  1. Hi do u think there will be no visa movement till Sep 13 !!! New allocation will start from Oct 13 !!!

Since F4 category has fixed quotas, it would continue to move at same pace in the upcoming bulletins. It would move faster if

    (a) the visa filing demand decreased from 2001 onwards or

    (b) Number of visas allocated for F4s suddenly increase

    Good Luck..

What I am thinking is if they recapture unused visas from 1992-2013; we can see huge jump in Oct bulletin.

I am hoping the cases which are already completed and waiting for visa number could get "current".

This bill should really prevent these visas getting wasted.

  2. Obama said he's very confident on the immigration bill ; although he hasnt seen senates proposal of bill.

Moreover the previous bill is too old for today; and not compatible for present time.Theres no chance they will keep ligering to it any longer.

The new bill will pass ; and i dont have any doubts about it.

Best is to wait and watch.

This bill will not pass.I'm sure about it.

On what basis are you saying this?

  3. Hi what is going on !!! Can you please explain !!!

    hi there,..

Theres nothing going on brother...i suggest everyone should wait patiently for the final bill to pass. Some of the amendments are getting adopted some are withdrawn.

Our discussion is pointless before all this.

Lets all hope everthing goes on smooth

    GOD be with us all.

  4. hello every body

i want to ask that who is eligible for the "CSPA"

    Eligibility Criteria:-

    1. Must be the beneficiary of a pending or approved visa petition on or after August 6, 2002.
    2. The beneficiary must not have had a final decision on an application for adjustment of status or an immigrant visa before August 6, 2002.
    3. The child must “seek to acquire” permanent residence within 1 year of a visa becoming available. USCIS interprets “seek to acquire” as having a Form I-824, Application for Action on an Approved Application or Petition, filed on the child’s behalf or the filing of a Form I-485, Application to Register Permanent Residence or Adjust Status, or submit Form DS-230, Application for Immigrant Visa and Alien Registration from the Department of State. The date of visa availability means the first day of the first month a visa in the appropriate category was listed as available in the Department of State’s visa bulletin or the date the visa petition was approved, whichever is later.

SOURCE:- USCIS - Child Status Protection Act (CSPA)

If you need to calculate the CSPA age,you can use this-- CSPA Calculator or google it.

    Hope it helps.:)

  5. from now onwards...Good Luck for your Graduation..

    :D

    Thank you :)

I graduated in US as an international student before I come back home to have an interview. I also missed the graduation ceremony. I do not know when the priority date becomes available again. It feel like we are all waiting in vain.

Sorry to hear that: and yes we all are waiting in vain.

I haven't filed yet, planning on doing it this month. Long wait ahead....lol

Definitely a long wait ahead.

  6. You said u r not in a hurry...:)

I am in last year of my graduation; my finals are in JUNE 2011.

It was my misconception that i might get a interview in march or april.

I was thinking of getting visa around june as i would not be able to go overseas before june, that is why i was in no hurry.

But for now if the same trend continues i dont know how much months i would be wasting after graduation. :o

  7. Good News are always filled with Hope..:)

    Hi All,

My parent’s case was completed on 21/11/2010. We are waiting for interview date, I called NVC last week and they told me that our visa number is available but because of limited capacity of Mumbai consulate I have to wait for interview date. Any one got similar answer from NVC? Does my case be affected by retrogression?

    Thanks for your input

My case was completed on Jan 11. I was thinking of getting a interview in March. But after reading your post i think that i might have to wait a longer time.

NVC told me to wait for 8 weeks for any notification.

Without your priority date it is impossible to say if you are affected with retrogression or not.

Do provide some more information about your timeline.

  9. tried visiting the link and it says Sign In Failed...whats next?it was last November 6,when NVC advise me that they place my documents in my case file..and wait for a later advisory when it is forwarded to the consulate.does it mean that my case is out of NVC?

    Yes

The consulate will schedule your interview as soon as your priority date becomes current.

    Good Luck :)

    GOD BLESS ALL

  10. Can anyone explain me what is retrogression and why it happens?

    thanks

    Hi agnar

Retrogression refers to the situation where previously current dates on the quota bulletin go backwards and become unavailable.

Retrogression happens because there were many applicants who filed adjustment of status in the United States, and thus the visa demands have increased sharply over the numerical limitations or supply that the Dept of State have alloted.

Retrogression can impact an individual at different times in the overall process. The individual’s priority date must be current at two critical

points in time: on the date that the I-485 application for adjustment of status is filed or application for immigrant visa at an Embassy/Consulate

is filed AND it must also be current on the date when the case is actually adjudicated (i.e., the immigrant visa cannot be issued or the

adjustment of status application cannot be approved if the quota bulletin is not current for the applicable priority date).

I am also affected by the Retrogression and NOTHING that can be done about it except to wait and pray for the best :(

    GOD BLESS ALL

  11. i am just curious and just asking what does sign in failed means?sorry, got no idea about it can anyone share me what does this mean? cc what i understand is case complete am i right?thanks and God bless

    Hi pampoo.

Sign in Failed refers to online payment portal. It is Immigrant Visa Invoice Payment Center; where you pay your AOS and IV fee bills.

You can Visit the site here. (Immigrant Visa Invoice Payment Center). You will only be able to sign in here if you paid your fees online.

CC is when you get a CASE COMPLETE. But it still needs to go through the final stage. When you get a SIF(Sign in Failure) it means NVC has completed the case at their end and you out of NVC processing and NVC will forward you case at desired consulate.

When you gt a SIF; that's a indication that you are 100% out of NVC and it is good to get a SIF!!!

  12. F2A Visa Information is :ot:

    for F4 Visa Filers..

    Family Preference Data for India

Based on the above link, it is not an analysis but an observation, which i observed is that the Retrogression happened on July 2003 and lasted till August 2004..

On a Positive Note..Past performance is not a indication for future trends..:)

The Priority date in JUNE 2003 was 8-Jul-91, It retrogressed to 22-Mar-90 in JULY 2003.

It came back to 1-Aug-91 in AUGUST 2004. It took a complete year to return to the previous date. :(

I am eagerly waiting for next VB; maybe it can come back to 1-Jan-02.!!!!! :D

    GOD BLESS ALL

  13. Welcome beenwaiting..:star:

I can understand your anxiety..Another VJ member Sonblom can provide the expertise for ur question...My thoughts..You need to work with a competent lawyer for any hope of success. It will be a good idea to invest some $$$ in a competent lawyer..I can suggest one..check the link below..

    Attorney Sheela Murthy

    Good Luck..

Mr VISAGRANT is right. Hiring a lawyer is best option. Murthy law firm is good. You can also search lawyers on AILA. AILA is the only legal association in the United States for immigration attorneys.

You can also opt for Law Offices Of Carl Shusterman located at Los Angeles, California. He was former INS Attorney and is expert of Child Status Protection Act(CSPA) Cases.

    - Uday

    GOD BLESS ALL
