Hi, i see in ur timeline that u had ur interview for ur AOS on Date : 2008-01-31, which that means you dint wait that long, i was like you but i get rid of that name check on 2 months and 10 days after my interview, so if i am in ur shoes i will wait a lil bit maybe u will get clear on ur name! but if u wanna travel (urgent) i see no problem to file ur AP.

Good Luck!

You may file the I-131 and I-765 concurrently with your I-485, or you may submit the I-131 and/or I-765 at a later date. If you file Form I-131 and/or I-765 separately, you must also submit a copy of the receipt for your Form I-797C, Notice of Action, as evidence of the filing of an I-485.

http://www.uscis.gov/portal/site/uscis/men...00045f3d6a1RCRD

According to the I-485 form notes you should be able to file your request for AP afterwards, for free even, as long as you send a copy of your AOS NOA.

Hope this helps

Thanks Sand i know i am getting a little scared about it, I am not sure if we are stuck in name check or not and i guess the interview did not go as good as i had hoped so that is also adding to the stress. Just wish i could know a simple yes or no :(
