    Thanks. I called NVC and they said that case is not yet transferred to embassy overseas, it is at NVC and there is no approximate time when it would be transferred to embassy.

    For now i am thinking of calling DOS later.

    Will VB Retrogression affect my case?I am thinking answer is yes as i cannot get visa until priority date is current.

    All FB category first case complete, then few weeks later SIF!!!! Only IR1/R5 case got first SIF and followed by CC.:thumbs:

    priority date - August 21, 2003

    notice of approval date ( i-797) - October 19, 2009

    my birth date - 29th august , 1987

    according to CSPA act i will get benefits up to September, 2014

    NOW HOW MUCH TIME IT WILL TAKE FOR CHOICE OF AGENT , M AFRAID THAT WHTHER I WILL GET THE BENIFITS OR NOT AS I ALREADY GOT REJECTED FOR STUDENT VISA TWICE , NOW I AM PLANNING FOR CANADA , WHAT SHOULD I DO , SHOULD I WAIT OR SHOULD I GO WITH CANADA?

    Family Based is not connected to student visa. In your case, your uncle has petitioned for your mother and u r part of the derivative category.Your Interview will be based on the Country of Birth.

    Family Based is not connected to student visa. Mr VisaGrant is right. You do not need to worry about that.

    I myself was rejected thrice for Tourist Visa.

    You want to go to CANADA or USA; that is up to you to decide.

  4. Yesterday i received email from NVC that few docs are missing,i have already prepared that docs/affidavits,problem is the cover that came with it has wrong beneficiary's name.

    It is my Grandfathers name written on it.(My mothers first name and grandfathers first name is same;only middle name is different.)

    What should i do?

    Should i send the cover letter as it came from NVC, or should i change the name and let the NVC operator know that i did it.

    For the two NON-AVAILABILITY(Unobtainable)birth certificates, did you send the NON-AVAILABILITY document from the Govt. Office along with the affidavits..?

    I have sent the NON-AVAILABILITY document from the Govt. Office; but did not send the affidavit from anyone.

    Should i prepare NON-AVAILABILITY certificates again?They are too difficult to obtain an takes about 15 days or so.

    Or should i simply prepare the affidavits(assuming they have NON-AVAILABILITY certificates with them already)and send them to NVC.?

    AVRS says that letter was mailed on DEC 10,how long will it take to reach petitioner at NY?

  6. Called NVC,talked to operator, she said that two of birth certificates are missing.

    Well we sent all original BC for all of us.The way i see it two of birth certificates were NON-AVAILABILITY(Unobtainable)birth certificates and these two certificates NVC is stating as missing.I think i will miss January too. Now what to do? :(

    Any suggestions ?

    i will go through I485 route only but as u said i need clearance from all places i resided since 16 than i also resided in US for 8-9 months in US??

    You wil need Police Clearance from all the places you have lived for more that 6 months since reaching the age 16.

    This is not my prediction but an estimation based on other VJ'ers timeline.

    Per your timeline IV took 17 days to enter into NVC system. If your IV was delivered at NVC on 11/17 + 14 days = December 3th. This is the date NVC will enter your IV into their system. After that it takes usually 6-7 days for SIF ie. 12/10. So you should probably have your SIF on December 10th (if you don't get any RFE, hopefully not) and then after a day or two (usually) you will have your CC ( Case Complete) on December 12th..:thumbs:

    Keep checking the Online Portal and let us know the good news..:yes:

    I am checking the portal everyday;waiting for SIF. I can only pray that case gets completed ASAP :yes: (no RFE :no: ). Will let you know if there are any updates.

    Based on the above letter and seeing the timing of your packages, it is just a matter of overlap.Right now it is taking roughly 12 days to enter IV packages into the system..NVC operator does not have access to the mail room and to see the contents. They can only see the computer screen and to say if it is received, reviewed, closed etc.Keep Calling NVC and Ask..When AVRS(Automated Voice response system) says checklist respond received...that means IV packet has been entered into the system.. :yes:

    I am calling NVC regularly and will let you know on any updates.

    Last week nvc machine said that they have received I864 but are waiting for DS230 package.

    Now the machine says that -"NVC has reviewed the documents you sent and found information or documents missing.NVC has mailed a letter to petitioner."

    They said letter was sent on 22 of nov. On 24th nov i received email from NVC :-

    We have reviewed the documents which you submitted in support of an application for an immigrant

    visa. Please review the information listed under each applicant's name and provide any documents

    which are indicated as missing or need additional information. You must submit the required

    information. Failure to provide the requested information will delay your immigrant visa interview.

