Does she have the "red paper" for her house? If not then make sure she gets it before she leaves, and gives it to a family member in VN. If possible, she should try to keep the house occupied while she's gone. Let a family member move in, or consider renting it out. If she leaves it vacant then the government can seize it. I'm not sure what the time limit is for this. Phuong's uncle lost his house less than six months after moving to the US, but she has other family members who have kept ownership of their homes for many years.
She doesn't have the red book. She only has the family registration book (Sổ Hồ Khẩu}. The land her house is on belongs to her parents. Having the house occupied is not a problem since they live next door.
I guess she should apply for the red book but people here are saying it will cost about $500 USD to get one which seems a bit much to me.

Hello All,
My case has been denied due to Adam walsh Act. The 2 main reasons are that my fiance didn't provide the proof of 3 years of counselling and 2nd is that his D.U.I.We have submited all the evidences to prove my fiance doesn't posk risk to me, However, my fiance didn't submit 3 years of counselling as it was a part of his sentence. He was convicted of possession child porn 10 years ago. He aslo submited the evidences of alcohol treatment..I dont undestand why they still deny us? What should i do now ? Should we appeal now? Please show me how to contact with human rights group and ACLU? I'm so panic and deeply sad. i love my fiance till death. Please anyone there help us? Please Please Please
I would steer clear of this guy. Your chance of immigrating to the U.S. with him is slim to none as things stands now. Deliberate hiding or falsification of a material fact is material misrepresentation and will bar you from the U.S. for life if you're a part of it.

I'll share my own experience. I actually bought the her ticket as soon as she received pink. When she went to pick up her visa on the scheduled date they gave her a white slip requesting her criminal record even though she had it with her at the interview. We were a bit scared but she got her visa a week after that. So in IMO, if you must buy your ticket give yourself some slack as far as the departure date goes. But i do agree with others, If you can wait till she has the visa in hand before booking that ticket.
Isn't the criminal record suppose to be turn in as part of the require civil documents? Did your wife not turn it in and they overlook somehow or she did and they ask for another one?

I have a question about bestman for vietnamese wedding tradition.
For vietnamese. does the bestman have to be single to be the bestman or can he be married and still be the bestman?
Not that big of a deal. We didn't even have a best man.

questions regarding CR1 visa interview. How was it like on the day of the interview. did you submit everything including timeline, 10 year residency, etc.. once u got inside the consulate? or did u wait until u actually met the CO?

I noticed you have a photo of a baby on your profile. If that's your baby together and he/she has CRBA, your interview should be a breeze. If not, proving bona-fide relationship will be your first hurdle. Everything else is just paperwork.

After almost 8 months, my fiancee picked up her visa yesterday.
I'm very excited and happy that we are only one step away from being together.
It's an amazing feeling knowing that I'll be with my SO soon.
For those still waiting, please have faith in your relationship and things will work out. You'll see!
My advice at the interview stage is to prepare for the toughest interview possible based on other member's accounts thus drastically reducing the chances of not getting pink.

It's definitely an amazing feeling. I was expecting more white. My wife was shaking when they handed her pink. All our difficulties getting to this point just faded away.

Yes that is the date of the certificate and yes if you have been married less than two years you will get a conditional GC with you will have to adjust status 90 days of that GC expiration date
Fantabulous. Is adjusting status a difficult process? Do we use form I-751?

The date should be on the bottom left hand corner the date is the date you sign the book that is your offical date of marriage
Do you mean where it saids "Vào Sổ đăng ký kết hôn. Số......Quyển số.......Ngày.....tháng, etc....?
So if this date is less than 2 years when we arrive in the U.S., my wife will be receiving a conditional green card good for two years instead of the permanent one good for 10 years?

Yes there is a date on it. If there is no date they means the certificate might not be real.
Where is the date located? Does is specifically say Date of Marriage or just a date under your signature?
This was issued by Vietnam Justice Dept and already accepted by U.S. consulate so I know it's authentic.
Did you have to sign a book when you got the certificate?
Yes, we did.

What date is shown on your marriage certificate?
I don't see anywhere where it says date of marriage on the certificate. There's a date of 02/10/2010 above mine and my wife's signatures. That's when the certificate was issue to us. The day and month are handwritten. The year is type. Lower left corner states, "Enter into marriage book on 02/10/2010".
We got married on January of 2008. This is what I put on my I-130. Also, under Visa Class on the pink approval sheet says IR-1 but someone told me this doesn't matter.

