Review Topic: K1 Visa

Hello I need help my fiancé was denied k1 visa today after being approved by the USCIS here in the USA grounds of his denial was that he was using K1 visa and marriage to get into the US we have been together since 2009 and I've been back to see him atleast twice we have evidence but looks liike it was not enough can somebody please give me some advice ASAP we are so devastated and dont know what to do.

co's were a bit intimidating but all in all they give you the chance to prove your case, the atmosphere is very tense but once you receive your visa hooray. my interview date was 29th Aug at 6.30a.m arrived at 5.45a.m and found couple of people outside. wife came with me for support and made it all the way to second security check point where she was turned back. i was among the first people to turn in my documents but had to wait for quite a while for the interview. the the moment of truth came, i heard my name on the intercom and proceeded to window 10 and my nerves kicked in. i took the oath and the co started.
1. who petitioned for you?
2. you were married before how did that work for you?
3. you only got married for immigration benefits?
4. how many times has your wife been here?
5. so you only got married for immigration benefits?
6. when did your relationship turn romantic?
7. so you were in another relationship while you were still married?
he asked me for supporting docs
i provided pics, emails, chat logs etc i had some big binders and he did not care for it since it wouldn't fit under the window. he instructed me to remove the pics and slide them under, we had a small wedding and kind of freaked me out cause he made some comments about it but i explained that's all we could afford. another lady co came over and asked about pics from back in the states and i only had a couple right then got rfe 221g to bring more evidence yet i carried a big book pack full of evidence they did not bother with anything else. brought back more evidence in a couple of days specifically how they told me to arrange it (no binders) talked to the nice lady co who again requested for more evidence (phone calls) from back in the states.
1. tell me about your spouse, i corrected her wife?
2. who are the people in these pics? (wedding pics and family)
3. when did you get married?
4. your English sounds very American, hows that? (lived there before)

brought those in and was put in AP for approximately 1.5 weeks got called back and was issued the visa pick up next day at 2.00p.m

attended my interview last week , i must say it wasnt what i anticipated.
the night before i couldnt get sleep awaiting the good news to finally join my hubby. i got to the embassy at 5 am ,my appointment was at 6.30 am , i just wanted to be on time.

we finally got in at 6.45 am the queue was relatively long. when we got inside we filled some paper for general information . i was called the first time at counter where the co asked me when i took my medical exam since she cant trace it. i rovided her with a copy of my results. she requested me to wait outside . i dint loose my positive n hopeful mood.

i was then called a second time after two hours where an african lady asked me general questions which i gladly answered . i then stepped out again. the third call was for my finger prints to be taken .

the last call was a co at couter number 8 . she was quiet mean , dint even say hello , she went to the back and came back with a bad attitude . she asked me afew questions continously without waiting for my response
1) when did u meet ur hubby ?
2) in his first marriage was it for immigration purpose only ?
3) you probably paid him to migrate ,
4) seems your husband is in the business of ferrying people ?

i have bad news for you , no visa for you . i do 8,000 applications in an year and this is definately not a bonafied relationship . she then gave me a red sheet. it was quiet a disheartening experience . i walked out of the embassy one confused person with my folder full of evidence e.g skype logs ,call logs , holiday photos , airtickets , traditional ceremony , love card , e.t.c

i cried the whole day and locked my self in a room in shock. my hubby was in disbelieve after 1 year of looking forward to start our life together. we love each other very much and i know if God is for us no one can be against us. we seeking services of a lawyer to see whats next.

Hey guys, here is a review of how our K1 visa interview went.

I and my fiance arrived at the US embassy in Nairobi on 20th July, 7am. As we walked to the gate, we narrowly survived an accident caused by a bad driver who had previously knocked two people and was trying to run away driving so fast towards our direction. My fiance tripped and fell there by bruising both her knees, elbows and her mouth swelled because she fell on her face. luckily, the speeding car was challenged by the embassy security and we got away.

Once inside the embassy, a big guy approached us and asked if we were together, we said yes. then he asked if we were part of the incident outside the embassy gate and we said yes. then he apologized for what happened and promised to get the embassy medical team to treat the bruises my fiance got. he then took us past the security and then straight to the consular and explained to them why we need to rush through so that the medical team can treat my fiance. He was a nice guy.

