  1. Penguin_ie is accurate and those things will be considered. I don't know if the petitioner needs to be released or not. However, the circumstance of being a "lifer" is going to be a challenging one to overcome. An attorney advise might be necessary ...

    Agreed as the initial petiotion is the one that does the major background checks on the petioner.

    I am guessing that the prison will allow a conjucal right as any marriage to be valid according to the petition instructions must be consumated.

  2. They are going to remove everything from the binder and plastic sleeves and arrange it as they like. IMO it will be more work for the agent to do this than to go through a neatly arranged stack of documents. We sent ours in with a cover sheet listing everything in order and just clipped the pile together. While the care you put into your package may reflect your intentions I seriously doubt it has any effect on approvals.

    This is what we were advised to do also.

    To make it like the petition would slow them down TBH and theye are only going to disassemble it to scan ready for the consulate anyway.

    Cover letter and components required clipped together.

    However i have read somewhere that NVC do not make decisions to refuse or approve, they just collate the required components that the consulate require to make the final decision!

    So I would advise your partners to get ready for the medical and iterview all the same!

  3. I'm a woman who was born and raised in the USA, and currently live here in California. I met a really nice Egyptian man online. We've known each other for a while, talking on the microphone for hours, in Skype on a daily basis. He is a teacher, currently working in Saudi Arabia. He vacations home to Egypt for the summers.

    Just before him, I had divorced a man after a 6 year marriage, in which I was a "house wife", only earning a small part-time income from home (husband earned plenty). After the divorce, I lived with my mom back in my home town, where I now have a regular job.

    Well, me and my new Egyptian sweetheart want to get married and I want to bring him here to live with me. But first, I have some questions:

    1. I do make good money now, but I've only had this job for a year. Is it true you need to have kept your job (earning at least double the poverty level) for 3 years in order to sponsor an immigrant?

    2. Is there any way around the above rule? I mean people move sometimes, it happens. People switch jobs. Not everyone has had their current job for 3 or more years... You would think that would be logical. I've heard of co-sponsors, and sure I know people who have had a good job for more than 3 years, but... Just because I know them, doesn't mean they would be willing to do it.

    3. What's all this I've been hearing, about American women leaving the USA to stay in Egypt with their husband, while they wait for the Visa to file? How are THEIR husbands getting visas? I know those women can't be earning above the U.S. poverty level, living over there. And if they went to Egypt, they obviously left their U.S. job. How do they do it?

    4. We plan to meet in Egypt. But as for getting married and bringing him here--- what would be the best course of action? Should I meet him in Egypt, then file for a fiance Visa from the USA? Or should I marry him there, and then file for a marriage Visa from the USA? Which would be more likely to get him here with me, and take less time?

    With my living situation, is it even possible to start the procedure any time soon??

    No simple answer as you have asked many questions that are covered by different visas, I can not answer for the earnigs that you make. However the quickest way is to meet then file the I-129f 6-8 months on average and dependant on countries consular process and will depend if your earnings can be based on the current year, someone will clarify.

    If you marry in egypt you have a longer wait 9-12 months is again about average, but some are getting through in less, but each case is unique and specific, what works for one will not work for all!

    I can only answer for what I have read on DCF (Direct consular filing) inthe UK. You would need to go out to him, marry and remain for a minimum of 6 months, remember this is based on how it works in the UK, then you would have to prove domicile in the US and if you have no job, you will need a co-sponsor i beleive, this is my basic understanding of DCF this can take 5months onwards but again depends on country specifics.

    The k-1 route which would involve you filing the i-129f petition would be fastest route but works out more expensive and he will not be allowed to work until he has his permit which can take a few months after his arrival where as the CR-1 after filing the I-130 once approved will allow him to work from the day he lands, its cheaper, but the wait is longer for him to get the all important interview.

    you just need to have the earnings bit clarified for you

    Follow the short cut as shown in the guide and you will wizz through it I am sure.

    The record apprently is held at 11 days, we failed this because we are still waiting for our case number from NVC at day 11.

    But this next process can be done in a few weeks!

  5. So I guess because of the huge goof up of not filing for a K1 visa....

    The best thing to do now is still carry on with wedding plans and then file for i-130 afterwards, and just be apart even longer...

    But i've heard it takes 7 years or so for i-130 to be approved!!!! is it true he cannot enter the US while i-130 is being processed?

    At the same time while he's applying for i-130, can I ask him to apply for a UK residence card for me as well?

