    Wow, thankyou everyone for your input.
    I too believe a child should have both parents in their lifes, however when one doesnt want to be apart of the childs life- why should I force it?
    The soon to be ex husband/childs biological father will be able to visit her as often as he likes- I am not going to keep him from his child. I will also be coming back to the states hopefully once a year as I want to see those that have helped me out through this trying time.
    I have even invited him to come to the birth of his child- his reponce "I need more time to work on myself, and focus on myself before anything else" meanwhile I see his debit transactions where his mistress lives.

    To the person saying there is two sides to every story...I have asked my soon to be ex-husband if i did anything wrong...his responce "no, nothing" he was just being selfish.
    I havnt been vicious in this entire process, I havnt even lashed out at the woman who participated in the affair- even though she told me to "get over it, and move back to australia"
    I have been very civil as I cannot risk the health of my unborn child with me stressing.

    I will be seing an immigration lawyer and a divorce lawyer this monday with the assistance of my mother and father who are flying in on sunday. My child deserves the best support system possible- the father had his chance to right his wrongs- appoligize and ask about his child. He refuses to speak of his child and is mainly concerned about who gets our dog.

    Thankyou again for your input, and some of you have been SO sweet- your comments lighten up my day and remind me that people dont have to put up with these circumstances- as someone said - my soon to be ex husband could of quite easily tried to move for me and my child to australia and I would have happily helped him out if he was willing to sacrifice what I sacrificed to move here- I need my family, and need to give my child the best possible life. He didnt appreciate me moving here for him and giving up my life- which I still to this day dont regret, I moved here for him, I loved him and was happy to give up my family and carear to be with him- its amazing when you put the shoe on the other foot and see what they would sacrifice for you. We are such strong people that go through this visa process- normally the partner see's this...unfortunately mine decided that I wasnt enough.

    Again I am not keeping him from her, however I will be exiting this country as I moved here for him- not for anything else, she will be born in Australia and if he wants some kind of custody- he can go through the australian courts. He has however shown no interest in doing so.

    Thank you for your response- in regards to me driving him away- he has been cheating on me since before we were married/engaged - he shouldn't of proposed to me if he was going to be unfaithful.

    I work a great job and don't rely on him for money- I paid for all of my visa process and paid to come over to live with him.

    I loved this man and believed that he loved me too- it is unfortunate that my marriage is tainted with lies.

    He wasn't going to tell me of this other woman- he admited he was never going to tell me- this woman told me- she also is as sick as she knew he was married and that I was pregnant.

    He wants nothing to do with me- as I said in my previous comment I was willing to try save my marriage- I loved this man

    However I need to go back to have a better support system. I am not doing this for revenge, he has made it clear he doesn't want to be apart of mine or my child's life- he is still seeing this woman and is becoming more and more hateful as it is coming close to my departure.

    I am only questioning the visa process as I do had a job willing to take me back over here with the oppertunity of growth and promotions- and I have friends. I would never want to take a child away from their biological father- but in all reality- he has made no effort or no comments regarding being apart of her life.

    I will maintain to send photos to him and his family- right now I am looking out for the safety/sanity and support that myself and child need at this time.

    Thank you to everyone that has posted lovely comments- it really does get me through the day knowing there are people out there that care.

    Always two sides to the story, assuming the guy did pay all the expenses to bring her here, and certainly is responsible for supporting her at 125% the poverty rate for the next ten years, plus child support on his child if it ends up that way.

    Not making any accusations, guy could be wild, or could be the wife is driving him away to cheat.

    Just saying, there are always two sides to every story.

    Results are also state dependent, like in Wisconsin, no fault divorce laws, cheating is okay, but the parent awarded custody can't live further than 125 miles away with the child. But this varies widely from state to state. Major issue with the FBI for child abduction or kidnapping if you prefer, is where one parent takes off with the kid/s.

    In international cases, Interpol may get in involved, but a very gray situation in whether this is a civil or legal matter. Also a gray situation as to when a child is a child, either before or after the child is born.

    Only advice I can give you if can't work this matter out between yourselves, go see a marriage counselor. If this doesn't work, see an attorney.

    Thankyou everyone for your responces.
    I am planning to move back to australia in 20 days- my flight is booked and my parents are flying over to assist me in the move.

    My soon to be ex husband has been mentally abusing me for a while..... He is being HORRIBLE in this whole situation and hasnt asked once about the baby since everything has come out.
    He has another biological child in this state and has NOTHING to do with her- I knew about her before the marriage and NEVER told him he couldnt see her- he is the type of person where its "out of sight- out of mind."

    I do have friends here- however his family have decided to hide from this situation and wont call me or check up on me. I have tried everything- and I was even considering coming back after giving birth to my baby girl in May....

