  1. well we did meet today but the conversation didnt go as well as i expected.at some point my wife took my 2 bottles of my expensive cologne,ran outside n threw them n broke them. so the neighbours called the police, when they came i explained what happeed n my wife also admitted so they took her to jail. i got a paper from the police officer and they told me i can get a restraining order. im sad i have to do this but i will divorce her.

    Is the restraining order enough for self petition?

    You are going to need a lawyer for your divorce proceedings, wouldn't hurt to get one that has experience in immigration law. I think that in a way it proves the basis of an immigrant visa, to marry in good faith, but she is just not mentally fit, at least now, to be in one... There is a record of abuse now, so you have that going for yourself.

    Yes, what I said was in response to a 'send her back/put her on a plane' comment, sadly I thought that people would be able to discern the context of what I said. Did I really have to be more specific that I didn't mean every single VJer in every scenario? Really? You can't tell the context?????

  3. what benefit is there in having RFID? so govt can keep all your info in one place, your entire family tree, even your blood type on a handy dandy datebase (as well as on the chip in the NIC)... why would you want that, for what purpose? other than to have a big brother society.

    excuse me if i'm not willing to have all my info in a govt database becasue you're too lazy to keep track of your own info.

    and just because people misuse their SS# isnt a reason to give away rights of privacy. SS# is for income purposes ONLY.

    driver's licenses vary from state to state, they are in no way a "National Identity Card" as you are craving, though they can be used as proof of ID.

    This. Has anyone thought what the hell would happen if a hacker, ubernerd or whatever were to change some of that info just to punk you? Imagine having our finances integrated to this mess... Oy.

  4. I suggest that you look for more advice, because even if most of the help you have gotten here says otherwise, I would tread carefully here. During my interview the IO asked if I had children abroad, by other women, in "any part of the world" (quote). If you get the same question, and you happen to say yes, without it being in the application, it may sound fishy to the IO (not to mention you are under oath when interviewed). My IO went over each single form with me and my wife, one question after another.

    Remember that as a resident, you are expected to comply with certain morale obligations, like child support, regardless of his/her location. Also, this should also be on your family budget, raising the bar on your obligations as far as income is concerned.

    Not saying to omit your child, nor document him/her, instead look further into this before you make the call.

    First of all, I'm not telling the OP whether to stay or go, that is his choice. How in the world would I be one to judge better than him?

    Also, I already said 'I'm speaking generally and not this case specific' (did you both miss that???)...I see it here all the time 'put her on a plane, etc' IT'S NOT THAT SIMPLE AND THAT DOESN'T WORK.

    And Happy Knappy, you said 'almost positive something will happen'...at the end of the day, that's nothing but lip service, that ICE has heard a million times over....nothing's gonna happen with just anecdotal hearsay, which at this point, unfortunately, is what his allegations are. So your advice worked out to a hill of beans.

    If the OP is going to leave his wife, and try to make a case for fraud, the best advice you can give is to get HARD EVIDENCE...you know, something tangible. I don't know what that actually can be, tbh. Perhaps an email, but even those can be altered, so I honestly have no idea what will serve as incontrovertible proof, but that's what the OP needs, not some wishful thinking 'oh something will happen most likely, i'm pretty sure'.

    There is fraud involved, but anyway, it would take a small IQ to take my statement as a promise, instead of wishful thinking. I am not the authority in charge of these things, but I am sure the OP found it helpful to give ICE a call.

    The affidavit of support is serious business, and there's no way in hell it comes with a "you make your bed, and now you lay in it" clause, even less so when the USC was duped.

  7. She has her green card now. I guess that she thought that was all that she needede but then found out that she had to stay married for 2 years so now she is trying to do what she can to stay.

    I expect that the next thing is ask if we can work things out. I think that now that I know what is goinjg on there is no hope for that.

    What is VAWA? Who do I call? I tried the # that I had but can't talk to anyone. Do you have a # that I can call?

    If you report what you have told so far, about her intentions regarding your marriage, and her plans to live in separate rooms to USCIS and/or ICE, I am almost positive something will happen, maybe even revoke her benefits right away... It is clear she duped you, so I suggest you listen to the advice given by fellow posters. DO NOT disclose anything to her about your plans to avoid a counter move... Things can get hairy real quick when dealing with these delicate matters.

    Of course, this is up to you, the choice to go on or not lies with you. Good luck.

  8. I agree with this statement. Vietbride is too harsh but agree with her as well.

    While it is difficult to go back to your country, is it reason to trump up VAWA charges on US Citizen / LPR just so you can stay in the US? You can't force your US Citizen/LRP Spouse to file for your papers if things are not working out. Hardship waiver is something you can use if it is too difficult to go back (not abuse charges).

