we have to yet registered our marriage , we would need the marriage certificate (copy ) right while i file i130 ??

so was thinking to register in the US , get the certificate and file

initially we were thinking of registering in india by the end of the year and get the marriage certificate and file in the states

guess registering in the states would be much faster ( than in india )

You register your marriage where ever you're married, not in the USA. I've never heard of registering your marriage other than the location of the marriage. Normally you register it when you get married.

The institution that conducts a marriage typically issues a document to that effect; which is then submitted to the local municipality. Marriages are registered with the local govt where ceremonies take place. As you likely married in India or Canada, the US has nothing to do with registration.

You submit a copy of the registration with your petition. Your wife awaits processing in India once she completes school. VJ members would say a big no-no to entering the US on a visitor’s visa with the intent to adjust and simply to ‘..avoid waiting..8-10 months to get her visa.’.

when i apply form i130 , with copy of marriage certificate which has my spouse's name change but she does not have her name changed on her passport

will that create an issue later ?

should she change her name in the passport as well ?

If she wants her vis and green card in married name she needs to change her passport before interview.

she is worried that if she applies for name change it will be a brand new passport and then she has to re apply for her Canadian visa (student visa ) and us visitor visa she has

Not sure. I've never had to deal with any other visa than the CR1.

Better off changing name after school ends and she returns to India to await spousal processing. Both visas would subsequently be moot in favor of an IR\ CR-1 adjudication.
