  1. Hi Everyone,

    Still no Biometrics for me and it's almost 3 months already from the time I received NOA1. I already called for Service Request, got their letter last Monday and was told I am in their system but no slot available yet.

    Anyone with a similar experience? Should I do infopass? I'm starting to become worried because my AOS is moving on a snail's pace and my daughter's NVC is moving faster than I expected.

    I submitted my daughter's DS3032 today and paid online, although I have yet to pay the $400 and DS230 [i think!]I wouldn't want her visa to come out first before I can adjust status because I want to be able to go home and be with her during her interview. Is it possible that her visa will get approved first before mine?

  2. I have the same problem and called USCIS to get a service request also. They told me that the case keeps being processed even when the biometrics haven't been submitted so it looks like your case s in it's final stage and all you need is to get the appt letter and do the biometrics.

    You can probably just wait until you receive it, they'll probably send you a letter if there's a problem anyway. As long as you checked with them to see if it wasn't sent already and lost in the mail, I wouldn't worry too much about it.

    I have a question though, when I called today, for the service request, I only gave the receipt number of the I-485 but after the call ended, I realized that maybe I should have given them the I765 number and all other files. Or maybe the service request for I485 will cover it all anyway?

    What receipt numbers did you give them?

    I gave them my I-485 receipt # and my Alien no. You can find these info on your I-485 receipt notice. I just figured that I needed to give them the I-485 because my 765 was filed concurrently with it. I don;t know really but for now I just know that biometrics is keeping in the way of my processing. Anyway they should give you a referral ID during your call and 2 weeks later you should be getting a letter acknowledging the service request phone call.

    Right now, I'm annoyed because it's taking forever for my paper works to be done. We can't make plans or anything unless this is done.

    I called USCIS on Sept.24 to make a service request about my biometrics. I haven't received my biometrics since I filed my paper work last June, that's why I called for a service request.

    Today, I received a letter from USCIS acknowledging my service request and this is what it said:

    Your case is awaiting the required Biometrics submittal, and is currently in suspense until you complete this process. Your application information has been entered into the system which schedules applicants for biometrics at their local Application Support Center. Biometrics appointments are scheduled as slots become available at the ASC. Once you have been scheduled for an appointment, you will receive ASC appointment notice to appear at a certain date and time at your local ASC. You must take the ASC appointment notice and photo id to your appointment.

    What do I do now? Should I just wait for the Biometrics letter? Should I schedule infopass?

  4. We did it ourselves., as long as you read and follow instructions carefully I don't see why you can't do it. As you said, you are a paralagel and you can put your experiences to good use by helping your son in law. In our case, sometimes the paper works became too consuming, confusing, and overwhelming and when that happenened we turned to this forum and did some research on the web and the USCIS website. You can perhaps use your connection as a paralegal to find someone who does immigration. We were very ####### with our paper works, and made sure that it will be easy for USCIS to distinguish which forms and paper works go with what.

    Anyway, there are a lot of people here on VJ who can help you and you can learn from their experiences as well. You can also save money.

    NBC received my RFE response for 2009 Federal Tax return of my husband on the 19th of August and today they "touched" my i-485 stating that it's being processed again.

    I know that processing of my case stops until RFE is submitted but I was wondering then, some here have actually done their biometrics prior to their RFEs. Reading those actually made me paranoid, I already want to call USCIS but I was thinking that perhaps I should give them a week at least from the time they have received my RFE response.

    do ou think I should give them a week more?...lol

  6. Hi there... I'm afraid I don't have much help to offer... I'm pretty new at this myself... Just out of curiosity... What was the RFE about? t might be possible that the information they requested is needed for them to send the Biometrics...

    The RFE was the 2009 Federal Tax Returns of my husband for the I-864 of the I-485.

  7. It's mostly luck, subjectivity and depends on how the consul interprets and assess the necessary documentation given. There's nothing much you can do as the burden of proof that she is returning to the Philippines is on her. If she's single, it's quite tougher to get through. But like everyone says, there's no harm in trying who knows lady luck is on her said the day of her interview. :D Good Luck!!!

