  1. I'm officially a Citizen!

     

    The process in Orlando was straight forward. I arrived 30 minutes early went to reception and told to sit and wait to be called. 30 minutes later an officer came out to ensure we all had the reverse of our I-485 completed and had our green cards ready. I was part of a group of approx 50 to be naturalized. We where lined up in the waiting area and brought over and split into four lines. When I reached the end of the line they took my green card, double checked my form, ran through the questions and asked that I go to the ceremony room. Into another line and again my document was checked once more, I was directed to the next staff member who was seating (as we arrived in no order) the soon to be citizens. She took my paperwork had me take a seat. On the seat was a packet, inside a voter registration form, passport application and a small booklet and a document running through how to acquire citizenship for children under the age of 18. On top of the packet a small flag of course.

     

    The ceremony lasted approx 45 minutes, there was a short video at the start about the history of the US and it's immigrant past. A short speech by the director, voter registration lady spoke and gave excellent information, another speech by I believe a regional manager for USCIS who then swore us in. We stood for teh pledge as citizens another short video was played. We where then issued our certificates as we exited our assigned seats. Then out to fill in that voter registration, take a few pictures and out into the world a freshly minted citizen of the American Republic.

    Congratulations, I got the exact same thing at my interview last month. Things here (Florida) went from "A decision cannot be made" to.. "in line for oath ceremony" and most recently "scheduled for oath". Your almost done with this process.

    Thanks. I suspect two things, one was conviction as a minor age 13 (early 90's) which involved a discharge no detention from back home. The other less likley to cause issue was a typo on my application where it looked like I was out of the country for a year. The typo was noted and corrected. Otherwise it appeared as if all was good. From talking to the IO I got the impression I should be approved once my case has been reviewed by another IO/Supervisor.

  4. I entered the US in November 2005 as a K1, at the time I was 25 years old. I obtained residency on or around October 2006 at which point I was months into being 26 years old. I thought I had registered for Selective Service way back during AOS but apparently I haven't. At the time I was under the impression that the K1 is/was a non resident classification which I believe would be why I never registered. I didn't register after I became a resident because I was then 26 years old. Anyway fast forward to present I've been in the US 12 years and a resident for almost 11 years this year and my naturalization interview is days away. 

     

    From what I've read thus far I shouldn't have any issues regarding selective service however I also have no evidence either way to prove anything other than the fact I never registered. Which kind of annoys me as I've evidence/documentation to cover just about everything else. I did go to sss.gov and I did do a search which returns no records matching my name/SS number. It's a non issues but there's always something that wants to nag at us when we're days away from an important date.

     

    Anyone else here have any issues regarding Selective Service or other issues during or after your naturalization interview.

  6. Everyone thank you very much for your replies and the information. Me and my fiancee really appreciate them all. We are worried for a possible denial, and all your responses have been really helpful in this stressful time period. I would like to give more details, The arrests were in May 2015 (Trespassing/Fail To Leave) and in July 2015 ( DWI 1st-Offense) I have a conditional discharge from this conviction which will last 3 years. Would it be a problem to apply for a K1 Visa during the time of the conditional discharge? Thank you all so much once again for trying to help! God bless you all. I would also like to add that my record in Turkey is completely clean, I don't even have a non-criminal traffic offense here.

    I don't mean to be blunt but be prepared for the IO to look at it like you have a problem drinking and/or making the right decisions when under the influence. Those two convictions are very, very fresh. A conditional discharge is from what I understand to USCIS a conviction it's not probation. The conditional discharge was your sentence (without actual punishment) for the crime committed. It typically means you have certain conditions to meet such as not drink driving or not being arrested for anything alcohol related however you typically don't need to meet with or be supervised by a probation officer. Your conditional discharge will be compete at the end of the three years given you haven't broken the terms of the discharge. Break the terms of the discharge and the judge could impose a prison sentence, take away your license and/or fine you. That discharge will remain on your record and be seen by USCIS. It goes without saying at no point in the present or future (even 10 years form now) should these facts be hidden.

    My personal (not a lawyer) advise would be to stop drinking! Read the guides here, google the K1 process and gather ALL paperwork ahead of your interview. Don't attempt to hide anything from the embassy, be honest and factual when asked questions and have evidence to backup what your saying factually. Don't go in shooting from the hip or driven by emotion. You need to be business like and go over prepared. You shouldn't have any issues, you can go the lawyer route if funds allow and follow their advice to the letter and you'll most likley have the same outcome. Lawyer's can't sway the system anymore than you or I can they can just interpret the law provide advice and what they believe the best course of action is and of course coach you on how to answer questions the right way.

    The points I was trying to make.

    1) petty offense exception relates to CIMTs. Therefore it's not relevant to OP's situation who does not seem to have any CIMTs, only two non-CIMTs (lawyer's confirmation would be prudent to obtain regarding this, but that's how it sounds)

    2) petty offense exception really only works for ONE CIMT. Several CIMTs even if relatively minor crimes (I'm using the word minor not in a legal but a general sense) will lead to problems and can't separately dealt with using petty offense exception

    3) I never claimed that waivers would be needed or OP would get denied. Only that because of the simple fact OP has some things on his criminal record, it would be prudent to consult with a lawyer to make sure these wont cause a problem.

