This may be a silly question but here goes... my fiance won't be able to come to the states until December 2008, when he finishes school, so when should we start the paperwork? It seems like some people's paperwork flies thru the system within a few months, while other people have to wait much longer. I know it's hard to estimate but if he won't be able to move here for a while, should I start the paperwork 6 months before he plans to move here or is it better to start now?

Again, perhaps this is a silly question but hearing people's feedback and stories is so helpful and makes this whole process a little less daunting.

Thanks!

People filing now will go through the system quicker than ones who have filed within the past year.

If I had to guess, though, I'd say you are still looking at at least 5 months from I-129f filing to "visa in hand".

I'd go ahead and file now. Who knows what delays you might hit! Plus, you can always stall the medical and/or interview a bit, and the K-1 is good for 6 months from when it's issued, so unless he gets the visa before June, you'll be ok.

Good luck!

Hi and welcome!

You have not asked a silly question! All of us are here to help one another answer any question we can.

You could start now if you like. Once he receives the K1 visa, he has up to 6 months to enter the States using it. If you filed now you are looking at a 6 to 8 month wait to get the visa. So even if you guys got it in say July, (which would be awesome!!!) he would still have a 6 month window from that time to enter the states.

I would go ahead and file now.

Best of luck!!!

Defo - go for it and good luck!! You might hit delays and like the above posters said - you can delay things a little at later stages anyway :) I am not moving until the end of June now so if I get my packet 3 before I go to visit the US in Feb I am not going to send it back until after anyawy - an interview date while I am away would not be good!!!

He is only actually "able" to come to the States when he has a visa in hand. If he's gotten visas in the past, then based on my experience, his chances will be better for a more expedient processing on the Albanian side of things. Basically, the Albanians I know who don't seem to have trouble with getting visas is because they have a history of getting visas.

I haven't kept up with current timelines..but it used to be that K-1 visa only gave you a 90 day window for when you had to get married once you arrived in the USA. You should check the opportunity windows for each stage of the process to be sure of the timing of things. Also keep in mind that December is a very heavy travel/holiday time and not much seems to get accomplished then.

I think applying know would be a bit too early, but I would start now doing a "dry run" of understanding the process. Go ahead and get the forms and start filling them out so you can keep everything as complete and concise as possible. Then check the forms again in April or May to make sure you have the latest updates and file then.....not so much advice but my opinion and feeling about this.
