annulment is 150k in pesos now. No appearance in the court. it will take 11 months to process. my wife is annulled last 2004. we met 2011. just be careful whom you will talk coz in the Philippines if they will learn you are an American they will take advantage and they will charge you more lol

The plaintiff would need to appear in one of the three meetings for annulment process. The lawyer can attend in there stead but in one of the appearances the plaintiff will be asked questions about the relationship and the facts of his or her case so they must appear.

There is no divorce in the Philippines. However a person can divorce person from the Philippines in any other country regardless of where they married .(Philippines or wherever) (A good Immigration lawyer will know that) If he is the one to file for divorce then she being the Filipina is consider divorce as well. If she files for divorce then she will have to get an annulment not him.You should or have your lawyer study the family code of the Philippines. Here is a link to it

Sorry wrong. :no: There is divorce in the Philippines. If you are a Muslim, you can take your case to a Sharia Court and have your divorce processed. See Presidential Decree No. 1083 "Code of Muslim Personal Laws of the Philippines"

He is graduated from the University of Georgia with Masters and Phd, of English, and minor in Psychiatric evaluation. I know odd combination.

Smart man, but has very limited access, to information like this,.,..,.

American married a Filipino, in Cebu, Philippines, and it came "un-glued" and was done and over, she left him after he had thoroughly explained to her, what her life would be like as he earns his living, and is an amateur writer.

Since he is a USC then he can divorce her and move on with his life. He can remarry with no problems. She on the other hand would need a copy of the divorce papers from him and she can go through the steps in the Philippines with the outcome being that she can remarry because he was the one who initiated the divorce proceeding on her. If he is a nice guy and willing to burry the hatchet, he should get a copy of the final divorce with endorsements and certified and send it to her. He will probably never see her again and it would be a good gesture on his part. Everyone deserves to be happy and in their case, each would be free to pursue their happiness.

Timeline

I have a good friend, who is a Professor of English, teaching in China. does not have access to the site from his part of China.

He was married in the Philippines, Cebu, 2012.

His wife came to China, and stayed a few months, then left, back to the Philippines, and has not been heard from again! Said, she could not live like that, but the whole situation was explained to her before the marriage, it is not as if she did not know!

We know there is "no such thing as divorce in the Philippines" but there is an annulment, and that takes 3-5 years, and thousands of dollars, and it must be proven that either the man or woman, was mentally incompetent at the time of marriage!

HE WAS TOLD AT A CONSULATE (NOT SURE WHICH COUNTRY) THAT AFTER 5 YEARS, OF SEPARATION, their was some paperwork he could file, somewhere, that would dissolve the marriage! I have no opinion on this, as I am married to a Filipino, and we have a good marriage.

I had no idea where to file this question, move it around if need be Mods., as he just wants to know if there is """ANY OUT"" for him from this horrible marriage!!!

Is he just married for the rest of his life? And wife left him years ago, and not been back, and he has no idea where she has gone to!

Pleas, help him, if you can. Thank you!

a us citizen can get divorced anywhere in the world where he is a legal resident.

holding a work visa in china makes him a legal resident in china.

he could file for the divorce in china, takes about 60 days with an absent spouse without any input into the system.

or if he maintains a residency back in the usa, an attorney could file in that county (not country) in the usa for him (the us citizen).