    Please read the enclosed information to determine where to send all required copies of missing

    documents. If you have any questions regarding this letter, please call the National Visa Center at (603)

    334-0700 between the hours of 7:30am and midnight ET.

    Please include a copy of this letter with your correspondence and write your case number clearly (exactly

    as it appears below) on the upper right-hand corner of all documents.

    From the date you mail or transmit the requested information, please allow 20 business days for NVC to

    review this documentation/your mail. When we complete our review, the NVC will notify

    you/petitioner/beneficiary/attorney with information regarding the next processing step.

    ______CORRESPONDENCE INSTRUCTIONS:_________________________________

    When responding to the National Visa Center, please include the bar code sheet that came with this

    letter. Failure to include the bar code sheet may cause a delay in the processing of your case. The bar

    code sheet should be placed on top of all documents being submitted for this case and mailed to the

    So after reading this i called NVC, to my surprise operator said she does not have any information regarding I864 & DS 230.

    It is my understanding that missing documents corresponds to DS230 package and NVC has not yet reviewed it.

    I864 package according to USPS tracking was delivered on October 29, 2010, 11:47 am, PORTSMOUTH, NH 03801

    Ds230 package according to USPS tracking was delivered on November 17, 2010, 11:32 am, PORTSMOUTH, NH 03801

    I will call NVC tom night again, any suggestions anyone?

  11. I was told to post here, my F4 Visa case:

    I currently live in Canada with my parents and my uncle has sponsored my dad for permanent U.S. immigration. My uncle is doing F4 Visa, for brother/sister. My dad got the VISA approval this past September, but no VISA's available yet because of too many applicants.

    I'm curious to know, if my dad gets sponsored, will he get his Green Card right away? Or will we have to wait a few more years after he's landed, to get his Green Card/LPR? Apparently, this will affect if I'm able to immigrate with my dad at the same time.

    Again, here are the dates:

    Petition date: April 2003

    Petition approval: August 2009

    Date that my dad received VISA Number: (Unknown)

    My date of birth: August 1988

    P.S. I know I'm 22 right now and would be considered an adult, but under the Child Protection Status Act, I could be still considered a child when the VISA number becomes available.

    You don't have to worry about anything.First of all you are covered under CSPA; from the details you have provided your CSPA age comes out to 16.(you can check the CSPA calculator here:- CSPA CAL.).

    To qualify as derivative beneficiaries on the petition for your father, the only requirements are that 1) you are not married, 2) your CSPA age is under 21, and 3) attempt to adjust your status within one year of your father's PD becoming current.

    When you father's PD becomes current;he will get a letter/email requesting the AOS fee (I-864) and IV fee (DS-230)

    As VISAGRANT said,you can call NVC and talk to operator at:-(603-334-0700),between Monday through Friday from 7:30 AM to 12:00 AM (Eastern Time).

    You can also ask NVC that you qualify for CSPA or not.(I called NVC for my case and the operator said that i am covered under CSPA.I am in F4 category,current age 21.)

    Don't worry about if your name is in the petition or not,call NVC and let them know,just make sure that when requested by NVC your AOS fee and IV fee are paid.

    Any Updates on your case?

    Sorry for late reply,i was out of town for PCC.Getting PCC from old city where you used to live is extremely difficult;As my father was a banker and he had postings all over the state.The police persons took ₹ 7,000 for making PCC of my father from his birth city.

    We have completed everything and will be sending the documents right away.

    Uday, check for I-864 bar code coversheet from the online payment site and then print and express mail the entire I-864 (Affidavit of Support) Package to NVC.

    Write NVC Case Number on the top right hand corner of all pages of the I-864 Package and supplemental pages (tax invoices, employment letter, etc.)

    For DS 230, If the payment shows as paid, print out IV bill bar code coversheet from the online payment site. You have to attach the original PC, so, u have to wait for that.

    Meanwhile after mailing I-864, Keep calling NVC and check whether their system is updated for your I-864..:thumbs:

    Thank you RICARDO4EVA2 and VISAGRANT. My both AOS and IV fees are paid now. I will be sending I-864 and DS-230 as soon as possible.

    I will let you know guys any other updation on my case.

    First..Congrats on ur progress at NVC..:thumbs:

    Check the below link and u will know the process followed within NVC

    After u paid the IV fees online...

    1. Wait 2 to 5 days (but keep checking online payment portal ( My link) status,once a day after 3 PM EST) .

    2. When status changes in the online payment portal to "PAID" - get the Payment Receipt AND Coversheet from the online payment portal.

