I came to US last Febreruary 7, 2007 and I have a greencard, I am married to an American and I came here through Fiancee Visa.

But our marriage is not going work because we both have a lot of differences in life, like of having a child, he dont want us to have children, and he is not willing to have one, Before I married my husband I have someone I talk 5 years ago when I was in college on that time, We both found out that we still have feelings for each other, He is willing to give up his life for me, He is willing to marry me and he is very much willing to have us children and he is an American too. Why should I do so that I can stay with him and separate my husband? And If I go back to Philippines, Can I still comeback to the US since I have my Greencard until it expired? I want to divorce my husband and go with him, And if I let my Greencard expired and stay in Philippines Do you think someone can still petitioned me eventhough I was already been petitioned before by my husband? And when my greencard already expire How long it takes before someone can petitioned a new visa for me? Please help me, I dont what to do, Hope that you can answer my questions, Thank you...

I'm not sure on all the legal specifics - I'm pretty new to this whole visa thing - but my general impression would be that Homeland Security would certainly frown on your getting a divorce so soon and marrying someone else. They might assume that your marriage was jsut a way of getting into the country. I'm not sure what action they could take (if any), but it's possible that things may be a bit unpleasent...

That being said, have you talked to your husband about maybe trying couple's counseling? Or even talking to a counselor yourself? Even though I don't know either of you or your situation, it still might be a good tings to think about before jumping into a divorce...

I think there is restrictions on your Green Card for this purpose. To see if the marriage will last and to prevent fraud, I don't know what will happen, but good luck to you and hope your next fiancee have a good lawyer.

Its all for LOVE..
