  1. Does your Green Card say you were a "Resident Since" Aug 2011?. If yes, then you are eligible to apply for citizenship within 90days of your 3rd yr anniversary of becoming a Permanent Resident.

    Here's the Eligibility Requirements for Spouses of USC

    My current or extended 2 year GC states "Since 8/29/11" I do not yet have my updated 10 year card as they state it will be with me within 60 days, but know others have been getting them within 2 weeks.

The USCIS website case status checker is working today, but do not take what it says as the true process as the site is not being updated and has not been updated for many in the last 30 days, I know this from a small group of us on Facebook that have applied and already been approved after submitting our I-751 and even I got a letter stating my I-751 was approved 2 days ago, but have not had email or text updates as I signed up for let alone the website being updated.

    You will be torturing yourselves if you rely upon it being accurate and updated daily! Take what the site says with a pinch of salt! In other words do not take it seriously!

  3. HI all, I guess this is where my last stop will be in the whole process of the VJ!

    I had my I-751 approved with a decision date of 10/07/2013 so the process took 4 months and a few days.

    I entered the U.S August 29th 2011. Am I right in my calculations that I may submit my N-400 within the 90 day window of my 3rd anniversary, that window starting in June 2014?

    Glad to have finished the 751 process!

  5. Question! Why did she apply for the visa when she could have used the VWP or visa waiver program which would allow up to a 90 day maximum visit? Norway is a VWP participant!

    You can still go down the K-1 route, she has not been disqualified for all intent and purpose, just means she will not be allowed to visit until she can prove strong ties to her homeland.

    And now she has applied for a visa and been denied, it is unlikely she will be allowed to use the VWP ever again which is of no concern as you will petition uscis for her to apply for the K-1.

    Alternatively, you could visit her, get married and petition for the CR-1 but last I heard. the K-1 would be the quickest!

    No futher problems due to accent? Her struggling disappears, and that withdrawal disappears also.

    It's quite possible you were thinking I was making a joke or poking a jibe.

    I assure you, I am dead serious about this.

    In fairness it will not help and her accent will be a novelty with many who have an interest in our country.

    On rare occasions when I gas up the car, I get I love your accent! where are you from! Now this says to me they are unaware of the English accent and or geography.

    I lived in Yorkshire for over 30 years and whilst not born n bread in Yorkshire I had a twang as they say so it is hard for some to comprehend me as from England, Im either Scottish or Irish, mainly Irish to many as I have auburn hair and thus being stereotyped.

    I too get the blank stare or them saying what did you say or just amazed that they are speaking to someone from England.

    It will pass, I joke with them when they dont understand me and no disrespect to the American people, but many are uneducated and or ignorant to the English language. We, as nations have our own way of saying certain words, we are lazy with our "R's" sometimes and the Americans are lazy with their "T's" it is what it is and always has been.

    Small town Americans have never been out of the country to experience what a select few have and only know Brits to live in fog and go to work on a double Decker red bus wearing a bowler hat and carrying an umbrella! And London spans the length and width of the whole country and if they know someone they immediately ask if you know them as many think the GB is a very tiny island. All this from watching TV.

    This frustrated me more in knowing that their language is the same as ours and yet do not understand! Some of the time anyway!

    The telephone hang ups will get fewer once they know.

    I think you need to sit down and discuss this with your hubby, he should not be frustrated with you, he knows this is all new to you and it is you that should be frustrated, withdrawing and keeping out the way will not help you in acclimatizing to your surroundings, Take the bull by the horns....If they dont understand you, thats because they are hearing words spoken different, you are speaking the same language after all. Its as much of a culture shock for them as it is for you!

    As the days and weeks go on, people adapt to you and you will both learn from each other...Its happening to me daily!

    Hi guys,

    I am lucky enough to have had a job open to me as soon as I arrived as my husband owns his business.

    My problem is I have turned into a nervous wreck whilst I'm there, mainly due to the fact I hate when I am faced with the blank stare after Ive spoken and people haven't understood me. I live in a small, very southern town and some of the locals really seem a bit scared of me (and I of them!!!) There's been a few times Ive answered the phone and had it put down on me,I'm presuming they hear my English accent and think they have the wrong number. I hate to think Im losing my husband new patients and freaking people out. There's a Hispanic community here too, we then have an even more uncomfortable mixture of people not understanding each other.

    I have now withdrawn and am tending to only go into the office when I know other people won't be there......weekends and the day off midweek that we have.

    It's awful not feeling comfortable in the environment that I live in, my husband has been amazing but I know he's getting frustrated with me.

    I feel a total failure right now. Did anyone else have trouble settling in?

  9. We started ours from the day I arrived, putting paperwork to one side and ensuring accounts were in joint names as soon as we could and keeping records of dates and of course making sure our camera was charged when invited to family gatherings.

    Mailing is not allowed outside of your 90 day window, they will only send you the packet back untouched! But you can mail it the moment your 90 day window opens prior to the 2nd anniversary of the GC expiry!

    If you havent started yet and still have a while to go, I would start now doing a bit here and there, trust me it will save time and maybe RFEs later.