    Ok this is straight from the hip, but our motto is hav a back up plan, that orn in mind....

    Yes can enter under vwp to marry, no can not adjust status, they are getting harder on this and if you proceed, well it could be devistating.

    Your plan to get married is valid and good provided they are not refused entry to the U.S on arrival this is where you need to have a back up plan in place, in your case it would be the K1 visa route usually less waiting time, but on arrival they can be waiting a few months to work, but this may have changed since we last researched.

    The CR1 on acceptance will allow them to work from day 1 of entering the US, but the drawback is that waiting to get it takes longer.

    Dont go down the K3 route, its being phased out and just complicates issues.....either file I-130 or the I-129f you may still visit each other during th process, but will need patience and wait!

    In essence, but as said, research here, read the posts, but dont go by specific cases as each are different and what worked for them may no work for you

  6. It took us 4 months and 6 days, dont ask hours or minutes.....lol

    To be honest it all depends each case is different, you could be together in 8 months or 12 or this could be totally wrong, its in the hans of the people who make things happen now, so i would sit back and wait.

    NOA-1 usually within 10 business days, but have known it longer, but if the USC filed the 1145 form with the pacakage i-130 then they will get text to confirm NOA-1.

    In essence how long is a peice of string? No one here or any other forum can say!

    If you are missing your wife, then do what we have schedualed, visits to each other if possible....every 3 onths to help keep the pains down.

    I realise not everyone can do this, but it has helped time fly with us, something to look forward to.

  7. Just to be clear, a fraud investigation is primarily focused on the intentions of the foreigner, not the intentions of the US Citizen petitioner. Some fraud is mutual but most is not. Clearly one of their concerns is that he applied for a student visa while in a relationship with a US Citizen. Many pertinent facts are missing from the initial post, which may or may not shed light on the problem.

    They are the same age, but how old? (This pertains to whether they are of "student" age.)

    They have at least been acquainted since before the student visa was applied for. For how long and how serious was the relationship? The OP says the engagement wasn't "official" but just what WAS the relationship status when the student visa was applied for? Evasive answers raise suspicion.

    How did the couple meet and how did their relationship develop?

    Does the foreigner have family in the USA already?

    If everything is on the up and up, the visa will probably eventually be approved, but it sounds like they are investigating to rule out first, whether the student visa application was an attempt to circumvent immigration law. If it was, that's a problem. We don't have the facts but the OP does.

    Totally agree with this post and speculation and conjecture is futile it is best to wait to hear what they want as supporting evidence if anything or whatever they are doing during this time, but as said, If you have been 100% honest with them then there is nothing to worry about, just another part of the waiting game Im affraid

  8. thx .. There is no mail I have received yet..I have NVC case number and Identification number csr gave me.. But nothing else..

    I can't pay AOS bill yet because not in system

    What you need to do is call nvc back, speak to human and give them the case number and ask them to send out the DS-3032 to email addresses, yours and partners and the non USCs 3032 can be signed and faxed or emailed back to them, but follow up with snail mail, once this has been done then the AOS and IV fees will be sent to the choice of agent, which should be the USC as the civil documents will be requested.

  9. I didn't get a text/email even though I filled out the 1145 and sent it with my application; I even got a text/email about receipt of my package to begin which is very odd. Anyways, I got an official paper in the mail with my NOA2 date on it instead.

    It does seem odd, however I guess like the status page, not everyone gets to see thier progress, but glad you have NOA-2 in hand! Now the hard work begins!

  10. what application are you filling out first? it could take a wile, and yeah it sucks. have you thought about staying in the usa and waiting? say for 6 months which you are allowed to?

    UKCs are only allowed to remain 90 days under the VWP.

  11. Congrats to All of you who got their NOA2. Are there anyone left in Jan filers that did not get their NOA2?? I am one of them.

    Waiting and Waiting... still continues... :(

    provided you registered the 1145 form at the time of filing, your wife will get a text and email and you will just get an email.....Be aware that if you try and work out thier working times to 5pm, its futile as our notification came at 7pm US time so either working late or an auto updater!

  12. I don't know if the immu. paper is entirely lost or misplaced but I just want to know how vital this is at POE time. Will I have to present this at POE? I only have the x-ray CD so I'm pretty going batty right now since that's the only paper missing in my file :bonk:

    If you have your mysterious brown envelope, everything should be in there that is required, but if it worries you, can you not ask your doctor for a copy just in case?

