Hey, sorry for the long absence... it's just that I've been so caught up with getting adjusted to life in the US, near my husband and a new family :) .

Vernon, I think it is obvious they require I-134 for your K-3 and then later when you will ajust status you will have to send I-864. That's what I'm doing now.. AOS with Affidavit of Support I-864.

However we were also worried they might ask for something else at the interview so my husband sent me I-134 and I-864 just to be on the safe side. I needed I-134 (which I gave at the embassy) and I just put the I-864 asside at that time and I sent it in the AOS package on July 15.

That's about it. If you have any more questions I'll try to answer them. How's the baby?

Our K-3 timeline

- jan. 12 2008 - Wedding

- feb. 11 2008 - sent I-130 to Chicago lockbox

- march 06 2008 - sent I-129F to CSC

- may 06 - APPROVED

- jun 12 - medical and interview passed! Visa in the passport!!!

- jun 24 - entry in US through Chicago

AOS

- jul 16 2008 - AOS + EAD sent to Chicago lockbox

- jul 28 - NOAs for AOS and EAD

- aug 6 - Bio letter

- aug 11 - RFE e-mail (I-864)

- aug 19 - Biometrics done (they scanned my little fingers maybe 20 times because fingerprints were not clear enough :P )

Okay so I'm sick of waiting for people to tell me when to jump and how high to do it. So today I took the process into my own hands and I'm taking a chance to see what I can do.

I was told I had to apply for a police clearance. When I did that I was told it would take 6 weeks. After waiting for 2 weeks and making numerous calls to try and speed it up, I found out that it will be ready on August 9, which is one week earlier than expected. Once I had that and the forms from Cody in my hands I was then able to apply for my interview date. This meant waiting another 3 weeks for my time to go to the embassy. So today when Cody's papers arrived I decided to be daring!

I gathered the forms I needed to submit to apply for my interview date and scanned them in. I then emailed my caseworker, who has been amazingly helpful and understanding and asked to have my interview scheduled around August 14. This is would give me enough time to make sure my police clearance was completed and not make me wait till September to have the interview.

I'm feeling hopeful and confident again which is something I have been lacking the last couple weeks. Keep fingers and toe crossed for me and I'll keep you updated on what’s happening.

Update, Said had his interview today and I think everything went well, not sure till I talk to him on the computer. He said it lasted about 10 mins. and the lady said they would call him (no mention of time frame) and gave him a white paper saying they need additional processing and they didnt need anything else from him. Not quite sure what to think of this yet :unsure:

Glad to hear things went well! Can't say I have heard anything like that before (about the sheet) but hopefully he hears something soon. I know how much endless waiting can drive a person insane. Good way to look at it is that they didn't ask for more evidence! Good luck and keep us posted.

Ok to me this dosnt sound all that good. Help Im going crazy. :unsure::blink:

oh wow! that doesn't sound good. what did they tell said when he asked about it? you were applying for the k-3 visa right? have you found anything online about it?

Are you sure its section 212(a)(5)?? I looked it up online and this is what I got. Hopefully it is of some help for you!!

Please, read following questions see If It rings a bell.

a. I-130 petition (Father --> Son in India) interview got rejected because of 212(a)(5)(A).

What is section 212(a)(5)(A) means ?

b. Is it possible to waive section 212(a)(5)(A)? If it is then What is the process to waive 212(a)(5)(A) ?

c. Can he reappear for visa interview? When ?

d. Do we have to appeal this case in India or US?

Here is some brief about my brother case.

Dec-2000 Father came to US (family immigration) and my brother was over 21 age and unmarried

Jan-2001 Father got a greencard & filed for my brother based on greencard & my brother was unmarried

Jun-2002 My brother got married.

Aug-2004 My brother got divorced.

Mar-2006 My father became US citizen & convert greencard based petition of my brother to US citizen base.

July-2006 Case got approved in USCIS.

Nov-2006 My brother got medical examination & interview call.

Please, any kind of help would be greatly appreciable.

Me & my brother are waiting to hear back from you guys…..

Are you sure it is Section 212(a)(5)(A), as this relates to an employment based situation? 212 (a)(5)(A) states that an alien seeking entry for the purpose of seeking skilled or unskilled labor is excludable in the absence of an approved labor certification. This ground of exclusion applies to the second and third employment-based preference categories. "Alien labor certification" is a process that, when completed, results in certification by the U.S. Department of Labor that there are not sufficient workers who are able, willing, qualified, and available at the place of proposed employment and that such employment will not adversely affect the wages and working conditions of workers in the United States similarly employed. INA Section 212(a)(5)

well this website lists all the reasons why they would reject it at this time. so double check with him to make sure that's the right section and maybe even have him email his case worker. i know i have emailed mine a couple times already and they are really helpful!!

well you werent denied honey, your under AP which if you look around the site awhile will find out thats just Additional Processing, which sucks, but you havent been denied yet. but many people in this forum are going through the wait of AP, take a browse around and im sure someone whos going through this can give you the info on this that you need :)

I emailed CASA yesterday and I heard back from them already. This is what they told me,

Madam -

Your husband’s case requires additional admin processing. This processing is required by law and takes place in Washington. We don’t need anything more from you at this time and we will contact him when we are ready to proceed with his case.

Thank you all for putting up with my craziness and panic. i reall appreciate all of the help and guidance you offer here. i think i would have totally lost my mind if it wasnt for the ppl on here. you are all a great bunch of ppl.

yep i am a febuary filer and already a frustrated one seeing that the uscis is approving other petitions sent in march...and hasnt even touched mine which was filed a month earlier

sept. 19, 2008--- approved

NVC:

sept. 26, 2008----got case # from a live operator

oct. 6, 2008 ------received AOS bill/paid online

oct. 7, 2008 ------shows PAID

oct. 14,2008 -----IV fee generated/ paid online

oct. 15,2008 -----shows PAID

oct. 16,2008 -----mailed DS230 overnight

oct. 23,2008 ---- RFE

nov. 3,2008 ----- case complete

nov. 26,2008 --- medical exam

update - today i got an email from my case worker and it had my interview date in it, august 18 at 12:30pm i'll be meeting with my case worker. cross fingers and toes for me please!!

well i thought i'd update you guys on my case. everythings been going through smoothly, i finally am done with paperwork at NVC and am just waiting to hear the magic works "case complete" from AVR lol