I went with my fiance to the consular\'s window, she took all our documents and then realized that we don\'t have another copy of the DS 156 form. she then asked us to go download the form and bring it the next day. I then asked her if my fiance shall also have the interview when we bring the missing form the next day, she kept quiet for a while and then said well, there is an internet cafe just near the embassy, so if you can, go there, download it and bring it immediately. That sounded a better option for us.

While at the cafe, the internet connection was so slow and couldn\'t download anything. So we decided to head back to our hotel which had nice wireless internet connection. only problem was the hotel was a 45 minute drive away from the embassy. When we got back to the embassy, a security guard asked us what we have come for, we told her we have brought a missing document as we were told to. the guard asked us for a written proof to show that we were told to come back. we didn\'t have any so she suspected that we were telling a lie. she told us she is going in to inquire from the consular. We waited and hoped that the consular wouldn\'t deny telling us to come back with the missing document. Well, the guard came back and said we can go in. We felt a sigh of relief!

Once inside, we went to the same consular and then she like, i told you to come back immediately, where have you been? K1 interviews are only done in the early morning so you are going to have to come back tomorrow. I explained to her that the internet cafe she sent us to was not helpful so we had to go find another. She insisted on telling us to come back the next day. I then asked her when will my fiance do her interview. she kept quiet for a while then she said, alright i\'ll take the documents now then you will come back for the interview. My fiance gave her the DS 156, she took it and then she said, sit and wait for your interview. We were happy and shocked both at the same time because she had said my fiance shall come back for the interview but now she said sit and wait for the interview! we were really shocked. and normally, the interviews are done a day after handing in documents. (but thankfully, we had moved with all proof of relationship that day)

Well, we sat for about 20mins then my fiance was called to window 1. I stayed back sitting hoping for good news. ( We were meant to practice interviews questions in the evening at our hotel after handing in the documents, but now here i was watching my fiance being interviewed without any practice). I waited and watched her talking then after about 5 minutes, she looked back at me and smiled. I started to think it is good news. After another 3 more minutes, my fiance walked back to me with a smile on her face and showed me a green paper which stated that she come back and pick up her visa on the 25th of july! i was over joyed. i gave her a big kiss there and then. and we walked out arm in arm.

This is what my fiance was asked.
When did you meet your fiance?
How have you been communicating with your fiance?
Have you met his parents?
Tell me about your wedding plans.
What did your fiance come to do?
When was the last time you saw your fiance?

And that was it. Am so proud of my fiance doing good in the interview. Oh at the end of the day, my fiance got treatment for her bruises. Well it was kind of a bitter sweet day!! And i knew it would be a good day after the early morning incident.

My fiance had her interview on April 20, 2011. The schedualed date was the 19th but we found out that day was only to drop off the visa application and some personal info documents then thay tell you to come the next day for the interview. This embassy is currently undergoing many changes so thinngs may not be exactly the same for those of you with interviews coming up.

The embassy does interviews at 6 30 am and my fiance and i arrived at about 5:30 just to be safe. We were the second people there and waited about an hour before the security guard came to start letting people in. At the 1st security checkpoint both of us were asked for our passports and appointment letters. I had no appointment letter and just explained to them that i was the US citizen petitioner with my fiance for her interview. He let me in but told me that i would not be allowed to go in with my fiance for her interview.

At the second security checkpoint there were 2 lines. 1 on the right in front of a small podium where a woman took my fiance's name and made sure she was on the appointment list and the other line on the left in front of the second security checkpoint building. Go to the line on the right 1st before the line on the left. It is not marked as such and confused about every single person going into the embassy. A lot of people stood in the wrong line for over 20 miniutes before the guard told them they need to go to check in 1st. Thus losing their place in line and basically making them wait at least 1/2 hour longer to get in.

Even though the guard at the 1st checkpoint told me i would not be able to go in with my fiance for her interview i figured i would give it a try and see what they say. After all, I am an American citizen at a US embassy so i figured it wouldn't hurt to try. Once inside the second security building they asked for my passport and appointment letter once again and i was told i could not go any further without an appointment letter with my name on it. So i politely said ok and walked back outside. There are several benches outside the security building so i just had a seat and tried to get as comfortable as i could. I sat on that bench for over 3 hours while my fiance was inside for her interview. I seemed to be getting in the way of people going into the embassy so i think they may not even let the US citizen fiance past the 1st checkpoint in the near future.

