Hello All,

I just went to H & R block to get my 2007 taxes done. I spent two hours with the tax preparer with no luck.

Now here is my situation...

My wife has been in the states for a year and we've already filed for AOS. We have been scheduled for finger prints on March 4th. She does not have a valid Social Security number and hence I am unable to claim her on tax return. I tried applying for SSN six months back however, they simply will not issue her SSN because of pending green card.

Is there any alternative I can use to claim wife without having SSN?

Please advise as I have no clue about any of these stuff

The H&R Block Preparer should have known that all you need to do if file a form W7 along with your tax return... this will give your wife a ITIN to allow you to include her on your tax return....

Yeah I just googled it and found out she must have SSN or ITIN in order to file a tax return. I dont know If I want to file W7 to obtain her an ITIN because it may take upto 10 weeks before she gets ITIN. You guys think I should just not claim her this year?

You should file as married for a joint return which will save you money. So try to get ITIN for her. Call up some Tax preparers, explain your situation and ask them about obtaining ITIN for your wife.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

All you need to do is include the completed form W7 with your tax return..... IRS will allocate her a ITIN when the check your return.... ok it will mean it will take a few weeks longer for you to get any refund but it will save you the problems of filing a amended reurn if you wait for her SSN....

Use a tax software package to produce your return.... they all have the ability to print out the return so you can mail it.... the form W7 can be found on the IRS website and downloaded....

You don't ever "claim" your spouse, at least not as a dependent. Your spouse is never your dependent in US tax terminology.

Often, you come out ahead by filing a joint return. The other choice is to file as "married filing separately". If you have a dependent at home (not your spouse), you might qualify for "head of household", but there are a whole bunch of criteria you must meet for Head of Household.

Don't ever try to file as single if you were legally married -- single status isn't legally available to you, and the immigration folks will be checking that when you submit tax returns for an affidavit of support, or for an I-751 for removal of conditions, or an N-400 for citizenship.

Be aware that this year, the tax rebate will not be available to those who file with an ITIN. If married filing jointly, both taxpayers must have a valid SSN in order for any rebate to be issued. If married filing separately, a spouse with a SSN gets a rebate, while a spouse with an ITIN doesn't. It would be wise to figure your tax both ways, as filing separately and as filing jointly, to see whether the difference in the rebate makes up for the difference in tax.

a itin will give you and wife a fat refund. my wife used a itin when we filed our first joint return.
