K-3 question

Ok everyone,

Im sorry in advance, because I know this has been a really difficult thing for alot of people...

We will be mailing off our 130 very soon and I want to wrap my head around this first, so Ive been thinking:

I know there has been some uproar about K-3's being cancelled. Some posters are saying that the USCIS has said that the K-3 is no longer an option and it will be cancelled. While others are being approved :insert confusion:

I have also noticed that some are not following the instructions which state that you should wait for an NOA on your i-130, THEN send in the i-129F with the NOA attached.

So, here is my question:

Is there a common denominator?

Are the people who are getting this "the k-3 isnt valid anymore" the ones who have followed the procedure or ones who just filed the two petitions together, or before the NOA on the i-130 has been received? Or both?

Thanks for your input and experience. I appreciate any clarification you guys can offer!

Lisa

"you fondle my trigger then you blame my gun"

Timeline: 13 month long journey from filing to visa in hand

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive, and unecessary. Once you walk a mile in their shoes you will understand and be heard.

Thanks!

I've been watching this with great interest and from the best I can tell, the K3 visa path is at least temporarily blocked for those filing I-130 after July 28, 2007 and that filing an I-129F together or later will delay your process rather than speed it. This could change tomorrow but I wouldn't count on it. Unless you live in Western Canada, you'll probably be glad you never filed an I-129F and maybe even then too.

Facts are cheap...knowing how to use them is precious...
Understanding the big picture is priceless. Anonymous
