Any input would be helpful:

My fiancee has been approved for work visa in NY. I am wondering how this effects my applying for a fiancee visa? I thought I had read somewhere that her paperwork had to be filed in embassy out of country??? I'm just confused on the next step??

Your profile says you're married and have applied for a K-3 visa, is there more to this story?

Yes, confusing.

Fiancee K-1 visa is filed for by US citizen to the USCIS service center in the USA having jurisdiction over their US address, NOT at a US embassy or consulate.

I had forgotten all about that timeline. I have been away form this site for quite some time. Yes, I had applied for k-3 visa but life and my partner had other plans. I agreed with her decision, we got divorced and I took some time off. As timelines go it went rather smoothly. Up until her interview.... thats when we stopped the process. I guess I need to erase that timeline. All in all it was a good life experience. So now I'm just trying to figure out the K-1 process, because she is already working in NY on work visa.

I would just marry her and apply for AOS. That way at least you can live with each other without having to be separated while you go through the whole K1 process.

Yes, from the minimal information the OP gave, that's where my head went to. However, that information isn't enough to be certain about that.

To the OP...

What is the specific visa category? Did you meet her after she arrived? If not, did she become your fiance after she arrived?

FYI, visas are used to enter a country. Generally, when a person is already in the US, they don't need a different visa. Instead, they need to adjust their status.

If you met or decided to marry after her arrival, you probably can simply get married and adjust her status to permanent resident, based on the marriage.

Ditto that.

There is a guide for this situation.

http://www.visajourney.com/forums/index.ph...page=i130guide2

Check "a" in the I-485 "Based on approved relative petition". (the included I-130).

Apply for EAD at same time and include it in the same envelope, use code (c )(9 ) I-485 pending.

http://www.visajourney.com/forums/index.ph...mp;page=k1k3ead

You pay fees for the I-130, and I-485.

File everything to the Chicago address for I-485.
