I-485 Rejection Notice

Timeline

We got a rejection notice in the mail the other day saying the following...

Based on the information you provided your priority ate could not be established. Please resubmit your application with the proper documentation to the address listed on the bottom of this notice.

The following documents may be provided.

  • Your original Form I-130, (Petition for Alien relative) if you are filing concurrently; or

  • Your Original Form I-360, (Petition for Ameriasian, Widow(er), or Special Immigrant) if you are filing concurrently; or

  • A copy of your Form I-797, (Notice of Action) if the petition has already been filed/approved; or

  • Other evidence that an immigration visa petition has been filed/approved on your behalf.

The I-485 was submitted by my wife and I concurrently filed an I-130 on her behalf. Include in the packet sent with the I-485 was a copy of the I-130 I mailed. The only thing I can find wrong with the I-130 that was in the I-485 packet was the lack of my signiture. Do you think this could be the only thing they need? My signiture on it?

Is there anything else I can use as evidence? We have not received the I-797 for the I-130 (the check hasn't even been cashed after 6 weeks.

Possibly the signature for the I-130 may have caused the problem, an Un-signed petition is like no petition at all. I would prepare another I-130 package. Include correct fee for the I-130, and also proof of US Citizenship (Copy of US birth cert, copy of US passport, or copy naturalization cert)

Is now a US Citizen immigration completed Jan 12, 2012.

Did you mail the I-485 and the I-130 together in the same packet to Chicago?

It sounds like you mailed the two at the same time but not to the same place. You said you mailed a 'copy' of the I-130 with the I-485. You should have mailed the original I-130 with the I-485, otherwise they don't know you actually mailed the I-130 as it would have went to a different location.

08/15/11 - Received interview letter for September 19th

08/15/11 - Received interview cancellation letter

10/14/11 - Received new interview letter

11/17/11 - N400 interview - PASSED!!!

11/29/11 - In Line for Oath Ceremony Scheduling

12/30/11 - Got email that oath ceremony is scheduled

01/27/12 - Oath Ceremony - US Citizen!!!!

04/30/10 - Mailed I-751 ROC

05/11/10 - Received NOA (dated 05/03/10)

06/11/10 - Biometrics

07/13/10 - Card Production Ordered

07/22/10 - 10 year Green Card Received in the mail

07/27/07 - I-130 & I-485 Sent to Chicago Lock Box

09/04/07 - Received NOA1 for both I-130 & I-485 (Notice Date of 31st August)

11/09/07 - Biometrics

04/17/08 - Interview

04/21/08 - Received I-130 Approval Notice

05/09/08 - I-485 Approved (Email - Welcome Notice mailed)

05/20/08 - PERMANENT RESIDENT CARD ARRIVED IN THE MAIL

Oh *#(@, that's the problem. I mailed the I-130 to a different location. I did not see the note at the bottom of the instruction sheet saying to mail them both to Chicago if they are being sent concurrently.

Now I have to figure out how to fix this problem. :(

If you can, just wait for the I-130 NOA. Then, send in the I-465 with a copy of the I-130 NOA attached as evidence.

09/02/08: Received NOA...........Priority date: 08/20/08

09/02/08: Received Biometrics Notification

09/18/08: Biometrics completed - Charlotte DO

10/24/08: Received Interview Letter

12/08/08: Interview @ 1:00pm. APPROVED!

01/05/09: Oath Ceremony 10:00AM. Now officially a USC!!!

If you can, just wait for the I-130 NOA. Then, send in the I-465 with a copy of the I-130 NOA attached as evidence.

We were hoping to get my wifes EAD as soon as possible, also we are planning a trip out of the country this summer. The I-130 was mailed out 6 weeks ago and they have yet to cash the check.

I think I'll call them up and see if they have any decent options, if not we have to wait like you said.

Looks like we are going to have to wait for the I-130 NOA.

I am in the same boat. I received a Rejection Notice which stated the same reason. My Wife came to the united states on a K1 Visa therefore i had filed I-129. After she arrived and we got married within 90 day I called uscis and they told me to file I-130 which i did. I called USCIS to check the states and was informed i didnt not need to file I-130 (filing fee $355 which i lost) since my wife was already here in the united states on a K1 Visa, also we are married now. I mailed them I-485 I-864 and G325A and they rejected my application. They stated the following reasons.
