Went to Oath Ceremony and was denied to take oath.

Hello All!

I am new here. Pretty weird day going on. I did my interview for citizenship and i got my letter in the mail for my oath ceremony today. I went to the ceremony and immediately the immigration office told me i could not swear in today because i did not disclose 2 open summons that i have against me. When i heard this i was puzzled as i was arrested back in 2013 and i disclosed this to immigration and i provided the original disposition when i interviewed. I called the 1800 number and they told me to make an appointment with the interview office. When i went there i was told there are two summons open in my name. I was shocked as i did not have any summons in my name and i was told i needed to go to court to get documentation to prove that the charges were not mine. Seems like someone else with the identical name and same birth year had 2 open container charges and somehow it showed up under my name. I am kind of worried as the only thing that the court was able to provide me was a copy of the summons. I understand that the charges arent mine and the copy proves it but does anybody know if Immigration would take a copy of the documents so i can clear my name and have my oath rescheduled? Obviously i will not have the original as i was not the one charged and the courts will not give me a document that doesnt belong to me. Any advise on this? Im kind of freaking out as i was pretty excited to swear in this morning.

you can go to nycourts.gov and click on Ecourt and then Criminal Court and search the summons by your first and last name if its still active. That'll also tell you if someone else with the same name have any open summons or pending charges.

That's a very weird situation but I dont see any reason why they would not accept whatever you have as long as it clearly states 2 summons arent yours but someone else. good luck

Thank you for the confidence. I am going back to the office tomorrow morning and hope that this will end this crazy ordeal :::fingers crossed:::

Yes i tried that and i got the summons number and went to the court. Hopefully the docs that i have will end this. Thanks for the help!

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

hey any updates? it happened to me too during the oath ceremony. i told the lady that i was not arrested on July 20, and she clarified to me that they just need a new court disposition dated after my conditional discharge. I am still waiting for their response after i submitted court disposition certificate. it's been 2 months now and i'm scheduled for infopass..
