  1. The wife was on hold for 20 minutes for a tier 2 rep. Then they tell her no service request (medical) was found. They then put a new one through for a status inquiry. Watch this one get swallowed too.....

    At least you got that far. I've never been able to get them to admit there is a tier 2 let alone transfer me to them. "You're within normal processing times sir" (that they define as whatever the hell they want).

  2. I should have added that I feel no ill will (other than the obvious jealousy) towards those VJers who were fortunate to get their NOA2 with priority dates after July (non-expedited).

    Yeah... I can't say I feel ill will towards them.. but I can totally understand what you're saying. It's beyond infuriating to still be sitting here waiting and waiting and waiting and then reading someone posting how they go through USCIS in less than a week or so. It's rare, but still infuriating. Or the person who went all the way from paper work submitted to visa in hand in less than 90 days.

    Not to mention those lucky people who got sent to VSC instead and *ZIP* they're done.

    I don't hate them. But it still annoys me to no end...

    And here we sit... with nothing but government excuses...

  3. Ok, the service request I put through never got to CSC. That is terrible. What are these people doing?

    What did they end up telling you? "We're backed up and processing 16June. Continue to wait"?

    What's really stressing for me is that it is looking more and more likely I'm going to have to tell the wife that a March interview isn't going to happen and it will likely be April... or May... or June...

  4. So far, my Rep's immigration person is going to call CSC and ask them what's up. One of my Senator's person just gave me the same excuses that USCIS does with a bunch of BS about "We can't/won't do anything until you're past their processing date." This being their self-defined processing date. The same one that USCIS themselves use as a bloody shield to prevent creating any service requests.

    I wish I could just define turn around times as whatever the hell I felt like.

I tried to put a service request but they denied it because they said they are currently processing June 16 it doesnt matter if you are on your 180th day, as long as you did not pass your priority date yet then they will not do a service reques for example if they said they are processing June 16 and your priority date is June 15 then they will look up your case (service request)

    Wonderful, no?

    I'm debating starting to call them every day until they move. I've nothing else to do but wait, no?

    They've also been "processing 16June" for nearly three months now.

    When was your last update date on the website?

  6. First off a very clever solution that gives us some real insight into the current backlog, I tip my hat to you.

    I sure hope 782 reviewed applications in a week is due to the short work week and the probability that there are a higher than normal number of CSC workers out on vacation. This will be another short week, but I would imagine there are fewer people out on vacation this week as compared to last week. I can't imagine they can process more than 5-10 thousand applications a week which could mean that those of us with a late July priority date probably won't get our NOA2's until February at the earliest :(

    Sad to say, if I'm reading all this correctly their peak was only 1000 or so. So yeah, we're looking at several more weeks at best. :(

    I'm in contact with my Senator's and Representatives to at least get a status or preferably some kind of positive movement. I think I'll freaking flip out if after months of waiting they just kick back for an RFE :(

  7. When I read the OP post, I wonderd the same thing. If the petition by chance does get denied again after the appeal/waiver then is it possible to move to China and make a life as best as you can with your wife there?

    From what I understand, and could likely be wrong about, it is the appeal/waiver part that takes forever. Were I the OP and if the ruling wasn't an outright mistake, I'd be laying plans to move right now.

    It's been my plan for a while that if our interview doesn't go well, the next step is to fight, the very next is to move to China.

  8. Well, here it is 1January2012... 153 days with no activity and nothing but bloody excuses out of CSC. Amazing how backed up they supposedly are and yet VSC with similar volumes are processing right along. Probably has more to do with CSC not processing I-130s since June, with occasional exceptions.

    But it's cool, they all get to go home to their bloody families at night. :cry:

Update: Yes, I've been looking closer and this VJ timeline doesn't seem to be adding up with the figures anyway. :\ Igor's List, which seems more reflective of actual trends, shows loads of July filers still waiting for NOA2 so I'm back to waiting "blindly" again. Gotta have faith! I'm just hoping the new year's going to zap some sense into CSC... they might just get a move on with their workload now!

    I hope so as well. However, I'm firmly of the opinion that they are basically not processing I-130s at all and are instead concentrating on something else for some reason. All one has to do is compare the volume VSC is processing to CSC's volume to come to that conclusion. Around June practically all I-130 processing at CSC, with occasional exceptions, ceased. Meanwhile, VSC is still cruising along even if a little slower than before.

    My Representative will be looking into the situation come Tuesday. Hopefully that turns up some kind of positive result.

  10. the document fraud rate in Colombia is somewhere around 40%....the percentage of Colombians who abuse their visas is also quite high...and those Colombians who have married an American citizen and who are waiting for their immigrant visa interview, have historically shown an approximate 98% chance of the infamous 'mind change' (usually occurring at baggage claim) and who wait around and go for the AOS while in the US....so our VOs are not 'cold hearted' but instead are quite rational. You can (and should) thank the thousands of Colombian visa abusers, for they are the ones who have brought this about.

