USCitizen baby to stay here in Philippines

I am confused with your post. My son become a US citizen when he was 3 months old and he is holding 2 passports (PH and US passport). Is that mean he is no longer a Filipino citizen even if he was a naturally born Filipino American? As far as I know a person who lost their citizenship are those who were NATURALIZED to be a citizen of another country, meaning none his/her parents are Americans and not those who were born to a Filipino parent at the time of his birth. Please enlighten me with this, im starting to worry. Thanks alot!

hi...my parents are filipino, but i am a american citizen. my mom gave birth to me in the united states...but i also grew in the philippines, i never paid any fee... and i am not a dual citizen, born and always have been american. my parents just got recognition papers from department of justice in the philippines to "recognize" me as filipino too so i dont need to get a student visa blah blah...but i never applied for the filipino passport, and i never voted in the philippines or worked there etc.....smart move from my parents huh?

try to get that one for your baby, i wouldnt get dual citizenship because every time i came to the united states...they ask me if i have dual citizenship which never sounded right to me anyway...

for my personal opinion about leaving your son...i left mine...i felt really bad but i had no choice...i didnt have any job yet but i know my mom takes care of him very well...my son sleeps with my parents and they spoil him alot, plus my son has his own nanny 24/7 aside from my mom...so its not so bad leaving him only for a while...i do want him to grow up in america...but i work so much now and i am studying for my boards...tapos nakikitira lang ako sa ate ko muna...

when i get on my two feet and make it here in america alone...ill go back to get my son...so dont feel bad...its a sacrifice for the good of your son's future...

AND DONT LEAVE UR BABY BEHIND. I only saw my daughter a few times in her first 3 years! YOU NEVER GET THAT TIME BACK. Your baby, will not be a baby 4ever! I get depressed when I think about all the moments I didnt get to see. It sux! Really!

I agree with jom that the baby is a dual citizen. He/she became a dual national by automatic operation of the laws of both the Philippines and the US.

A child born of parents who are both Filipino citizens (at the time of birth) in a country that adheres to the jus soli principle (eg, the United States) is a dual citizen. The child, who is a natural-born Filipino because the Philippines adheres to the jus sanginis principle, is also entitled to apply for a US passport.

Jus soli (right of soil) is the legal principle that a person's nationality at birth is determined by the place of birth (ie, the territory of a given state).

Jus sanguinis (right of blood) is the legal principle that, at birth, an individual acquires the nationality of his/her natural parent/s.

A child born of one parent who is a Filipino citizen (at the time of birth) and of one foreign parent (e.g., Australian) whose country adheres to the jus sanguinis principle is a dual citizen and is entitled to apply for both Philippine and Australian passports.

A child born of one parent who is a Filipino citizen (at the time of birth) and of one foreign parent (eg, Australian) whose country adheres to the jus sanguinis principle in a country that adheres to the jus soli principle (eg, US) would be entitled to apply for Philippine, Australian and US passports.

Regardless of passport the baby will use, Philippines or US, there's no escaping the fees. If the baby leaves the Philippines using Philippine passport, you will pay the reduced travel tax (P810). If the baby leaves using American passport, he/she will pay immigration fees (in the thousands). If I were in your shoes, I'd use the baby's Philippine passport when exiting the Philippines and then use American passport when entering the US. Warning though, some Philippine customs officers do not know how to handle dual citizens and may ask you to pay immigration fees for the baby. Be ready to argue your way out of paying the fees.

Do you mean leaving him in the PI while you go on a short vacation, or leaving him behind while you emigrate to the US? If its the latter...it begs the question, why are you contemplating leaving your one year old child behind?!? Regardless of whether its a "just until I get settled" situation....this is for all intents and purposes an infant, and should not be left without the mother for any length of time. Just MO.

Why judge, is it really any of your business?!!! The question is technical in nature.

My daughter of 16 yrs old, is born and raised in the Philippines. She recently recieved her CRBA and passport. the only way she can recieve dual citizenship is if she applies for a Philippine passport. At that point she will be applying for the dual citizenship.

She is an American living in the Philippines. She is not a Philippine citizen. The reason why some are able to use both their PH passport and US passport is because they had a PH passport before they had a US passport. Which automatically gives the dual access. When those passports expire they will have to again claim dual status.

Was your daughter's mother a Filipino citizen at the time of your daughter's birth? If yes, your daughter is entitled to Filipino citizenship.

yup i agree ! my son has a US passport and before we leave im gonna get him a Philippine passport as well, who knows they might be useful in the near future..

I agree with you! And after reading RA 9225 @ gov.ph I believe my son's Filipino citizenship was not lost when he got his US citizenship because his US citizenship was NOT acquired through NATURALIZATION, he was a natural-born American because of his father and natural-born Filipino because of me.

I agree with you! And after reading RA 9225 @ gov.ph I believe my son's Filipino citizenship was not lost when he got his US citizenship because his US citizenship was NOT acquired through NATURALIZATION, he was a natural-born American because of his father and natural-born Filipino because of me.

If the IO looks for the visa, show him your child's US passport. If the IO says, well you have to pay immigration fees because he is American. Tell the IO that your child is a dual national and you are using his Philippine passport to exit the Philippines and therefore he does not need to pay any immigration fees except the travel tax. If the IO insists on payment, ask to speak to his supervisor. Ask them show you the basis for the fee or the law or rule that states that dual nationals using their Philippine passport to exit need to pay immigration fees. I'm sure the IO will try to skim money from you so be prepared.

I stated earlier that some Philippine immigration officers (IO) do not know how to process dual citizens who are exiting the country. I can't find a black and white rule from the website of the Bureau of Immigration to clear this common misunderstanding.

I hope that when you arrive in the US that you will post your immigration exit experience with your son so others may learn :star:

Yes, there should not be any issue for her in getting a PH passport. She is born there.

06/17/2011 Email/Text Card Production - APPROVED

06/20/2011 Received SS card in the mail today

06/27/2011 Received Green Card in Hand today!
