Casa case refused & returned to USCIS

2/2/2011 Rebuttle Interview: APPROVED!!!

3/18/2011 VISA IN HAND!!

4/8/2011 Arrive in US through JFK (20 mins total time)

6/9/2011 MARRIED!!!

7/2013 Divorced

and what r ppls view on the DCF?? How many have done it?? Where u approved?? And how did u work during that time, or did u? Did they question your income, etc?? Forgot to add that question :)

Hi all. I haven't been here in such a long time, but want to add my 2 cents. Most I-129f's expire on their own. I have heard that it isn't wise to withdraw it since at this point you now have fraud marker on your case. Although most of these expire, there have been a handful that have not, and have been reviewed, and reaffirmed. I wouldn't necessarily say this would be ideal since it is very time consuming, but it is smart to keep in mind that this could indeed happen.

My best advice would be to wait until it gets to the USCIS and have your congressman/senators office follow through. Once they tell you if the petition has expired you will be free to either file again or marry and file the I-130. But one important thing to remember is that whatever the reason the denial was in the first place will need to be addressed with any petition. This is not always easy since they don't always tell you. I do believe, however, they some times they don't have anything solid to base it on, just a few suspicions, and that they figure that if the relationship isn't valid the applicant will blow you off to find some other sucker in another country.

We were denied back in Aug of 05, but for the CR1. It was sent back and was reaffirmed in Aug of 06. He had his second interview in November of 06 at which time they didn't ask for any further proof of the marriage, just updated forms. He got the visa in December of 06, and has been here since.

Although ours is slightly different, there are many similarities to the process. Some have ignored the first denied petition and have gotten married. It worked out for them because it did expire, but there are some that didn't expire. So whatever you choose to do just be cautious. It is better to know exactly what is happening rather than to throw caution to the wind and hope for the best.
