Timeline

According to admin process guidelines after 12 months you can ask them for the status and they have to reply about the process my k1 admin process took 1.6 years and finally it got finish.

If you have waited for a year or over in AP and still did not get visa your sponsor (spouse or Fiance for marraige based visas) can file a petition in the federal court called Writ of Mandamus. You do have to show the judge proof that you have exhausted all your options to request the consulate/state dept to take action on your pending case, but seen no result yet. The federal judge can order the consulate or the department of State to complete your case. I have seen that usually when you send a letter to the consulate or the state department saying that you intend to file a writ of mandamus against the agency, they magically issue you the visa ASAP, because they do not want the courts to question their process.

Writ of Mandamus does not apply to visit visas.

Eabbas, I was wondering if people are comfortable can everyone mention the name of the benificiary with the AP wait time. I did a lot of research and found out that AP wait time does depend on name to some extend. If the visa applicant's name matches or is similar to the name of a person on the FBI wanted list, then there needs to be extensive investigations before visa can be issued. I looked at the FBI website yesterday. I looked at their top 20 most wanted terrorist list. Unfortunately, I found that there are four wanted terrorists with my husband's first name somewhere in their full name and figured that is the reason for my husband's case being sent back for clearance to Washington DC for the 3rd time. Not to mention the name does not have to be a exact match, anything similar will delay the case. It is unfortunate that the governement has not come up with a better process to clear these names faster.

i have no issue with that as long as we do it correctly... My husband even used hid own name here on vj...its adil abbas im sure we are stuck cos of that

Daer RealAL ,, i want to know that i waited for more than 17 months under AP can i file Writ of mandamus and how long does it take to complete and how much it costs.Please let me know all the process and most importantly whether it affects my case like it angers consulate when i ask them todecie my case otherwisw i will file writ of mandmus because i am afraid to say that this thing (warning)may affect our case and they decide in nagative.

I've been reading about the Writ of Mandus throughout the VJ section and from what I've read you don't necessarily file it right away. You write a letter first to the embassy send it certified so you know they received it or with a confirmation of delivery so you know that it got there. You basically explain your situation to them and tell them that you will be filing a write of mandus within 30/or 60 days giving them time to get your case complete. If those days pass with no results and nothing going forward THEN you hire a very good immigration attorney who has filed these lawsuits before and get it started. But you can't just file it.. you need to send a letter to them informing them you are considering this action due to the lengthy AP first.

Sorry about that.. im feeling stressed at this point that we may also be seeing a year ... who knows.. good luck

I normally don't do these trackers as the topics often die down, but being in the same boat and going through such a hectic time in the past one year plus I'm willing to give this a try. Interview was June 6th, Fiance` K1 Visa. Interview went smoothly at Islamabad, the lady counsellor was surprised I had a strong British accent for someone from Pakistan (told her I've been in UK for quite awhile where I met the lovely) and put in mandatory AP after 15-20 minutes of constant questioning. The questioning I didn't mind, I love talking about the lovely and I!

I have also been reading about Writ of Mandamus. There is not a lot of information about it on the net. It's expensive to hire an attorney but I think well worth it if it forces the embassy to make a decision no your case.

Gil1234... thanks for joining this.. most of the issues with being able to see the results of ap for ISlamabad is that most of the people don't complete their timelines and this way we can at least get an idea of who its affecting and for how long and then we can celebrate with them as they get the visa!

Carolyn, I too think you should look at the writ of mandus. I'm not sure the entire pros and cons but it's definitely worth researching. Background checks etc are fine but when they delay for so long it makes life very difficult and stressful and heartbreaking. Let us know what you find out.. we have a long way before we have to look into that but anybody on AP after interview for over a year should definitely research it!