    You know, giving how mindnumbingly impossible it is for people to come here legally, I am no longer surprised that so many do come here illegally. This situation really just demonstrates to me once again that the only ones punished by these laws and processes are the people trying to do things the right way. Those fraudsters you mention and other illegals are likely laughing their asses off at us jumping through the hoops.

    People from VWP countries can easily do, and often do, that infamous mind change. Why screw around with the long waits and being apart when they can just fly over and "suddenly" decide to get married. I would find this entire process a hell of a lot easier to defend and justify if it wasn't such a steaming pile of #######.

  11. I'm sorry that you went through this. What is incredibly galling is that were your wife from any of the VWP countries she could just hop a plane and fly over. They might give her a bit of a hard time at POE, but would likely let her on in with a fraction of the proof required at interview.

    It's been said before: If you're from a non-VWP country your chances of a visitor's visa are pretty damned slim in the first place. If you're married to a USC who isn't living with you, the chances are zero.

    "Do you know anyone in the US?"

    "Yes, my spouse"

    "Denied."

    We thought about trying it ourselves. We already failed horribly before we were married. Didn't feel like going through that again.

    Unfortunately, the "elected officials" didnt do jack nothing for this fella either. They may be elected by us but are they for us? What did the mantra used to be??? A government of the people (elitist), for the people (lobbyists), by the people (designated elitist groomed to be the face of the cabal...I mean government)

    Now here is something to remember:

    In short, this entire situation can be summarized thusly:

    Everyone in the US falls into one of three categories: Don't know it's this bad, aren't impacted by it or wouldn't care if they did know. Most have no idea it is this bad. Most truly believe that you get married, pop your spouse on a plane and come home. They have no idea about the months of waiting and the arbitrary denials. The go nowhere appeals and all the rest. The rest are people who are in no way impacted by this situation. Either because they would never marry someone outside the US, or because they can easily call in favors and get a visa (assuming one was needed) easily.

    To put it another way, very few people know and understand our pain. All those who do, are in no position to do anything about it. Those workers at the call center who tell us "We're still processing 16June, so you're well within the standard processing" generally don't give a damn about us. They get to go home to their families at night while we sit alone.

  13. Do you think its CSC being so slow? The VSC is processing December like crazy which is weird. Someone got NOA1 December 5th and NOA2 approval December 15th. Yet previous fliers sit. How can they do that.

    Scares me since I will be filing next week.

    Well hang on people. Something has to give. And personally I think a bunch of letters flooding senators and congress peoples office now would do some good. Isn't this the election year?

    Yes, it is CSC being slow as hell. While there are some exceptions most people going through VSC are getting approved in 90 days or less. At the same time most people going through CSC, who aren't being approved practically instantly, are taking several months. I hope for your sake you go to VSC and not CSC or else you'll likely be in this super slow boat too.

    It is an election year. What makes you think politicians care about people in our position? There aren't enough of us to shift an election and the public is generally unaware we have these problems. I've lost track of how many times I've had to explain how terrible this process is after someone says "But she's your wife?!"

    Two possibilities come to mind. One, the theory of VWP preference and such is incorrect and/or not totally correct. Two, I notice you have the 'deadly' 4August touch date. There is an unconfirmed report that all petitions touched on that date was moved to a storage facility. That would make it rather hard for them to be processed in a timely manner, no? While unconfirmed, it does tend to fit the pattern. So far there is only one known case of someone who was touched on that date and has been processed. Coincidentally it was also after they were approved for an expedite request.

    USCIS is acting in favor of specific countries. I suspect USCIS is trying to "balance" diversity in US by acting quickly in favor of those countries who immigrate less to US. I am thinking USCIS is getting lot more applications from countries like China, India, Philippine, Mexico etc...

    That is why applicants from these countries wait more than 4 months to just get NOA2, where as smaller countries, more developed countries that has lot less people immigrating to US get NOA2 in weeks.

    That's possible. Though, it seems more likely that if the flow of applications are greater from X, and for whatever reason they have some people assigned to only work on specific regions and/or countries, then the people with fewer applications are getting processed far far far far faster than the other ones...

    That said, it is beyond annoying to be waiting so long when people who can easily have their spouse visit are getting approved practically instantly and people who have no chance in hell of their spouse visiting are waiting months on end with nothing but ###### excuses coming out of USCIS.

    Pretty much. I got excited for a moment thinking I was actually going to be transferred to Tier II instead of just another person with added 'rudeness skills'. She actually sounded like I was wrong to even be asking or attempting to get any more information than '16June'.