    I spoke with my husband and told him that I would be willing to work on our relationship for the sake of our child if he was willing to fight for our marriage and show me he wanted to change his ways and get proffesional help. Instead he decided to make leaving the country EASY- he has threatened me, mentally abused me, left dirty womens underware in my underware drawer, is still seeing this other woman and is accusing me of trying to get him fired from his job- why would I want this if I eventually wanted child support?!?!?!?!?!

    I have weighed all my options and am leaving- I will be having the child in Australia and will be filing for divorce....I will be getting something drawn up to where he understands that I am having the child in Australia- therefore not kidnapping.

    My question now is not what I should do...but what will happen with my permanent residency green card? My "conditional 2 year one" expired last august and I went in for biometrics in November- everything is being processed...but what happens if i get a divorce in the mean time before recieving interview/green card????

    Please help,
    I am a permanent resident and have applied for my removal of conditions. I should be recieving this sometime soon...
    I recently found out my US husband has been cheating on me for the majority of my marriage, I am 6 month pregnant with his child... I want to move back to australia to have my child and divorce him- however I am scared of the legal rights he has over me and my child....

    What can I do???? Can he go for custody even if I have my child in Australia? I am planning on divorcing him- he doesnt deserve me and my child.

    Please help!

    hi there...

    I have booked my flight tickets under my maiden name...(in my australian passport)

    However all of my AOS, AP AND EAD is under my married name...

    I have given enough time for my AP to be done before flying...

    so when I go there/come back...should i just show my marrage cert. to prove my last name change...which will be on the AP?

    hi there,

    Im kinda freaking out...

    had my interview yesterday (tuesday) and got approved- they dont need me to send anything else in...

    I have booked flights for next tuesday to go back to the USA....i know i should have done this until i had my visa in hand...however Ill be a god mother the day after i arrive! so I had to be there...

    monday coming is july 4th for the USA...which means consulate gets a public holiday-

    the lady at the interview said i should have it by friday....

    should i be freaking thinking I wont have it by tuesday?

    they have today, thursday, and friday to send it to me (overnight post)

    do we think this is possible...or should i start stressing???

    I was just getting stuff ahead of time, thought I would have my NOA2 by now but I guess no....

    In Victoria don't need case number for police check or medical, so I went ahead and got them done.

    Now I am just waiting on my NOA2!! Ps Callie surprised me for me 23rd bday on thursday :) 5 Months since I had seen her, so shes here for a month which is good!

    But yeah been nearly 5.5 Months since NOA1

    well boo to the NOA2 and yay to seeing callie!!!!!

    its sooo bloody hard waiting for that NOA2!!!! i know exactly how you feel and i hope you get it very soon :) just keep bugging them at the consulate- i did lol....daniel seriously called everyday until they did something about it...maybe coz im a bit of a stress head....lol

    i just got my packet 3....sydney is very quick which is nice!

    however i got it on friday...and now we have a long weekend BOOOO....so tuesday it is :)

    have a wonderful time with callie...and try not to stress too much- thats really the worst advice i could give- coming from me NUMBER 1 STRESS HEAD :)

    know that we are sending positive vibes into the atmosphere lol :)

    Hey everyone...

    so....the process gets fun now :)

    UPDATE FROM DOWN UNDER...

    got my NOA2,

    consular received it...

    had my medical....i am healthy :)

    got packet 3...

    it is a long weekend this weekend - trust my luck!

    so i will send it PRIORITY EXPRESS on tuesday...

    (hopefully i will receive daniel's I-134 on tuesday....mail says i should)

    and then WHOOHOOO hopefully interview will be soon...sydney looks like they are pretty good and quick with their interviews...sooooo fingers crossed!!!

    I will be a god mother first week of july so hopefully i will be there to welcome my new nephew/god son layne brock :) eeeeee :dance:

    Question About Sending Packet 3?

    Do we really need to include a self addressed envelope with packet 3? I couldn't find anything in the instructions about this? - Unless there is additional information that comes with packet 3 which i haven't yet received :unsure: .

    I thought we just bring one with us on the day?

    now that you have done the process...did you send the return addressed envelope with packet 3? this is the first time hearing this??? x

    YAY got my medical done...and by looking at the DHL tracking sydney consulate should have received it today!! whoop whoop...does this mean i will have a packet 3 soon???? how long does it usually take till you get it once they receive the application?

    Also...i have all my packet 3 stuff together....just wondering though...i know it says 'send original and photocopy' will they return my original items at the interview?....this means i put my medical, birth certificate, police record, affidavit of support all in the mail?????

    Also....i know they send you out a packet 4 with an interview date....however I really need to get back to the USA asap for work- People are holding a job for me...is there anyway of emailing them and asking for a sooner interview? Do they do this?

    Here's the P3 info that you'll be sent: http://canberra.usembassy.gov/fiance_niv_appl.html (they just tell you to go to this page)

    Here's the checklist of stuff for P3 that you need to send back: http://photos.state.gov/libraries/australia/39176/pdf/dsl-1076.pdf you can see they want the original AND a photocopy. At the interview they'll return the original/s.