    3." PRINT" the payment receipt AND coversheet.

    4. Send off the form, the supporting docs, and the coversheet and payment notice to NVC.

    Once the above steps are finished, keep checking the online payment portal and your email for the NEXT steps, then go through the above 4 steps again.

    Unless if there are any delays at NVC, the AOS (I-864) is accepted first, then the IV (DS-230) is second.

    Does the petitioner meet the income requirement with "OWN" income? If yes, petitioner has the choice of using either (864 or 864EZ). If not, and petitioner is combining the income, needs to use I-864. Since you are the intending immigrant, no I-864A is needed in that case.

    It's better to send only the basic required documents with the AOS application -- tax transcripts, W-2, etc. and then bring the big stack of documents to the interview, showing them on an as-needed basis according to what is being asked and said in the consulate interview later.

    Ask the petitioner to see the copy of their 1040, find the line that says "adjusted gross income" and copy the amount in that field to the AOS form.

    Regarding assembling the documents, especially the police certificate(PC) takes longer, so as you have already paid the IV bill, take a copy of the coversheet to get the PC faster.

    Don't forget all the listed documents has to be sent in "ORIGINAL" along with the photocopies to NVC

    Finally, as said earlier, make 3 copies of all documents incase of an emergency need and Also write down your NVC Number on a postscript and keep them on all your originals

    AOS has already been paid;can i send I-864 right away? And when IV fee bill has been paid i can send DS-230 also;without the notification from NVC? or should i wait till NVC tells us to do so?

    I sent an email to NVC for CSPA facts,I received the email after couple of days stating that my case has been put into CSPA review.

    I also had send DS-3032 via email to NVC,Today I received that they had accepted MY Choice of Address and Agent and IV fee bill got generated,I checked the link you provided My link,it has name for all family members including my 25 year old brother,so we are covered under CSPA right.?

    Sir you told me to collect the following documents:-

    Then NVC will send the kit via email and you should start assembling all the below documents..:yes:

    --Original Marriage certificate

    --Photocopy of Marriage Certificate

    --Original Birth Certificate

    --Photocopy of Birth Certificate

    --Original Police Clearance Certificate from Local Police Station.

    --Original Police Clearance Certificate from Regional Passport Office.

    --Photocopy of beneficiary's Indian passport.

    When they will ask me to submit all this.?I suppose this all will be going in IV package.

    My petitioner is my choice of agent,but the tax forms will be submitted by someone else;so which form should be filled?I-864W or I-864EZ

    Please guide me through.

    If you have provided the email address for the beneficiary and petitioner to NVC, then go ahead and send the DS 3032 contents in the beneficiary email address to NVCINQUIRY@state.gov.

    As your priority date is current, you can send the DS 3032 email right away. NVC will respond to all emails.Call NVC a day or two to check whether they have received your DS3032..:thumbs:

    When calling NVC, do mention about the CSPA and check/provide the CSPA information for your case. Do check the below link and ask any of your queries with the NVC.

    You should be'pro-active',instead of reactive and push things INTO NVC based on payment status at the online payment portal or the Affidavit of Support.

    and note that the 'downloaded barcode coversheets' contain instructions on 'what to do' for 'each step'.

    I was gong through NVC Shortcuts and found something.

    Please read the red underlined text.

    6. Send DS-3032 to continue processing.

    The DS-3032 AKA Choice of Agent, is the form that indicates who will pay the bills and accept other documents from NVC.

    Once all documents are fully loaded in, the AVR message MIGHT change.

    Operators will be able to tell you if the DS-3032 has been generated.

    If the DS-3032 has been generated, you can email it [8] or use the instructions at the top of this guide to create your own barcode cover-sheet.

    Attempts to send DS-3032 via email may or may not receive an automated response...but the automated response does not mean it's been accepted.

    Due to SPAM filters at NVC, if you do not get an automated response immediately, either switch to a different email account or mail the DS-3032.

    Once accepted, you will get an email message...or you can confirm with operator.

    Attempts to mail or email DS-3032 before it's been generated are useless. It's like trying to pay a water bill for a house that hasn't been built yet.

    The auto response email just means that they accepted your email. It doesn't mean they can do anything with it.

    It’s a good idea to mail AND email the DS-3032

    Should I call and confirm that DS-3032 has been generated or should i send DS-3032 anyway.?

    One thing more I am derived beneficiary,My age is 21 years and 5 months,case was pending at USCIS for 8 years,I emailed NVC stating my age and CSPA act so that i can also get VISA.My CSPA age comes out to be 13 years.Should i do anything further or that is good enough.?
