  1. You can try to get emergency AP by making an Infopass at your local office.

    Right. There is an emergency advance parole only good for 30 days, I am planning to do the same too. I was told by the USCIS in our area that i should file first the I-485 along with the Advance Parole and show them the proof/receipt that i filed the AP before they can process it then do the Info pass thing. Submit evidence warranting the issuance of the Emergency AP. Good luck i hope you'll be able to get it. No need to wait for the 2-3 mos processing of the AP. You can call the USCIS in your area to inquire about it. :)

  2. This question is for the fiancées in Manila. When should I take the CFO seminar? Is it before my interview or after my visa is issued?

    Take the CFO Seminar after you get your visa so you don't have to come back for the CFO sticker and the Green Certificate. Right after the seminar you can get the CFO green certificate as well as the CFO sticker all in one day. :)

  4. My visa was delievered after 4 business days, i think you should get it before the end of this month. Or you might want to email the 2go so you'll keep track of your visa. It shouldn't take more than 2 weeks especially if the delivery address is around Manila. Good luck on the waiting time. I hope you'll get it sooner. :)

  5. Over here a Bachelor of Laws degree doesn't really mean anything. You can take Pre-Law here, but Law Schools will take people regardless of what they took in undergraduate. And you must have the graduate level education to sit for the bar. At best, it's a good foundation for you to transition to law school more easily.

    On the contrary, i think having LL.B degree is still better than not having any degree at all regardless of the country i had it. Thanks but what do you mean Pre-Law? I already had my pre-law studies so i will not waste another 4 yrs to take it again. What i want is to get a masteral studies at least, besides i don't have plans of competing with the American lawyers doing stuffs like handling cases in courts, for a fact most American law firms look down on asians. I just want to practice my profession, making it sure the 9 years of studying is worth it. Thanks for the info though.

  6. The pre-interviewer will ask most of the questions about the relationships, how, when and where it started, what's your fiance's job, his age, your work experience, have u ever been out of the country, and stuff like that, just the basics so nothing to worry about.

    For the Consul, actually just the reiteration of some of the questions that the pre-interviewer asked. If there's no problem with the documents and the legimitacy of relationship, the most you can spend at the cubicle is 5mins and voila, visa approved! Good luck! :)

  7. 2010 tax return won't be a problem,just bring it with you if they ask for it like you said, i didn't even have it during my interview and it went fine.

    Try to remember the important "dates" e.g. when your relationship started, date of wedding etc. and one last thing just PRAY and RELAX, there's really nothing to worry about. Good luck and sleep good tonight. :)

    Hmmn...i'm not sure if you have to bring his pay stubs too, but if there's no problem with his income, the pre-interviewer won't even bother to look at the pay stubs.

  8. To be sure just tell him to give you the tax returns, my pre-interviewer asked those docs from me. They will look at it first, if there's no problem with the income as reflected in the tax returns, they will not even bother to look at the pay stubs. It's better to work on it now than to be delayed later on. Good luck! :)

  9. The USEM sends the appointment letter not through the post office but by Air21 courier, so don't expect it to be delivered by your postman. As for my case, the letter was dated Jan. 13, 11 and i received it on Jan. 19, 11 so six (6) days, I'm just from Muntinlupa. Probably it'll take longer if you live in the province.:)

It's very simple question.My wife wants to divorce me and go back home.Should we divorce before she go back home or can we do it even if she in Philippines?I just want know coz I know u cant divorce in Philippines.Would that effect the divorce process?She don't have a cond green card yet.If i divorce her here she wil be out of status i think and i don't want a forced deporatation.Just get the divorce and she catch her flight back home.

    Sorry to hear your situation. You can obtain a divorce whether your wife is in the States or in the Philippines ( this is assuming your wife's presence is not required for the divorce proceedings there, although i have heard a lot of stories that this may be done). Once you obtain the divorce decree, it would be kind of you to just furnish her a copy of ir before she heads back home, she'll be needing the divorce decree for the purpose of filing a petition in the appropriate Philippine court for the Recognition of such judgment for purposes of remarriage, having said this, there is no need for her to file an annulment case in the Philippines. Note however, that the divorce decree you obtained should grant you the capacity to remarry so She shall likewise be capacitated to remarry after complying with the aforesaid petition for the recognition of the divorce decree in the Philippines. This is based on Article 26 (2nd para), Family Code of the Philippines.

