    I think you possibly have a legal mess on your hands.

    Her i-130 was approved on 3-2018. She entered the US in 11-2018 to help with our newborn son.  She is scheduled to leave at the end of April although she can stay until mid-May based on her i-94.  I wrongfully assumed we could adjust her status next time she was in the US based on a question on the i130 without considering the type of visa she uses to enter the country.  :(  At any rate, thank you for responding. 

  2. Thank you for confirming my suspicions that we were about to go down the wrong path.  It's definitely not our intention to commit fraud. However, I wrongfully assumed that she could apply to adjust her status while visiting given that is the only way she can lawfully be in the US.  We will submit an i-824 to have her approved petition sent to the embassy in her country and she will complete the process at home. 

  3. Hello,

     

    I need some guidance.  We received approval for my mother-in-law's i-130 and planned to submit the i-485 once she returned on her b-2 visitor.   I just finished the application, but she is scheduled to return to her home country in about a month. The plan was for her to return again once we knew when her biometric appointment was scheduled.  I'm hesitant to submit now because the i-485 instructions indicate her application may be denied if she leaves the country while her application is pending even though she is leaving so not to overstay her visitor's visa.  I am aware that I can also file an i-131 with the i-485 but am concerned that I will not obtain the travel document before she is scheduled to leave.

     

    Can anyone give me guidance how best to approach this situation? Thanks in advance! 

     

     

     

  4. Hello Friends....wow I come with great news....We were APPROVED! wow and you guys were the first to know....other than me waking up my mom. Havent even told my fiance yet!!!!!!!!   5. Hi all!

    I am writing for another VJ member whose fiance recently had an interview in Guyana. In Guyana, the USC is able to join the beneficiary for the interview. The couple was interviewed together on the interview date but was then asked to come back again to be interviewed separately. They are now in Administrative review. I don't have much details beyond this at the moment. She is very disheartened that they didn't get an approval on the interview date. She wanted to know what have other VJ members experiences been with AR? About how long did it take to finally get the approval? Any info to help her understand what to do next would be greatly appreciated!

    Congratulations!!! That is awesome! Mark has been here for a little over a month. He is adjusting fine. He recieved his SSN last Friday and we are moving ahead with our Nov 12th wedding. :dance:

    I hope everyone else is doing fine. I'm sure I'll have questions once I get to the AOS phase (which is right around the corner).

    It took my fiance over 2 months to receive the interview date from when he submitted packet 3. He submitted the packet on 5/16 and we received the interview date on 7/29. According to an agent I spoke to some time ago, interview dates are assigned by some computer program. I think its based on how long you've been waiting since the time you submitted the petition and how many people have applied for immigrant visas. 277 days passed from the time I received the NOA1 and the interview date. Based on your NOA1 date, your interview date could be around 11/26 if you had to wait the same exact length of time I did (or probably 11/23 since its around the Thanksgiving holiday). This could would mean you would receive the notification of the interview toward the end of Oct. That's just to give you an idea. It may be sooner or later. Again it just depends on the number of other applicants.

    Hang in there! I know the wait can be frustrating. I had my fiance calling every week to figure out what was going on. You will get the interview date. :)

  8. I am happy to report that my fiance's visa was approved today! yay!!! :dance: :dance: :dance: I was able to attend the interview with him and the longest part of the process was the wait. Everything went smoothly. I am so happy to have found this website because it helped tremendously!! Good luck to everyone else that is still waiting.

    Packet 3 for Guyana consists of the following:

    1. DS-230 part 1 and 2

    2. DS-2001

    3. Applicant Information Sheet

    I will ask my fiance if I missed any forms. If you haven't done so already, you can e-mail the embassy and ask if they received the petition. The e-mail address is visageorge@state.gov. All the forms for packet 3 will be listed in the letter sent to your fiance. I'm even told that they can e-mail the letter to you.

  10. My Fiance's interview was this morning and she was APPROVED!!!

    She has to collect her passport with the visa next Wednesday (I wonder why it will take them 1 week to print a visa, but I'm not complaining)

  11. I was told by the NVC Rep that they have been cases in which the 129-F has been forwarded to the consulate.

    I was told the same thing (that it went straight to the consulate), but it does go to the NVC first. 129-F petitions do not stay at the NVC long. You could try to call again tomorrow to see if you get a different answer.

  12. Sorry I haven't been around for a while...not sure I was even missed haha...but Byron dumped me last Saturday. He said the fights were too much, and yeah there were plenty. But only because of the stress of distance. Anyway, I wish you all the best of luck, and happiness in your marriages! This forum was such a great support for me!

    I'm sorry to hear this. The distance and this process is SO stressful. :crying: I really hope you guys can work it out. If I saw correctly the interview is scheduled in less than month. You guys are so close...

    Just stopping to say hi and catch up on how things are going with the Decemberite crew. I'm REALLY happy to see that people are progressing along in the process. Congrats to all the recent approvals! Mark and I are still waiting for an interview date. He has been calling every week and today sent an e-mail. We are told we should hear something in the next couple weeks.

  14. HEY VJERS!!!

    Just a quick question, is there any documents that I need to send my fiance in the foreign country? I know that I'll send him the enter duplicate of the first sent out package with evidence of our relationship etc....but are there anymore forms proceeding that I'll have to have notarized and send it to him for the interview or anything that needs to be notarized here in the US in general. Does he need to have passport pics of me?

    I really just want to be on top of things before they ask for it, because mail from the US to Guyana might take a bit and my brother will be going to Guyana next Saturday so I really just want to send allllllll needed docs then... so please assist me if you can.

    My fiance is a police in Guyana so wont need any probs getting a police clearance but when do we need that? Is that for his interview?

    Here are the things ill be sending:

    the entire i-129f package sent in initially (duplicate)

    i-134 for me the petitioner (Is this the right AOS for me)

    the i-134 affidavit of support of my friend( who will be the co-sponsor)

    FYI I just say that the check was cashed yesterday :) Havent gotten my NOA1 hard copy yet....

    Hi Ro Damon,

    I would just send the copy of the i-129F if you want to send something with your brother and wait on sending the I-134F with the supporting documents. You have at least another 4-5 months before you receive the NOA2. You want the I-134F and supporting documents to have dates that are closer to the interview vs it being 5-6 months old. The I-134F is not needed until your fiance goes for the interview. I would send it closer to when he hears about the interview date or at the earliest when he receives package 3.

    I will actually bring the paperwork and copies with me since I'm going to Guyana for the interview.

    I'm just stopping by to say hi! I'm working full-time and teaching on-line so I very little down time. Mark and I are still waiting for package 4 w/ an interview date. He has been calling every Friday to determine what's taking so long. We thought he would have received the notification by now, but not yet. :blink: The last representative he spoke to stated it could take 1-2 months to receive package 4. It's been a little over a month now so I guess it will just be a matter of time. I'm just so anxious because I'm also going to Guyana for his interview. I want to make travel plans, but of course I can't without knowing the date.

    I hope the process is going smoothly for all my fellow Decemberites!
