Hi all,

I have a little question concerning I-129

what can happen if my fiancee answer yes to the question of child neglecting : In fact she has a record that say : "contibuting to the deliquency of a minor" . It happen 5 years ago and she didn't follow all the classes.

Any idea ?

Does your fiance have an actual conviction on her record? Or is this an indicated report for child neglect on the state registry? There is a big difference between the two. If its a conviction, then she must check the yes box, if its an indicated report, then she doesn't check yes.

In answering yes to any of the IMBRA questions, she'd need to file a waiver with the petition. The waiver explains what happened with regard to the conviction and reasons why they should "overlook" the conviction and approve the petition. I don't think I've seen anyone in the IMBRA forum with your same situation, but you could for help ask in that forum too. Most people with Domestic Violence convictions don't tend to report back, which is a shame since anecdotal evidence is so vital to this site.

And, of course, like Karen pointed out above, a consultation with an experienced immigration attorney would be a worthwhile investment of time and money.

Your are right, I think in our case a lawyer will be helpfull.

This process seems to be so long sometimes... let's be patient and strong... love will be over all..

Another question that should certainly have been asked :

Once we send I-129 , will I be able to visit her under waiver visa program ?

Yes, but they may not let you in. Bring evidence that you intend to return.