  13. Ohh wow that is so not fair just for writing the date wrong you got held back that is so ridiculous..I sure hope I have better luck.. how long did they end up holding you back for?

    What did you have to do??? Did they send the forms back to you or did you have to refill everything out??

    As mentioned before it could be a simple mistake, I have generated 3 times the DS-230 with silly stupid mistakes like address of where you will live, but I failed to read the part it states, list who lives there presently...., i put the address down correctly, but faild to tell them she lives there now. Couldve been an auto RFE, another is forgetting to check a simple yes no box on another question, so it pays to keep copies as I had already sent my wife my ds-230 ready for the next step, unless you can check your copies and see what it might be I would suggest trying not to worry too much, whats happened has happened and at least you will have the chance to rectify it!

    I just wanted to know roughly when I should book my medical for London. Is there a long wait time to get an appointment from what you guys know?

    Also how long do they last, whats the expiry, 6 months?

    In essence you can not book your medical until you have approval at USCIS and your LND number

    You are a couple of months min from NOA-2 once your wife gets this notification, you will also get an email or will know by the status on USICS site...After around 9 to 15 days, your wife can start to call nvc number and check with auto voice responder AVR to see if your file has been put on the nvc computer, if it has she will be able to get your case number which will be different from the number on the NOA-2 it will start LND short for London where your file will go once complete.

    By having your LND number you can call knightbridge to arrange that appointment and its one less step for you in the UK to do later on, but heres a link that will show you short cuts and steps through the NVC process, worth reading to understand what will happen next NVC Shortcut

    Our USCIS journey took 4 months and 6 days, but not all may go that fast and we are now into our 5th day after NOA-2

  15. Thanks all for the response. Issues about our Exs do come up in our conversation from time to time. I know that to the visa officer it will show evidence of open, good relationship & communication afterall we all have past, good or bad.

    What you are doing by discussing with your new partner is right in fact its a must, you hit the nail on the head Relationship & communication are vital for any marriage or relationship.

    Your partners past may hurt her as much as it may madden you or may not depending on your demeanour, but here is my take on things from reading the odd post on this thread

    One poster said that London will not grill you....Dont take thier word for it, just because they werent questioned about it does not mean to say others werent, we may never know unless they come here to post thier experiences.

    In my opinion, if you truly know your significant other, you will know about thier achivements and tribulations, good days and bad days, likes and dislikes to know about thier past will help you learn to truly love and care for her/him and prevent making the same mistakes the others did to hurt thier partner.

    Today on skype, my wife and I were discussing EXs and how I tend not to bring mine up as much as her and asked if she should stop....I said no, I need to know, but equally I told her more of my ex, which hurts me and know it hurts her to have to hear how I was treated, but she knows the triggers if she ever wanted to hurt me like my ex, but know she wouldnt and know she will avoid them.

    In short, It is best to know about your partners past no matter how trivial they think it might be, but if you truly love them and know them, you will know of them regardless of any pain that it may contain.

    If you have copies as we do of everything although ours will end up being a CR-1 and not K-1 now would be a good time to read up on past divorces, learn and understand them.

    My wife and I have both said the same about getting married , "we aint doin this again" We have found our true soul mate!

  16. Had same concerns, but love takes many guises and recent studies suggest it takes a fith of a second to fall in love. That said we met online via an online radio station chatted for a month or so engaged 6 months later, married a year later and will hopefully be together a year and a half later being july august 2011 with many trips since our first meeting to and from each other inc Ireland, paris, scotland

  17. The difference in our age does not matter in this situation as we both care and love for each other. My problem is when a man is older than a woman they approved their visa but when it comes to a woman why they do not approve. I do not look like my age and he do not look young either he is 27 and more mature than any man i have meet.. My question now is WHAT IS THE NEXT THING TO DO...

    I think you will find the question was a genuine and valid one, the age difference does matter to US goverment officials, it is common ground for them to query mass age differences. They do not look at the LOVE connection side of things.

    The person asking the age gap was merely trying to help you to reason, shooting them down by not answering something that may able to help you understand.

    Its your choice to provide information that could or could not help you!

    It is not possible to second guess the interviewing officer, but if you are a young male intending to marry a much older female, then he has to ask himself the true nature of the relationship so in essence he has every right to approve or deny!

    The NOA's seem to be coming in fast and furious now! Congrats to all who have gotten them!

    It is frustrating I know as we have seen others get theres who filed after us, but patience pays off it truly does and it will come for you also just need to hang in there, we are at thier mercy!
