Missing I-94

Hi

Has anyone ever submitted their AOS package without a copy of the I-94 and if so what was the outcome? My husband has been in the country several years and has long since misplaced his. He has his passport with stamped visa and date of entry. He even has an alien registration number due to an application for temporary residency that he submitted years ago but subsequently withdrew. We were planning to apply for for a new one with the I-102(?) form but think that that may not do much good considering it has long since expired. When I contact the USCIS 1-800 number for guidance, the reps tell me that they are not authorized to give advice regarding that but can only direct me to the I-102 form and suggest reading through the instructions. If anyone has had any experience with this, your input would be much appreciated.

Yes, a copy is required for the application, and yes you file form I-102 to get a replacement. You will most likely get an RFE for the I-94

Just to help you a bit, I also had to file the I-102 to replace the I94,

I filed it on 11/20/2006

received it on 01/30/2007