    If you download the I-751 from the USCIS site with instructions, it gives the basics of what they want to see, you can then add onto that or expand on what they want.

    Our packet weight a few pounds and was over an inch thick in evidence, but whatever you do, photocopy what you send and keep for your files, they told me that I had left page 2 out from the I-751 when I hadn't, but couldn't argue with them, would do no good!, but it was a quick fix in that I pulled page 2 out of our copy, copied it and returned same day! Cut down on time!

    However, the generic evidence listed by others may be standard, your evidence is unique to you!

    We put a cover letter with ours inviting them to visit at any time day or night!

    Long time no see!
    I've been in this strange bubble where thinking about immigration paperwork and filing were non existent.

    Now back to real life...I feel a little outa the loop of things now.

    My question is, when should I start getting my ROC ready? and how much in advance does it need to be posted.
    I don't even know where to start right now!

    Hoping someone can help me out, or redirect me to a instructional forum.

  10. Its hard for you both and do understand that as the beneficiary I also wanted to start up my own business and not work for a slave driving business, which I have found the majority are!

    It does take a toll on the relationship, but "Love will out- conquer all" as they say.

    We'll see how this unfolds. My wife is a dentist but because of the laws in the individual states, it is impossible for her to work as a dentist here without going back to school for two years, and amass well over $100,000 in debt. And yes, she not only gave up all the normal things to move t the US, she also gave up her thriving dental practice, knowing that she would never be a dentist again--at least not here in NJ.

    We have about 3 1/2 months to decide what to do, and no, we won't lie on the 751 just to get a green card--we are both far too ethical to do that. We do have some possibilities in three states--MN, MA, FL where she can be a dentist and/or hygienist without going back to school, and that would completely upset my business, so we have big choices to make in a short time.

    As to the implications about affairs, pregnant, or other cheating ways--never !! We are just suffering under the stress of her not being able to start up a dental practice here--we both knew that coming in, and the stress is simply much worse than we ever anticipated.

    And do love that girl !!!

  11. Do I need to send a copy of my first NOA?

    Not knowing what your RFE was for.

    I would send the original back with the information they have asked for, but copy it and you keep the copy with your papers so you know what was asked.

    NOA 1 is just a notice to say they have started the process of your application and/or is explaining what they are doing and dont see why you would need to do this as they will have a copy on their records

  12. Why you would pay a revenge immediately? Sometimes, two people just simply realize that their life together is not a cake with whipped cream on top. It doesn't always end up bad because one is cheating over the other. And hence, he is being normal, and humane to work things out for her to remain here. Hate is not the answer....

    I agree revenge or hate is not the answer, but to add to anotherlostsouls, post!

    Look at it this way as all of us will understand, we spent months and weeks apart from the ones we love so much, we yearned to touch and hold each other before our day was over and the same when our days began.

    The agreement for one of us to move country was not an easy one, but one of us had to and give up much in order to do so!

    In my case, I gave up a great job and money, being with friends that took me a lifetime to make, changed a lifestyle and culture so in other words I gave up my life and my home country and put everything; Financially, physically and emotionally into my marriage that I have faith, trust and respect in!

    Our decision was based on the fact that my wife has a large family, we could have a better lifestyle and her kids, grown up and starting families of their own; She didnt want to miss out on that!

    No one knows how that path will unfold and unfortunately things can take a turn for the worse as we are only allowed to spend a certain amount of time in each others country and the visa process also takes its toll!

    It may be the case that they have the burden of guilt, knowing that the other has to try and make a new life here and I will be totally honest, its not easy, I have made a couple of friends, but no one I could turn to in the event something like this happened to me! God forbid it should ever happen!

    In cases like this we can only comfort the other based on what we read and offer suggestions based on what we have read in the past, we are not counselors or the I/O that has the final say and to be honest, I dont think I could be the final person who determines the fate of someones life!

  13. Ok, I may get degraded for my answer here, so I apologize in advance, but from my perspective, have you talked to your wife? Have you ever asked her (since her daughter was born) if she still loves you? If so, are you guys willing to go to marriage counseling? Your status on USCIS's eye depends on these. If you love here, that is great, but if your wife does not love you and does not want to fix the situation than you have slim chances. On the other hand, if you guys would go to marriage counseling, and you honestly told the USCIS that yes, you had a point in your marriage when it was a bit shaky and yes, your wife cheated on you and now have a daughter from another man, but you forgave her, and you would like this marriage to last, and so does she, then USCIS might understand your situation. But for that your wife has to want to change, and fix things and go to marriage counseling with you. I wish you the best, man! I really do. Or if things are sour as lemon, divorce here, and then file a waiver when filing for ROC. Good luck!

    By the sounds of it, they have already filed for ROC and not sure how that would go down as they have been called for an interview.

  14. Wow, hard to believe I've been away from the forum for almost two years. We could have filed in June but waited a few weeks to get everything together. Just sent the package off this week and now reading the horror stories about VSC. Wife has a trip home planned for September so I hope we can get the response letter and the bio metrics soon even if the removal of conditions takes much longer.

