I-864, working abroad in 2006.. How can prepare tax return?

Timeline

I am preparing I-864EZ. It needs tax return including W2 for 2006 to file. My hubby(citizen) worked in Korea in 2006 and he even didn't file tax return and he doesn't have any W2 in 2006. His income was higher than poverty line..

He begin working the company in US from 2007 so he can prepare 'employment of verification' of the company he works for now.

In my case, how can I prepare the document for I864EZ? He will do late tax return for 2006.

Is it OK to send I864EZ with 2006 tax return(without W2) with statement his status(he worked abroad in 2006 so he doesn't have W2 for 2006)(+the proof he works for US company now and his income is higher than poverty line now)..

Please help..

Even if a U.S. citizen works in another country, they are required to file income tax form with the IRS. There is a schedule to be used, I think it's schedule F to report foreign income, even though it's not taxed.

He can use form F2555 or F2555EZ to take the foreign tax credit.

Since he worked in Korea in 2006 - it doesn't matter whether he made over the poverty line or not as he cannot use his foreign income for the Affidavit of Support unless the income will continue to the United States, which from what you said is not the case since it sounds like he started working for a new company in 2007.

You won't be able to submit a W2 for 2006 although you will be able to get a tax transcript for 2006 which will be just as good - you can request this 3 or 4 weeks after you file the return.
