Timeline

Once my fiancee and I get married, my parents will be his sponsors for the I864. Neither my fiancee nor I come anywhere close to being able to meet the levels. My parents however, do. THe wording of the requirements confuses me. Can my parents be the sole sponsors? OR do I need to begin collecting my tax returns to prove that I can´t support him? THanks for helping me clarify this.

2/20/2007--K-1 interview and approved visa!!!

3/14/2007--entry into the U.S

3/19/2007- civil wedding

3/21/2007--OAS papers mailed off

4/21/07 Biometrics appointment

6/20/2007--AOS interview in sacramento--almost aproved

interview @ tampa, fl office: april 26, 2007

green card received: may 5, 2007

removal of conditions timeline:

03/26/2009 - received in VSC

07/20/2009 - card production ordered!

You are the primary sponsor. You need to show what you earn, no matter what it is, even if it's not enough to support your fiance. Both you and your parents will fill out a separate I-864, you will check the part that says you are the sponsor, your parents will check the part that says joint sponsor (sorry, I don't know the exact wording, but it's something like that). You need to attach your W2s and taxes (I would recommend you send tax transcripts since they sometimes will send an RFE for taxes, even if you send in W2s and returns). Your parents also need to attach their W2s and tax records (again, it's easier to have them order free tax transcripts so you don't have to worry about missing some of the information they want from you). You and your parents also should attach employment letters, etc as in the instructions on the I-864. If you can't send an employer letter, for instance, address this in a cover letter. Also explain in the cover letter that you are the primary sponsor and your parents are joint sponsors.

A final note, I would recommend you attach 2006 taxes as well since so many people got RFEs last year who filed at this time, we thought the RFEs were likely for 2006 taxes even though we filed well before April 15th.

Hi,

Just read your final note Re:2006 taxes. We had our taxes done early and have our refund. We were only going to send in 2003, 2004, 2005 taxes because we read on VJ somewhere that if it's before April 15th, the prior year taxes aren't required. The only reason I was excluding 2006 is that we filed as married (she's a USC and I'm here on a TN visa) and we're not sure if the 1040 should go with her I-864 or my I-864A or both? (we're also using my income toward the poverty line amount... she's $387 short!!!)... or both?!?!

Any advice or feedback on this would be appreciated!