    You should get your NOA 1 within 2 weeks provided you have completed everything to their liking and not missing anything! Your NOA 1 will be the extension letter also which extends the GC for a period of one year, within a week you can expect the ASC notice for her appointment for bio metrics which is usually scheduled within a 4 to 6 week period depending on ASC office..

    So think you will be fine with timings on this!

    You do have choices, but as said earlier, you are asking strangers to make your mind up for you! What do you want is what you should be asking yourself?

    Harsh reality check here and not meant to be mean, but this is serious, has she changed or has she realized that she may be seen in a bad light and accused of immigration fraud? That is a question and the answer will be left to USCIS I/O and yes he will listen to all that you both have to say on this!

    This my friend is down to you, it is easier to forgive than to forget! Next time you are home alone and she is out with friends or working, will it not cross your mind as to where she is and more importantly, what she is doing?

    I will assume this is not a troll post also; You know what I would do as I have said already, but to enlighten you further and please bare with me, but you have given up your life in your home country for a woman who has admitted to cheating on you, fall pregnant, may be yours, may not, but a DNA test will verify this, you are now financially obligated to a child that is not living with you, but with someone else, she has a previous marriage to a CR-1 beneficiary who we can only assume is still under the I-864 conditions...In other words, your wife has to support him until such time they become a citizen or 10 years has lapsed!!! Not only that, but you have a dependent child whether you like it or not and someone has to help with raising of the poor child!

    I would see choices here and know exactly what I would do!!!

    I have so many concerns over your post and feel that so will USCIS, I would seek legal advise on this and not ask in a publc forum such as this..

    My situation is kind of messing up. I married a usc for almost 3 years now. While we been together she cheated on me once and pregnant with another man. but because we are still love each other so we decide to stay together. During that time I got my 2 yrs green card , she gave birth a girl. We decided to put the mans name as the father of the girl. now the girl live with her dad not us. When the time came for I 751 , I filed it without putting girls name in the form coz she's not mine. Then I got RFE, I responded, then I got a letter saying to wait for an interview.

    What should i do in this case?

    Should I tell the truth or pretend like nothing happened untill they ask?

    Should I divorce?

    Umm silly question, but you ask " Should I tell the truth or pretend like nothing happened" You have the paternal fathers name on the child's certificate of birth??? I am going to take a long shot guess here and say this is why they have asked you in for an interview!

    Also you state "she cheated on me once and pregnant with another man"???? That means she has cheated you twice!!! As I read it anyway!

    I can not see how you can pretend that nothing has happened, USCIS are trained to tell if people are lieing.

    In essence my friend! Tell them the truth, the whole truth and nothing but the truth!!!

    If it was me in that position and lucky for me I am not, I would divorce her, sell up, surrender my GC and go home!

  17. Anyone know if sealed juvenile records from Canada have to be revealed for green card or naturalization? In the I-751, it asks if you were arrested, but I was told that with a sealed record, I could legally say no to that question and that it is as if nothing ever happened. If I say no to being charged with anything on the I-751 or green card application, and then say yes to having a criminal charge to the citizenship application, will my application be denied? in the citizenship application, it states" if you were arrested which includes sealed or expunged records". This, I understand, I would need to say yes. Would this affect my application at any stage? I know that my criminal check resulted in nothing, and I never had to go to court. I can't find records for this anywhere either. thanks in advance.

    I declared mine from start to finish, always tell the truth whether its sealed or not! A lie always comes back to bite you when you least expect it!

    Luckily I was 14 at the time of verdict so my atty told me and would not cause concern! there is a wikipedia entry on CIMT and juvenile convictions, worth a read!

    I am not an attorney nor do I make any claims to be one .. I have been reading threads in vj for well over a year now .. most of my comments come from reading other's experiences coupled with my own

    I started with a 129 and then changed to a 130 after I found out my marriage was legal ... go figure

    To be fair they read from cards about topics asked upon and would safely say to call one of them an idiot for doing what they are told to do is a bit unfair.

    However you are correct in that the next level should be requested as you should get a more accurate reply!

  19. Well boarding passes are a great idea but are not absolutely necessary if you don't have them because people can lose those. They won't expect you to travel all the way to see each other again just to obtain them. But if you have any primary evidence such as receipts, boarding passes, credit card bills etc. that put you and him in the same geographical location then collect all of those and send them to him. Also, another thing would be to show evidence of recent correspondence since you received the petition approval. You might also want to both write a new and updated letter of intent with it clearly dated and signed by both of you to indicate you are both still in a relationship and both still intend on marrying since the petition approval.

    In fairness they are very important and I would say very necessary! Especially for the fiance process as it is evidence that a person may have used it to board a particular flight to arrive at said destination to meet the other, that on its own may not be solid proof, but backed up with an invoice and photos it holds weight.

    Without the boarding pass and photos, how else can it be determined that a couple have met? Given the powers of technology and computers these days! I am not saying for one minute that anything anyone has submitted is or has been tampered with!

    I have always said and will remain in the corner by saying throw anything and everything at them even if you think its weak, but it may be the one piece of evidence/information that ties it all up.

    Bare in mind that USCIS can check to see the point of entry details of past visits if dates are given to be verified
