The worst that involving a senator/congressman can do in my opinion is...they find nothing and tell u what you already know. You are waiting since April, right? This is so crazy. If tier 2 gives u same ####### of Feb 2013 being processed, tell them "well aren't all of your USCIS staff aware of that? Then if so, why am I being sent a notice along with my transfer back ing ____ stating they have to respond/process within 60 days? Who is right here? You or them? Maybe I need a supervisor level person to tell me what is going on because apparently all of you are not on the same page?"

I wouldn't hold back on asking for a supervisor at this point. Tell them that USCIS is giving different answers each time you call, so you rely on their written notices only at this point which states they have to process within 60 days of transfer... Grr... I getting angry... serenity prayer needed. Get a service request put in, note down service request number... Later on email the USCIS service center with that request number....do all you can.

Just thinking out loud here regarding the 60 day supplemental notices that were sent out.

We know Tier 1 and Tier 2, given day and time, their mood will give a different answer. The fact remains they sent written notices out saying they have to process within 60 days and this was part of their effort to reduce workloads and process faster. We also are seeing that emailing the individual service centers does nothing especially when there is no service request number which of course you can't get because Tier 1 and 2 go by the Feb 13 processing dates...So was wondering if there could be a mass effort to complain from those pending 60 days or more....

I am wondering if we can email SCOPSSCATA@dhs.org collectively stating the following: This is the email addy mentioned on USCIS if you can't get a response from the service center...

Dear Sir/Madam,

My I130 case (Receipt Number -------) was transferred to ____ (Name of service center) on __________ (date). I received a supplemental notice with my transfer stating that due to USCIS diligent efforts to reduce processing times, the case was transferred and USCIS will process within 60 days and I would hear something. I request that my case be looked into as it has been pending for _____ days.

I understand the requirement is to have a service request number by having called the National Customer Service and having placed a service request., following which one can email the service center when one hasn't heard anything back. I was unable to get a service request number as Tier 1 and Tier 2 representatives refuse to place one stating the case is outside processing time of Feb 13, 2013. I am unable to email the individual service center as they do not look into emails without an actual service request number. My last resort is to reach out to you as is stated on USCIS website when one is unable to resolve by calling National Customer Service and emailing the service center where file is transferred to.

This whole runaround and miscommunication is unacceptable as it's double standards on part of USCIS. If USCIS is allowed to go by what it is stated in writing on USCIS website that they are processing cases as of Feb 13, 2013 or before (which by the way I disagree with), then we, the stakeholders, have every right to hold USCIS accountable to the written notice stating that our transferred case is to receive some processing within 60 days. I am positive that the supplemental notices sent with the transfers were NOT a mistake on part of USCIS and hope that USCIS will uphold what they have promised.

I urge you to look into this matter at your earliest. It is unacceptable that cases are pending for so long when the national average time when we filed was stated to be 6 months.

I think that we should actually come up with several directed letters. Maybe we can send them at the same time (and copy the other people on our list) or send them out on consecutive days for a week. If that doesn't work, we can contact them EVERY day until they start taking us seriously and friggin' DO something to fix this bullcrap.

If I was someone past 60 days after a transfer and past the stated time of 180 days (sense of Congress)m I would begin considering legal action through a writ of mandamus. This legal request to make a decision on your case won't guarantee an approval automatically but it does mean a judge can force USCIS to adjudicate your petition within a certain time. If your petition is simple and complete, I personally think it would be easier for USCIS to do the work required than go to court. The letter that was provided with the transfer and the law often cited in writ of mandamus should be enough for a judge to act. A real public service to the forums would be to pay a lawyer to draft up a writ of mandamus specific to the situation shared by the thousands now waiting. Then a simple copy and paste of relevant information into the document and a trip to proper courthouse would get things moving.

I am not a lawyer and am only sharing this information based on my own understanding of the process. A fee is involved for the filing in court and involving an immigration lawyer may not be necessary if you're so close to approval.

My understanding is that the courts will not entertain a WoM until it's been a year, despite congress's note that a petition should be done in 180 days. If it's been under a year, my understanding is that they will respond by just denying your petition.

But I was considering exactly this for if my case looked like it was going to go over a year.

Well I want to say this uscis process almost drove me crazy,but thank God it s all over and we re moving together to the next stage, but want to share something with you guys, during the i130 we only put in a photo copy of our marriage certificate, and we did t get any RFE,bcos at one moment looking at the list of what people added to their i130 package got me realy scared,so I was expecting an RFE,but God give us an approval and we did t call the senators and the congress man offices, I just want to say stick to what is OK for you,hang on there

I would doubt it...don't think so...wouldn't know cause my senator/congressman don't even want to get involved. They speak the same language as USCIS agents...one that makes no sense.

So mine got approved just a few days short of 60...I never called the USCIS misinformation line, never placed a service request either since then I figured I'd get the 30 day wait thing. Senator and congressman did not wanna be involved.

I sent an email on Jan 11 venting about why others getting approved out of order this that, asked my status...very quickly got automated response that this email is to follow up only with service request number and won't be considered otherwise.

I again sent email on Jan 31, not venting this time about others but calmly stating that I have no service request number due to agents refusing giving me March 2013 timelines, another agent couldn't tell me if file really was at CSC, another stated 6 more months...in this case I have no recourse but to depend on their written notice stating they process in 60 days and mine are up in few days, asked status, if file is at CSC, if it will take beyond 60 days. This time no automated response...so I figured maybe a human is considering it.

I also sent an email to the service center director yesterday night stating I am frustrated to be getting different responses conflicting to the 60 day notice.

I don't know what exactly worked but it got approved today.

Wanted to share in case it helps someone else. Praying for everyone

I'm new on VJ . I usually dont get on these things but im completely desperate and hopeless

I filed for my husband whos in pakistan in may 2013.. i got a transfer notice 7 months later on dec 6th saying that i was transferred to texas service center and tht if i didnt get a decision within 60 days to call customer service.. my 60 days were over on feb 6th 2014. and today it is feb 19 - about 12 days over my 60 days.. when i calll customer service they told me that texas service center is currently working on cases filed in march 2013 and that i have to wait 2 and a half months or more...... i dont understand the meaning of this.. why the transfer within 60 days than? (I'm a US citizen btw)

i dont know at this point what to do at all.. this is just torture all i do is cry cryy
