EAD Card production ordered!!!!

6/10/2008 I131 Approved YAY we can visit England again!! (nobody from there could make our short notice wedding)

10/28 Interview date
