No criminal record on NBI Clearance. Pls help :(

Hi everyone!

I got my NBI Clearance just this month and it says No Criminal Record. I have a theft case from 2 years ago that was immediately dismissed after a couple hearings. I have my interview scheduled this month as well for my K1 visa. I just have a couple questions.

Will I get automatically denied because of that? I deeply regret what happened before and I hope I wont get denied. Also, I've been in the US before and been nothing but good there. Also about the letter of explanation from NBI, can I get it before my interview or should I wait for the embassy to ask for it after the interview? I've did some research about it and just confused whether to wait for their 221G or if its even possible to get it before the interview so I'll be prepared then. And lastly, what other documents will I need for this case besides the letter of explanation from NBI? I have a letter from the hall of justice that my case was already dismissed.

Im really worried and I hope this wont affect my chances of getting approved. I hope someone could help me out on this and give me some light and insights. Thank you so much!!

No you can not get the official explanation letter before the interview, others have tried and NBI will not issue it unless the embassy requests it. Sort of a "catch 22" there.

Hank is right. What I'd like to add is that you will be given instructions to go to the Manila NBI office which at that time you will want to have all your documentation and court papers showing your case was dismissed. NBI will enter the information into the system and then generate a reply to USEM.

If your case was dismissed you will be fine.

A copy of your letter of dismissal may be good to bring, I would suggest having a copy for NBI also (just in case), I don't know that USEM will care about the letter of dismissal, they will want the explanation letter from NBI.

You will be fine I had same problem too back in 2010. I got 221g reason NBI. If Co refuse to issue your visa due to NBI. Then you have to wait your appointment letter NBI will sent you.

Thanks for the prompt response Hank, I have spent my night reading on threads that is similar to my situation and researched if most have them have still gotten the visa and most posted a positive feesback.

I really appreciate your response and all the information I have gathered from this site at least now I know what I would need to do.

At the NBI and interview you will want to have all your documentation and court papers showing your case was dismissed. This is very important. Our experience was without them then you will have an RFE till you produce them. So be proactive and secure the dismissal papers if you don't already have them.

i would like to ask if i will get a nbi record for the requirements going to abroad it's its possible to see my dimissed record before ? It's been 2 or 3years ago case was a theft but already dimissed , hope for you reponse

Don't know for fact, but it would seem logical that the certification from the court would be adequate.
