getting a holiday visa while waiting for IR1

I think i know the answer to this question already, and i'm sure that there is almost no chance, but i thought it was worth asking anyway.

we got married in september 2006 and started the process of direct consular filing. as soon as we had all the documents assembled, we took them to the consulate, only to be told that the law had changed at the beginning of that week regarding payment and we could no longer file there. my husband had to go back to the usa for work anyway and started what he thought was the K3 process. due to some confusing legal advice, we realized four months later that we were applying for the IR1. this whole process has been so frustrating all along the way. when we got the DS3032 i thought we were close to the end, only to realize yesterday that we still have ages to wait and will probably miss our first anniversarry.

my husband can't come out to visit me for any decent length of time because he is working. i on the other hand do nothing but wait. is there any chance that i could get a holiday visa for a month or two to go over to the USA and visit him while i am waiting for my visa? i fully intend to come back to South Africa and finish the visa process here. if it is possible, what would i need to prove my intention to return? it feels like we have been waiting forever and the end seems so far away!

You can apply for a holiday visa, you would need to prove to the Embassy that you are indeed going to return to SA.

Check the Embassy web site http://pretoria.usembassy.gov/wwwhvisas_nivguide.html for details and you could contact them by e-mail, is says you can on the web site, to ask questions. So ask what they would accept as proof. Quite often an employers letter and details of a mortgage or rental agreement and/or bank details that show you would indeed have to return are ok.

Just because you have applied for an immigrant visa doesn't stop you applying for a holiday visa, it just makes the Embassy a little more cautious about your intent.

thanks :) problem is i've been waiting for so long to get to the USA that i have nothing tying me down here - no property, no bank accounts, no job, not studying and i'm staying with my parents. i'm doomed. i think i'll just forget that idea and save myself the $100. thanks for your help tho!!

My wife asked and they took our $100.00 fee and said sorry No!!! In order to come here on a travel visa, we where told you cannot have anything in progress or any plans to immigrate. So if you have ANYTHING in progress IR1 CR1 k-3 they will assume you will not return, being your plannig to immigrate. Double check your status with the gov. IR1 and Cr1 is sometimes faster