    Your points are understood however I disagree with a few things.

    1. There are no petty CIMT's that I'm aware of. There's no known to me at least shades of CIMT's. CIMT's appear very black and white. The OP can always get a lawyer and when in doubt it's always a good idea however from what the OP has posted they won't have an issues as long as they are honest and present everything and answer all questions. However the OP should do what is best for them in their situation.

    2. I think your confused on exactly what is a CIMT https://en.wikipedia.org/wiki/Moral_turpitude If I'm wrong, something has changed please do enlighten me I'm always up to learn something new

    3. I didn't suggest nor intend to suggest the OP would get denied and the shouldn't if they are honest at their interview. I agree it's always best to be safe and hire a lawyer if there's a clear and specific need to.

  8. You should look up what the petty crime exception actually IS. First of all, it's for CIMTs that are minor offenses. Second of all, it really only applies to ONE offense, not several.

    If neither of OP's offenses were CIMTs then he doesn't need the petty crime exception anyway.

    I have looked it up but thanks for the link to a law office. CIMT's and minor offenses are two separate types of offenses. You can't have minor a CIMT, the system appears to be very binary in that way. At least it has been in my experience thus far. The OP's offenses are not CIMT's from my limited (10 years) experience navigating the system. The same as the OP I've SEVERAL offenses that are not CIMT's but are minor in nature. Yet I'm here, no waivers, no denials.. nothing.

  9. The petty crime exception is for ONE crime only. You can't have several and claim petty crime exception on each and every one of them, that's not how it works.

    Where are you getting that information from? I don't remember coming across anything that says your allowed one petty crime but two and that's it. Now I understand if the IO see's three DUI's then yes there's a trend there however a DUI, a trespass charge at separate times/places shouldn't cause any major issues.

    Both of OP's crimes happened in the US, so while he needs a police certificate from Turkey (to show there is no criminal record there), OP needs to obtain criminal history/court documents from the US where these crimes occurred.

  10. It really isn't an issue but it is wise of you to cover your bases like this. I believe the true intent of asking that question is to ensure you didn't register to vote, attempt to get a passport, attempt to enter the country and claim to be a USC etc.

    When buying a home here, first and second time they always default the paperwork to USC which I know is what they do but I demanded they change it. I didn't let them cross it out and initial it I had them reprint it which stalled things and made everyone act as if I was being unreasonable until it was explained to them what that simple check box means if found at a later date and dragged up. I can without a doubt understand your being cautious.

  11. I came to the US under a K1 with a juvenile criminal history without any major issues. I got through AOS too without issue even though it meant rehashing the same old things from when I was 13. I was up front, honest and declared everything. It appears your on the right track with the DUI that alone shouldn't bar you entry under a K1. The thing you should do before you have your K1 interview is understand that the IO won't care about the emotion of the (night club) incident as you might. It's all very black and white to them, did you admit guilt? It seems that way and as far as they are concerned you are guilty. Regardless of anything you might think or want to say, even believe. Do not appear to justify a crime that officially acknowledged your guilt be honest and remorseful or face the potential reality of filing a waiver and waiting longer or worse... The Oompa Loompa regime takes office and suddenly you no longer have legal grounds for a K1 or AOS. I'm hoping that takes them time to change however I expect in their small minds they'll want to move fast.

    I'm sure your aware they will want and acquire a police certificate/criminal history from Turkey. If there's anything on record there be prepared to disclose it and be questioned on it. Time since the crime and your age at the time does factor in too. How long ago where these incidents if I might ask?

    ​So I've made it through the K1 Journey - thus begins the AOS Journey! haha

    My question is ... seeing as the AOS processes around the same time as the EAD i-765, is it really necessary to do the extra paperwork for the EAD?

    ​I mean, once our status is adjusted, we're eligible to work yes?

    Orrrrr is it just worth doing the I-765 in the event the AOS is delayed for some reason?

    That depends on how badly you need or want to work which will require an EAD prior to being granted conditional residency. If processing times are about the same I'd wait if you can afford it however any delays with your residency and well time is money here. Once your approved for residency you should receive an I-551 stamp in your passport at the interview. This will be good for one year and hold you over until the conditional resident card arrives in the post. At that point you can legally work or if you have an EAD you can legally work. Once you get your conditional resident card I highly recommend you get over to the Social Security Office and get a SS Card that hasn't got the "Valid for Work with DHS Authorization" or worded similar on it. It makes life easier when filling out I-9 when being hired. You can get away with just a SS Card without the notation above and a valid drivers license. No need to show a resident card to HR and they can't ask for it. It'll also prevent HR from over stepping their bounds and demanding to see an unexpired resident card after the one on files expires. Last thing you want is HR telling you, you can't work. This is from personal experience.