    Are you from Davao City or Tagum? I am from Davao City. We are currently living in NY but looking to move to Cape Coral/Fort Myers area next year. We have been looking at quite a few houses and will probably be travelling there between September or October to buy a house.

  9. Hi Everyone,

    I have been reading people's post and found that they have done their Biometrics sooner than 30 days or even before they had an RFE, in some occasions. If you check my signature you can see my timeline and please let me know if I should start calling USCIS.

    It's been 53 days or 37 working days since I got hard copies of NOA1 and then 14 days after I received hard copy of RFE for I-485. RFE was sent last 16th of August. If I'm going to get my biometrics after they received my RFE response, should I start to count againt 30 days thereafter?

    would appreciate all your replies. :)

  10. I agree with everyone..di nya pwede iprocess yun Fiancee Visa kung di pa sya annuled dyan..also, kung sakali magrant na yun annulment nya,ipadouble check mo lang yun instructions about petitioning you kasi na acquire nya yun green card and citizenship nya by marrying a US citizen dati...

  11. Hi Everyone,

    We got our RFE today in yellow paper for I-485. They are asking for "Federal Income tax return submitted to IRS in the most recent tax year".

    My husband hasn't filed yet his 2009 federal Income Tax return, he usually avails of the extension and so he is filing in October which he usually does. We submitted 2006 to 2008 Tax years paper work [ W2's, Form 1040 + schedules & form 1099], for 2009 we only submitted w2 and form 1099 as he has not filed yet. We have mentioned this on our cover letter and explained to them he's filing late, obviously they have disregarded that.

    How do we go about this? Should my husband file his federal income tax now and wait for the paperworks from his accountant before responding to the RFE? or should we send a letter explaining the situation?

    Your help will be greatly appreciated.

  12. I got NOA1 hardcopy for my daughter's I-130, & check cashed. My I-130, 765 & 485 were also "touched today. But on the website they said that they sent me an RFE for I-485 last July 9. I'm expecting it anytime this week. I can only speculate as to what it's going to be. I sent I-693, I-864 with w2's and form 1040 and its schedules, pay stubs and all. It's driving me up the wall. :crying::crying: I went through most of the posts here on VJ regarding RFE's on I-485, and there are really different kinds they ask for. I'll just probably have to wait, impatiently!!!

    Let's keep each other posted so we'd know how each of us progresses.

  13. Her personal doctor said it could be a beginning case of asthma due to complications of allergic rhinitis. Now would that be a reason to show up as a positive result on her sputum test? Aren't they looking for serious cases like TB, bronchitis, or pnuemonia. Any advise is appreciated

    I'm sorry to hear about your situation. I know waiting is such an agony.

    I am an asthmatic, I have both bronchial and skin asthma [atopic dermatitis/eczema] and used to have bad asthma attacks when I was still in the Philippines. Allergies & Asthma go together in my case. Rhinitis can be triggered by allergies. When I went for check ups I remember that whenever my pulmonologist would make a request for chest x-ray it will always come out to be inconclusive and so I had to do another kind of x-ray which was called the alv or something like that. It's basically from my chest down to the lumbar area and it ruled out other suspicions of my doctor especially tubeculosis.

    I hope that everything works out fine, there's no harm in seeing a pulmonologist as this is their area of specialty and just to make sure that she's clear, if its just a case of asthma I don't think she needs to be worried about that. I have gone through this a lot of times in my life that it never alarmed me if my chest x-ray comes out inconclusive or they need further testing. But all the time it was always negative of any serious ailment.

    I hope somehow my story lessens a bit of your anxiety. Goodluck and hope that everything turns out great for both of you. :)

I'm not sure if this will help but my former housemate didn't take the the Philippine board, she applied to take the NCLEX exam here in New York, she passed and now she's a nurse working in one of the hospitals in Queens. She did a self-review, went to the library for additional books and resources and took the online review tests.
