January Filers at the CSC - How are you doing?

Yes, I've read that several times over the last year trying to better iterpret the law. It's also been posted here quite a bit. I'll try to find the post but I think it was rebeccajo who cleared it up best basically stating that ultimately it is the responsiblity of the Department of Homeland security that gets to say who can and can not work. So, while the K1 authorizes you it basically just authorizes you to be authorized! :girlwerewolf2xn: ... I know!

I think I'd rather be able to claim plausible deniability. :)

:lol: I guess that depends on what you do for a living. ;)

lol...I work at a TV station...with a news department. And don't think I haven't considered it...I just won't, unless I go past processing times...and then you can be sure that I'll be calling up my friends back in news. :)

This is the best thread I can find on the subject... Although, I don't know that it does anything but reaffirm the fact that it's a very gray area that can be interpreted in many ways!

Russell will work for me until he has his EAD then he'll put his master's back to work I suppose. Not too concerned with it here but I can imagine it's a pretty big issue for most and should be made clear.

On that note, and now that many of you have been approved over here ;), have any of you been asked by the consulate to supply a CV/Resume for the beneficiary?? I've never heard of such a request but it was on a short list of documents sent to me via email from the Consulate in response to what financial docs they would need from me.

I wonder about how long it takes at the NVC and getting to the consulate too? Didn't look too long from the timelines...

To jump back a couple pages, I just wanted to share what my experience has been so far with timelines after the NOA2 is issued. Mine was issued on the 28th (Wed), and as you can see in my sig below, it was sent out the 29th (Thur) and landed at the NVC on the 2nd (Monday)!! I just happened to have called the NVC on Monday night and the nice lady gave me our NVC processing number and told me that had gotten our file that morning and it should be sent out by the end of the week. On Wednesday (the 4th) I called back, just cause I was curious, and that nice lady said it had already been processed and was sent out to Costa Rica that day.

So the moral of the story is, things DO move faster after the CSC!! Just one week after getting the NOA2, our papers are on their way to the embassy. Based on my tracking, they average 2-4 days to arrive at most embassy's.

For those of you who are holding out for that NOA2, I hope you find some peace in knowing that once it happens, you WILL see activity quickly, and every day it gets a little easier knowing the countdown until you're together is finally getting SMALLER!

K1 TIMELINE:

01-24-2008 = Sent I-129F to CSC

01-29-2008 = NOA1 Issued

05-28-2008 = NOA2 (125 days after NOA1)

06-02-2008 = NOA2 Hardcopy received; NVC received petition

06-04-2008 = NVC sent package to Costa Rica

06-10-2008 = Embassy received

06-13-2008 = Picked up Packet 3

06-25-2008 = Interview (28 days after NOA2)

07-05-2008 = Home to the U.S. together!

09-20-2008 = Wedding!

AOS/EAD/AP TIMELINE:

10-15-2008 = Sent giant packet to Lockbox

10-22-2008 = NOA1's Issued

11-04-2008 = RFE on AOS only: need birth certificate, ORIGINAL was taken at interview. GRRR

11-24-2008 = Biometrics

12-22-2008 = Mailed RFE packet back

01-02-2009 = AOS processing resumed

01-16-2009 = Service Request filed for EAD (90 days with no news)

01-27-2009 = EAD and AP approved (102 days after NOA1's)

03-12-2009 = AOS Interview, APPROVED!

REMOVING CONDITIONS TIMELINE:

02-18-2011 = Sent packet to CSC

02-22-2011 = NOA1 Issued

03-21-2011 = Biometrics

04-26-2011 = APPROVED!

DONE WITH USCIS FOR 10 YEARS!!

I'm sure you can find employers who will accept just a social security # but many will want to see EAD from the DHS authorizing you to work legally.

Really it is not easy to do even that. The documentary requirements on employers for hiring employees are strict. Look up I-9 requirements. Failure to gather the proper documents from employees can lead to a 10,000 dollar fine and potential jail time - so employers are very unwilling to employ under a social secutiry card alone - there are too many fakes out there.

But JUST NOW, Cesar got an email. I checked again online. And we have been approved.

omg guys... I was just sleeping and all the sudden (like 3 minutes ago) I hear the same noise which always wakes me up when my SO wakes me up in the morning (I sleep next to my laptop in order to be as much with my sweetie as possible) and it turned out it was the alarm I have set to my mailbox... because of something what I just received containend this:

Current Status: Approval notice sent.

On June 5, 2008, we mailed you a notice that we have approved this I129F PETITION FOR FIANCE(E).

I'm reaaaalllly happy now :D :D hehe

K1 Timeline

March 2006- Met on my Spring Break, started emailing/calling each other daily.

June 2006-Started dating.

December 2007- Started getting papers ready for K-1.

December 23rd, 2007-- OFFICIALLY ENGAGED!!

Late December- Mailed all of paperwork off to lawyer.

January 1st, 2008- Attorney mailed off first package.

January 16, 2008- Received package back because check was from Canadian account.

Mailed correct check immediately.

January 29th, 2008- CSC received package.

February 8th, 2008- Received our NAO1

June 5th, 2008- Received our NAO2 via email!!! yay

August 27th, 2008- Interview- APPROVED!!

October 11th, 2008- POE Blaine: Moving for GOOD!!!

AOS Timeline

November 3rd, 2008- AOS Packet received in Chicago

November 12th, 2008- Check cashed!