Usually a week.. the slip should have the date.. some have been told to come back a week later as the visa was not ready yet.. so the date she will get the visa is not carved in stone
Reason I asked is I noticed most were told to come back in a week, but we were told two.

Our case has been approved. I just need to find out if they're going to issue my wife an IR-1 visa or a CR-1 visa. We got married back in 2008, but our marriage certificate wasn't issue until 2010. Does this mean we've been married for two years or not?

Most recent federal income tax return, W2, and 1099-R was what I had to turned in. Pay stubs and employment letter are not needed unless requested by consular officer but you can include if you want.

I'm a grad student and have no income. My dad has agreed to joint sponsor DH. Do I still need to fill out I-864 even though I have no income?

Given that the HCMC consulate sometimes makes up its own rules, it's best to be fully prepared.
The thinking is that you don't want to give any reason not to give pink. You go in fully prepared so to mitigate the risk of being given a blue slip.
If you can go and be with your fiancee you should do it. I highly advice it. You'll be glad you did..

Being with your spouse really doesn't make any difference as far as the con/off is concern. I was with my wife every step of the way. Didn't stop the con/off from dishing out blue and white. What made a difference, at least for us, was that I was able to counter whatever the con/off dished out right away. The day before we got pink, con/off asked for W2 of joint sponsor. I went home and had him email it to me. Print it out and submitted it the next day. We visited the consulate six times within a month and a half. Anyone who's been there knows this is not fun. But in the end, it was worth it. The pink slip is nothing but a checklist they have to go through before they can issue your visa. Going through the process, I also thought they make up their own rules and do what ever they want, and they can. No court in the U.S. will come to your rescue. Now that our visa has been approved, I realized that they're just doing their job. Give them what they need and they'll give you what you want.

I've looked on the interview letter as well as on the HCMC Consulate website immigrant visa instructions document and I can't find an answer to this question.
Most people going through HCMC are submitting:
1. Notarized 10 year residence history for applicant
2. Notarized relationship timeline
But I can't find anywhere on official channels that says these are required, including our interview letter. I've seen the threads saying that HCMC interviewees are including them as a matter of course now. Where did this start? Is it only necessary after a blue slip or if the relationship is questioned?
It won't take anything at all to whip them up, I'm just curious about the origins of this. I know they have been asked for after a blue slip, but are there also cases where pinks are given without them?

Hello Everyone...
I need some info.. I just received my NOA2 and now Im trying to get myself ready for the next step and I was reading over some info and it was asking for my last 3 years of my tax returns. But the only problem is that I only worked 3mths in the year of 2009 and I didnt make enough money so I didnt file my taxes.
Do anyone know if my 1099 would work in the place of my taxes? I didnt receive a W2 because I was working on contract. Can someone please let me know if you have any information on this topic.

My joint sponsor submitted his 1099-R and they accepted it.

If he's sponsoring your son also, yes.
Sorry, this is the wrong answer, I couldn't edit.
The others are correct. Your son is a USC and does not require a visa to enter the U.S.

Hello all,
Last week I submitted the I-864 and DS-230 for my wife following the shortcuts/guides posted on VJ. However, I just found out about the DS-2001. Do I need to submit this too? If so, how should I send this now knowing that I've already sent the DS-230 packet.
Or does my wife to submit this wife to the HCM Consulate as part of her submissions (i.e. medical exam) to the consulate?
Please advise. Thanks!
DS-2001 is a form to notify the consulate that the applicant is ready to be interview. You don't send this in until you have all the require documents for interview. I emailed mine in.

Hi Visa journey, my wife is currently waiting for an interview date. I used an agency to help me file the CR-1 petition process. I have notice that HCMC consulate nowadays request a 10 year residency from the petitioner and list of relatives currently residing in the US. I ask my agent about the 10 residency and list of relatives and she said that "do not provide anything unless they ask for it". I am going back to VN to go with my wife for the interview and I just want to prepare all or most of what is needed by the consulate. So is my agent right or should I prepare the 10 year residency & list of relatives and have it notarized before I go to VN and bring it to the interview??? Thanks everyone for your help, god bless.
Better to have and not need then to need and not have. Although we prepared one and they didn't ask for it.

What price are you talking about? This is my wife's house, not mine. I've been living in Vietnam for the last two years and haven't had to pay any price for being a Viet Kieu.