    ...BUT word of advice, scan EVERYTHING. You'll need the NOA2 (K1 visa petition approval) when it comes to AOS (a copy is fine) and you'd be surprised how many people lose it and don't have a copy anywhere. Also, don't forget that when you do get P3 the first thing they'll ask for is DS-230 to be sent IMMEDIATELY but if you have the rest of P3 ready you can send it all at the same time. :)

    p.s. Your A number (alien number) is on the NOA2 above your name on the NOA2. You'll need to know that for AOS too :)

    thankyou sooo much for your help!!!! Medical is booked for monday....and rang the NVC and they posted my application TODAY!!!! sooo exciting... oh and 1 last question lol! should i glue my passport photos to the form with the photo space? or just put my 2 photos in the package?

    hopefully everything starts going quickly now!....i miss my man tooo much!

    Oh...when i know that the sydney consulate has my application...do i have to wait for them to send me my package 3? or can i just send all of my stuff??? If i have everything ready? xx thanks again :thumbs:

    Hi everyone- quick question...

    when can i go get my medical done? Do i have to wait for sydney to receive my application? and for my packet 3?

    i have my case number-its at the NVC right now...should be sent soon FINGERS CROSSED...the lady gave us the case number yesterday....

    so can i go for it now? I just want everything to be done so as soon as packet 3 arrives i can get things going quickly...i have my police records...just need medical :)

    They will not send you a DHL number. There is some kind of secret code that you can use to track it...search on tracking DHL package here and you'll probably be able to find it. Be warned, just because the NVC says they approved and sent doesn't mean it was mailed the day they said it was. It might go out a few days later.

    I did not receive an email from the NVC, I just kept calling until they confirmed it was received an approved.

    Neither Dipu nor I received notice from the embassy. Once I had my case number from NVC and knew from DHL that the embassy had it, I emailed them to confirm. Dipu never received his packet 3 but i received a copy a few weeks after the embassy said it sent it to him. He was able to download the packet from the embassy website.

    ok soo....what number do I call to bug them lol...and when should i start calling- should I wait 2 weeks? And then what do we ask when we call? just that its been approved and sent to sydney-or for a new case number so we can track or an ID or what lol...im a bit clueless :wacko:

    I have done everything i need to for packet 3- however looking at this site about sydney consulate they say they do send the packet 3? or should i just send it as soon as i know (tracked it to sydney) that they have it in sydney?

    congrats to everyone on all the process....just a little question...may be silly but its still a question...

    so our case has been sent to the NVC now YAY...and its been there for 9 days...what happens next-as in-will we get another email to say 'we have sent your application to sydney consulate' or will daniel recieve a letter in the mail stating that? how will i know that its being processed? and will they send a DHL number??

    I really think you're just a little confused. We all sent our cases to the Texas Service Center so that they can process our checks and then route our cases to the correct service center...either California or Vermont. You have been sent to Vermont. Just like I was. You mentioned earlier that you called NVC and NVC said they couldn't do anything for you - right, because they can't. Your case isn't at NVC. It is at VSC.

    In order to put in an expedite request you will have to contact VSC: http://www.visajourney.com/forums/topic/297378-vsc-phone-number/

    Please don't stress. Calm down. Do a little research. Your NOA2 is coming. Check the link I just posted above and call for a service request.

    An expedite request means they will prioritize your case based on a reason specified by them as being grounds for prioritization. Being outside processing times is grounds for prioritization. Ask to speak to a Tier 2 representative. I have mentioned that some VSC petitions cannot put in a service request until they're hit 30 days past the 5 months mark which you are a little less than 20 days from. But it won't hurt to try. Otherwise, contact your congressman and/or senator. The USC would have to do that and all it takes is a simple phone call, email, or letter.

    ok please any help me....



    im about to SCREAM!....i have searched this forum and need to know WHAT I NEED TO DO!??!?!?!?!

    WHAT is expiditing a case? and how do i do this?

    HOW do i ask for a service request number?

    Daniel has rang the 1800 number twice now and has talked to BLOODY ROBOTS! he asks about our case and its like they are reading out of a text book- he then says we are WAY PAST the 5 month mark...and they say 'sorry for the inconvenience, TEXT BOOK TEXT BOOK #######!'

    Both times he has called they are just useless!

    What do I need to say to them to do my bloody case! ARGH please someone HELP!!!!!

    oh and ive just freaked out....coz my case has been sent to VSC....we sent it (posted it) to the texas service center....but somehow ended up at vermont! dano is from LOUISIANA...vermont doesnt say it handles louisiana cases?!?!?!?!?!?!! ARGHHH OMG?!?!?!?! does this mean eventually they will figure out its in the wrong place and then send it else where and THEN we have to wait another 6 months- KIRIA IS STRESSING