My fiance left the second security checkpoint and went to the counsuler building only to go through a 3rd security checkpoint before entering. Once inside she went to a counter and gave the prescreener some proof of our relationship and her passport. She was then told to have a seat and wait for her name to be called. There are 10 interview windows all numbered accordingly. The 4 C.O.'s doing immigrant visa interviews were all english speaking Americans. They did not seem to like interviewing people they could not understand and my fiance even thinks they turned a few applicants away because of this and told them to come back with an interpreter. My fiance was about the 7th person to go into the interview area out of about 25 people. She ended up waiting almost 2 1/2 hours and was the very last person called for her interview. She was very worried that something was wrong and that maybe they would reschedual her or something.

Once finally called to counter number 10 she walked up and was greeted by a blonde American C.O. in maybe her late 20s. She was very nice and immediately asked my fiance if she was upset for having to wait so long. My fiance politely said "naaa, i don't mind." The C.O. told her that her file had fallen on the floor and she just noticed it when reaching for a stapler or something and that is why she got moved to the back of the line. The C.O. then asked my fiance if she knew a certain verse in the bible to which she replied "no". The C.O. then made her recite a verse in the bible from Mathew and swear to tell the truth. The C.O. started making small talk and was very friendly and talking to my fiance like they were good friends. My fiance didn't even realize she was being interviewed since the C.O. made her so comfortable and calm. The C.O. seemed very happy to finally be able to interview someone that could speak very fluent english and uderstand what the C.O. was saying. The C.O. also seemed happy and commented on the fact that her aunt lived in the same town as me (the petitioner). After my fiance described the interview to me i was able to pick out about 11 uestions that were asked:

1:Do you know Mathew X:XX (can't remember the exact verse)
2:How did you two meet?
3:What cartoons do you like (just small talk i think as i have no idea why she would ask that.)
4:Can you give me a precise date that you met?
5:Where do you currently live?
6:Do you have a British passport? (my fiance was in UK for 5.5 years on a visa)
7:Why are your parents in UK and not Mauritius?
8:Where is your fiance right now?
9:Do you have any proof that your fiance was in Mauritius with you?
10:When is your wedding date?
11:Who introduced you to your fiance?

The whole interview lasted about 10 miniutes and went very smoothly. I think that if they wouldn't have just been chatting like friends it would have only taken half the time but i am certainly not complaining. In the end the C.O. handed my fiance a green slip of paper and said her passport would be processed and ready to pick up tomorrow at 2pm. My fiance wondered why they would need to process her passport and said "don't you mean the visa?". The C.O. smiled and said "yeaaaah". Kinda like "oh you spoiled the surprize". They both said goodbye to eachother and my fiance came back out to meet me and finally give me the 1 word i have been waiting so long to hear, "APPROVED!!!".

We came back the next day to collect the visa and arrived about 2 hours early. We were instructed by security to come back at about 1:45 to go in. There is a small shopping center right next to the embassy with 2 resteraunts so we went there and sat down for a bite to eat while we waited. During our lunch one of the C.O.s actually came and ate lunch at the same place we were and sat down right next to us. It was not the person who interviewed her but it was definately a C.O. that was interviewing people at the same time as my fiance. We did not talk to the C.O. and just ate our lunch and left. We then went back to the embassy where i had my fiance go in and told her i am not even going to bother going past the 1st security checkpoint because i felt more comfortable waiting outside. She was in the embassy for about 1.5 hours and came back out with the yellow sealed envelope that says "DO NOT OPEN" on the outside and her passport with a nice big K-1 visa sticker on one of her visa pages.

The whole process at the embassy seemed a bit disorganized and took a very long time but was not too bad for my fiance and i since we are very patient people. I would suggest to anyone going there to bring extra EXTRA patients and a good attitude. It seemed like the better half of the interview was based on the attitude and the way the person being interviewd conducted themselves. As long as the applicant had all their documents, were able to communicate well with the C.O. and conducted themselves in a polite and profesional manner the
C.O. had no problem giving out a visa.

As i had said earlier, this embassy seems to constantly be changing how they do things so this is our expiriance at the time we went and may not be exactly the same for future visa applicants.