    It does seem like every marital breakup leads to VAWA if you were to read this forum. People start thinking about how to file VAWA and what documents do they need immediately as soon as word breakup is uttered.

    Oh, it's up to the poster to decide what he will do. I don't think he is going that route just to stay, it is a combination of all mentioned factors. He is between a rock and a hard place, because if things truly are as he says, he entered the marriage in good faith, and under that context, he should have the right to have his case heard by the proper parties. Also, the USC should not get a free pass for her conduct. Whatever happens she should still face the consequences, again, if things are as the OP states.

  9. I am sorry to hear about your situation, hopefully someone like Jim will shed some more light into what can happen. The only thing that I can tell you, aside from the judge that gave you a break, people in overstay (out of status) or in removal proceedings may encounter problems when it is obvious that they got married to avoid deportation. In your case, I think it's true, but with the difference that you had lived with your then gf and then married, proving in a way your relationship was in good faith to begin with.

    To USCIS you are still in removal proceedings, resulting in your denied petition. I am sure that your I-130 will get approved, but no so sure about your AOS. Jim?

  10. Subscribed. Belief in an invisible sky man is, imho, delusional no matter what you want to call yourself. Therefore, I propose a new rule: if you are going to attack someone's religion, you must disclose your own so I can expose it for the woo that it is.

    It may be a fair approach, but why would my beliefs be mocked for someone else's narrow minded views??? Not saying that I am ofended, but it may not be the same for other VJers, y'know? Religion is a big tangled mess that you don't want to get caught up in...

    Drugs are illegal for everyone because of the excesses of the few.

    The blanket moratorium on offshore drilling punishes the innocent along with the guilty

    for the actions of one reckless company (BP).

    Sarbanes-Oxley punishes all public companies as a class for the sins of a few Enrons.

    Collective punishment is a principle ingrained in our legal system, whether you want to

    admit it or not.

    That has nothing to do with democracy, more like survival. And, to add to this, people will want to protect from the negative actions of the few, meaning it's one sided. That will happen anywhere regardless of religion or pollitical views.

    Drugs are illegal because of what they do to a person(both mentally and physically), not because of a few boneheads thst decided to snort some coke. Even if there was one heroin addict in the whole wide world it should be illegal, just because it will deteriorate a human life.

    You can look at things as collective punishment in a legal system, sure. But, a legal system is a set of norms that rule over a society's behavior looking for the common good of its members (yeah, textbook - ish, but you get the picture), in a specific place, and specific time (because of reforms and addition of new laws).

    Having said that, laws will regulate similar situations, and will impose pretty much the same consequences/penalties as such.

    Sorry, buddy. I see your point, but I want to make sure that we have facts going straight, to avoid further logistic complications. The Incas were settled way south, like Peru and Bolivia. We had Aztecs, Mayas, Zapotecs, Olmecs, etc. :D

    What's also not surprising is that someone who clearly shares the exact same views as the posters you mention, posts like them. :lol: They too can go on for hours without ever answering rudimentary questions or discussing the OP or anything within its scope.

  14. Why were you suspend then if you did no wrong? Ever since you joined, in what June this year, you have come on and antagonized people who clearly don't share your beliefs. The majority of your posts are filled with clever jargon and witty comments rather than discussing the topic. I've let it slide, yet when I point this out, you then accuse me of "crying to the mods". Cleo on the other hand, seems to have selective outrage as your insults masqueraded as posts do not offend her, just anyone who disagrees with you.

    As to your grudge comment, think about the bottom line you posted, now read and think about the context of the post again. It's not a grudge at all, simply pointing out that though those posts contained insults, yet she had no problem with this. Whereas, the use of gringo was offensive. In other words, it basically illustrates that she has double standards based on her opinion of the poster. As you said, "no matter how much you want to hide something," like being biased and hypocritical "it is what it is."

    Ok, I defended my point of view, you are right.

    Funny how the spotlight of my comments then turned (and had remained) on you though... Maybe Cleo, Madhouse, AJ, think the same about you, but they could only say it so many times. Again, you are not gonna change, why would our perception of you change?

    It's also interesting that for a... person of your caliber, that doesn't hold a grudge, you have a very clear recollection of what I have said so far. I won't go into it anymore, I am really not interested, but again, it is what it is.

    I'm done, and I think everyone else who jumped on this free publicity ride for our fellow poster, should just be done as well.
