Surprisingly it looks like I am required to attach very little under the 5 year rule.   Unless I missed something it's essentially copy of the green card, payment and proof of termination for other marriages.  The rest does not apply to me.  I do have the following 2 questions though:
 

For proof of termination of other marriages, is it  only for myself or do I also need to include my wife's prior marriage?

 

Also I am not clear with the reference to dependent spouse.   I do send support payments to my ex-wife, however she is not a spouse since we are divorced.   Does that part apply then or is this only for people that have a support obligation to a current spouse?

I only attached my own divorce decree, since I am applying under the 5 yrs rule.

 

Maybe the following would apply :

When you apply under the 3 yrs rule, you would have to attach divorce decree for both applicant and US citizen spouse IF :

- you obtained your GC through marriage to US citizen and the US citizen spouse you are currently married to and applying through is different than the spouse you obtained your GC through (because that would basically bring him in late in the process as they would already have info on prior husband from your file).

- you obtained your GC via work, are currently married to a US citizen and don't want to wait on the 5 yrs rule for work based GC naturalization.

 

Not sure where you saw the dependent spouse reference.....

  • NOA1 in mail 06/13/2007 (who said 13 is badluck )
  • 07/30/2007 After no touches and no other signs we just got an email with the APPROVAL of I130....Thank God !....now what ?

  • 08/07/2007 Case received by NVC and case number assigned :))

  • 08/13/2007 DS3032 and AOS bill were generated

  • 08/14/2007 Emailed choice of agent ...i'm so curious when they will accept it...hopefully soon

  • 08/21/2007 DS3032 and AOS fee bill arive in mail

  • 08/27/2007 paid AOS fee bill
  • 8/28/2007 DS3032 choice of agent accepted
  • 9/3/2007 IV fee bill generated

Only need to send photos if located overseas, or at least that's how I interpreted it. They will take photos at Biometrics apptment.

  • sending I130 05/16/2007
  • cheque is cashed on 06/11/2007
  • NOA1 in mail 06/13/2007 (who said 13 is badluck )