  11. Like what Tero said, the USCIS will notify you if it has forwarded the approved petition to NVC. Not too long after the NOA2 (1 week in my case) your fiance will receive a letter from NVC which has the Manila Case number, but if you can't wait for the letter just give it at least a week and call NVC, mine was approved at the NVC 7 days after it received the approved petition from CSC. I emailed IVmanilareplies@state.gov and found out that USEM has received my case (electronically) 3 days after the approval from NVC.

  12. scheduling the interview at the usem manila really SUCKS! i called several times three days in a row, was able to talk to untrained call center agents who keep on giving me different information, one has told me it takes 24 hrs from payment before i can schedule, the other says 48 hrs, now the last one i talked too is really hopeless, she said it's going to take 5 to 10 days! what the F***! I had to pay $350 just to be delayed for 13 days to schedule the interview...oh good heavens! :help:

    The saddest part is the visa interview is never refundable. :wow: so i'll just make the usem $350 richer if i don't push through with this impossible visa process.

  13. i have a question, im thinking if my late registered birtcertificate can be a way to deny me by US consul for getting a Spouse Visa? My mom thought that im registered but then she found out that i failed to registered by the midwife cause i dont have a copy of b.c in LCR nor in NSO, we just found out when i started to gather requirements and went to NSO to get auntenticate of my b.c and they told me no record found under my name. I dont have baptismal certificate either cause im not baptized in catholic when i was born. Is this become a big problem for me to get spouse visa? thank you so much!

    My birth record was also late registered 6 years after i was born was the only time it was finally recorded at the NSO, but no problems cos i got my BC copies many times already from NSO, as long as you can obtain your BC from NSO, there would be no problem with your visa concerning it, the fact of late registration won't matter, and if you can't obtain such BC, i think you need to follow some rules to prove your birth here in PI if you were born here, like you need to get a certificate from the LCR from the person who is in charge of such records that they indeed do not have a copy of it for some reason and after a diligent search then you need to present that with NSO, i am just not sure what are the further steps to be taken after that, but you can always visit the website of NSO or better yet call them on what to do with your birth record. I mean no disrespect, praying helps, but there are other solutions too, be proactive and call the USCIS and ask to be escalated to find out the case-status, I had to resort to this when we didn't receive anynews after 5 months, only speaking to a USCIS office did we find out that a RFE(request for additional evidence) was mailed out on Dec.29/10. There are other recourses, hmmm hmmm. to the poster of "wet-your-pants", dont' give up, like the ombudsman of USCIS if the 5 month waiting period is not met, in our case USCIS made a typographical error which may have impeded the process, hence we could have a case for "expedite".     No need for that, got my approval already last Dec. 08 without any RFE, and all i did was to pray and pray harder, nothing beats prayer,it eases all my worries and stress and makes me confident that things will be alright with HIM, i was just trying to help lovely girl on how she should go about her waiting agony, it's all about encouragement and understanding the pain of other people who are in the long wait which seems to be endless. Thanks for your input though, hope you'll help others who are still waiting. :)

  15. i got my NOA1 Thur California center on sep 1 st its already been 5 month at the end of this month but hope we get the NOA2 soon......Iam started being un patient Now!!!!!!!!!!!! Any where here around that time

    I have been in your situation and yeah it does sucks, it's an arbitrary process with the uscis and sad cos we can't do anything about it, it's hard to have that enduring patience too during these times, but just help yourself, get busy with other things, try not to check your status too often, take a break from looking at the approvals here in vj so it won't disheartened you, i know it's hard but that's what you need to do, don't do the advice "withdraw the petition" it's totally nonsense, you'll get your approval too like me, right now the best thing to do is just PRAY, i won't even ask you to stay positive cos that's really a hard thing to do now, just pray, pray and pray, it really worked for me! good luck! :)
