Planned entry on VISA waiver 2 years after previously being in the US for 6 months on visa waiver when spontaneous marriage occurred, hence the overstay. Left US the first time due to death in the family, never got to apply for Residency. Stayed in Australia 2 years, USC husband came also, then I entered second time and was paroled into the USA for overstaying VISA waiver the first time, wouldn't have been an issue if I had been able to submit the documents previously. Questioned at LAX for 4 hours due to my reasons coming to the USA, it was to attend a wedding originally with intent to return to Australia. Was granted parole and whilst staying here my husband and I decided to seek an immigration attorney's advice as to whether I could apply successfully as we changed our minds and wanted to stay. |
